On November 10, 1987, the Ministry of Public Security issued the "Measures for the Administration of Public Security in the Hotel Industry" (hereinafter referred to as the "Measures"), which is the "predecessor" of this "Regulations". Promulgated by State Council Order No. 588 on January 8, 2011, some provisions of the "Measures" were revised and shall come into effect from the date of promulgation.

To establish a hotel, you must apply for a special industry license

The "Measures" that have been implemented since 1987 stipulate that to open a hotel, you must apply to the industrial and commercial administration department to obtain a business license before you can open a hotel. The new "Regulations" clarify that after establishing a hotel and obtaining a business license issued by the industrial and commercial administration department, it must apply for a special industry license from the public security agency of the people's government at or above the county level where it is located.

Applying for a hotel special industry license must meet certain security and safety conditions, including the installation of hotel industry security management information systems, resident ID card reading equipment and other accommodation information collection and upload facilities, and necessary anti-theft and video surveillance and other security prevention facilities, including security agencies or security personnel.

After accepting the application, the public security organ shall review the materials, verify the conditions for opening the hotel on site, and make a decision within 20 days. Anyone who engages in hotel business without obtaining a special industry license in accordance with the law, or whose special industry license has been revoked or revoked, shall be banned by the public security organs, the illegal gains shall be recovered and fines shall be imposed.

The directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the relevant provisions of the "Public Security Administration Punishment Law of the People's Republic of China".
