According to the Notice on Restricting the Purchase of Multiple Commercial Houses (Qiong [2065438+07] No.96, hereinafter referred to as Qiong [2065438+07] No.96) jointly issued by the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Land and Resources and the Notice of the Provincial Department of Housing and Urban-Rural Development and the Haikou Central Branch of the People's Bank of China (Qiong).
First, define the scope of purchase restriction.
From the date of promulgation of these Detailed Rules, in addition to the newly-built commercial housing listed in the notice of Beijing J&F [20 17]96, our city will include property-based hotels and second-hand housing (referring to commercial housing and affordable housing that have obtained the property ownership certificate or real estate license through initial registration or first registration, the same below) into the scope of purchase restriction. Suspend the sale of newly-built commercial housing, second-hand housing, newly-built and second-hand property-owned hotels to Hainan non-registered households with 1 set or above commercial housing (including ordinary houses, high-grade apartments, low-rise houses and serviced apartments, the same below) or property-owned hotels in the city.
All or part of the property rights of 1 set of commercial houses or property-type hotels owned by non-registered households in this province (subject to the online signing and filing of the transaction contract or property right certificate) shall be regarded as having 1 set or more commercial houses or property-type hotels.
Second, clarify the qualifications for buying a house.
Non-local registered families who do not own commercial houses or property-based hotels in Hainan can apply for the first purchase in Haikou, a non-restricted area stipulated in these rules; Non-local registered families without commercial houses or property hotels in Hainan, and 1 family members who have continuously paid social security certificates in cities and counties of our province for more than 2 years, can apply for buying houses in Haikou for the first time, as stipulated in these detailed rules.
Non-provincial household registration personnel who purchase houses in our city are subject to purchase restriction on a family basis, including couples and minor children. When a resident family applies for buying a house or applying for a commercial personal housing loan, it must first issue a certificate of no family purchase record by the housing construction department and a certificate of no family housing by the land department.
Third, set up a restricted purchase area
The restricted area referred to in these Rules refers to the area west of Binjiang West Road, east of Changtong Road, north of Nanhai Avenue and Hongcheng Lake (including Haidian Island and Xinbu Island), and the closed area south of Yehai Avenue, north of Ring Expressway, west of Tielong Road and east of Yuehai Avenue.
Fourth, increase the proportion of property-based hotels.
From the date of promulgation of these Detailed Rules, the sales proportion of the property hotel project shall not be higher than 10% of the saleable area of the project, and the remaining 90% must be used for self-sustaining operation. If the sales proportion of the original sold projects has exceeded the above proportion, the sales will be stopped immediately, and the newly approved projects will be sold in strict accordance with the prescribed sales proportion from the date of implementation of these Detailed Rules.
Five, further restrictions on the transfer of existing homes
From the date of promulgation of these rules, newly-built commercial houses purchased by enterprises, institutions, social organizations and other legal entities must be registered for five years before they can be transferred.
Intransitive verbs further implement the differentiated loan policy.
If residents buy a second set of commercial housing in this city and the corresponding housing loans are not settled, the minimum down payment ratio for applying for commercial personal housing loans shall not be less than 70%.
Seven, strengthen the transaction qualification examination.
Non-residents of this province should provide a transaction commitment letter before buying a house or transferring ownership (prospective buyers promise that families do not own commercial houses and property-based hotels in our province; The transferor intends to prove that the commodity house or property hotel to be transferred has reached the time limit stipulated in the Notice of Beijing jjf[2065 438+07]96 and these Detailed Rules, and promises to be qualified for trading. After the housing construction department and the real estate registration management department have passed the qualification of buying a house or transferring it, they will sign a house purchase contract or a house transaction contract for online filing after confirming the transaction qualification. In the process of purchasing or transferring the house, if it is verified that it does not have the trading qualification or the promise is false, its trading qualification will be cancelled, and it is not allowed to trade again within 1 year.
The housing construction department and the real estate registration management department are responsible for reviewing the qualifications for the purchase and transfer of commercial housing. Real estate information management system (online signing system) should realize real-time sharing and unified query of online signing data of commercial housing. The housing construction department and the real estate registration department shall establish an information sharing mechanism, and the real estate registration department shall exchange the real estate registration of commercial housing to the housing construction department in real time to realize information sharing. The housing construction department shall determine the purchase and transfer qualifications of commercial houses, property-based hotels and second-hand houses according to the online signing and filing of commercial houses and the registration of real estate.
Eight, strictly review the trading behavior.

Strengthen the management of price filing. From the date of implementation of these rules, enterprises engaged in real estate development within the scope of this Municipality shall, when handling the pre-sale permit of commercial housing or the sale of existing houses, declare the price to the price department for the record; Before the implementation date of these rules, those who have obtained the pre-sale permit or handled the sale of existing homes, but have not reported the price to the price department for filing, shall complete the filing procedures within 1 month after the promulgation of these rules. If the price is not filed within 1 month, its pre-sale qualification shall be suspended according to law.
Should real estate development enterprises strictly implement it? One room for one price? Do not use false or misleading price forms to trick consumers into trading with them. After filing 1 year, the sales price shall not be raised at will. If it is really necessary to adjust, the price must be declared again for the record to prevent arbitrary price increases.
Intensify investigation and punishment according to law and strictly enforce market order. Items that have not obtained the pre-sale permit for commercial housing and property-based hotel rooms shall not be pre-sold, and shall not be charged or charged in disguised form. For real estate development enterprises and intermediaries, false propaganda, hoarding of housing, real estate hoarding, artificial shortage of housing, driving up housing prices, clearly marking prices, illegal sales, selling more than one room, Black intermediary? And other illegal acts, once verified, shall be severely punished and publicly exposed. If the case constitutes a crime, it shall be transferred to relevant departments for criminal responsibility according to law.
Ten, shantytown renovation projects, talent purchase (in line with the needs of industrial development in our city) and other policies shall be formulated separately.
XI。 Matters not covered in these Rules shall be implemented in accordance with the provisions of Notice No.96 [2065438+07].
