Article 5 When performing their temporary resident population management duties, public security organs and temporary resident population management stations shall adhere to the management principles of openness, convenience, efficiency, and civilization. Public security organs and temporary resident population management station staff should abide by laws and regulations, provide high-quality services, enforce the law in a civilized manner, act impartially, and consciously accept supervision during the temporary resident population registration and management work. Article 6 Temporary residents shall abide by laws, regulations and relevant provisions of Xiamen City, and abide by Xiamen City Citizens’ Covenant on Civilization. The legitimate rights and interests of temporary residents are protected by law. No unit or individual may discriminate against temporary residents. When the legitimate rights and interests of temporary residents are infringed upon, relevant departments should handle it promptly and in accordance with the law. Article 7 Temporary residents who plan to stay in this city for more than 7 days should apply for temporary residence registration within 7 days after arriving at the place of temporary residence. Temporary residents who are 16 years of age or older and plan to stay in this city temporarily for more than one month should apply for a temporary residence permit within one month after arriving at their temporary residence. Temporary residents visiting relatives, visiting friends, traveling, seeking medical treatment, studying, going on business trips, etc. must apply for temporary resident population registration or passenger registration in accordance with regulations and do not apply for a temporary residence permit. Article 8 If a person who is undergoing reform through labor, reeducation through labor or juvenile correctional education is allowed to go home for temporary residence, he or she shall report to the local police station for registration within 24 hours of arriving at the place of temporary residence with a certificate from the supervisory authority. Article 9 The registration and management of temporary residents staying in hotels shall be handled in accordance with the public security management regulations of the hotel industry. Article 10 To apply for temporary residence registration or apply for a temporary residence permit, go to the public security police station or temporary residence population management station in the place of temporary residence in accordance with the following provisions: (1) If a unit recruits temporary residents and provides accommodation, the hiring unit shall apply for the application; (2) If an individual recruits temporary residents and provides accommodation, the employer shall apply for the application; (3) If the temporary residents rent a house, the lessor shall apply for the application; (4) The temporary residents shall stay in the residential (village) homes. Article 17 Units and individuals that provide accommodation for temporary residents shall immediately report the death of a temporary resident to the public security station at the place of temporary residence. Public security agencies. Article 18 The temporary residence permit is a valid proof that temporary residents legally reside in this city and may not be forged, altered, lent or transferred. Temporary residents should carry and properly keep their temporary residence permit for inspection. If the temporary residence permit is lost or mutilated and cannot be identified, you should promptly apply to the original issuing authority for a reissue, and the accepting authority should immediately reissue it. Article 19 When performing official duties, public security organs may inspect temporary residence permits in accordance with the law, and may detain temporary residence permits for temporary residents suspected of breaking the law or committing crimes. After the reasons for withholding the temporary residence permit are eliminated, the temporary residence permit should be returned promptly. Other units and individuals may not seize the temporary residence permit. Article 20 People who are homeless without ID cards or other valid identity certificates and without legitimate employment or fixed residence shall be persuaded to return by the public security organs and civil affairs departments or detained and deported in accordance with the law. Article 21 House lessors shall not rent houses to temporary residents without ID cards or other valid identity certificates. If a temporary resident is found to be suspected of violating the law or committing a crime, he shall promptly report it to the public security organ. If a house lessor entrusts another person to manage the rented house, the entrusted party shall perform the obligations stipulated in the preceding paragraph. Article 22 Units and individuals that provide accommodation for temporary residents shall accept the guidance, inspection, and supervision of the public security organs. Units or individuals that house more than 20 temporary residents must establish a temporary resident management system and designate responsible personnel. Management of temporary residents. Article 23 Anyone who violates the provisions of Paragraph 1 of Article 10 of these Regulations and commits any of the following circumstances shall be ordered by the public security organ to make corrections within a time limit. If a temporary resident violates the provisions of paragraph 2 of Article 10 of these Regulations, the public security organ shall impose a fine of not less than 50 yuan but not more than 100 yuan, and the person responsible for reporting shall not be punished. Article 24 If a temporary residence permit is obtained by fraudulent means, the public security organ shall confiscate the temporary residence permit and impose a fine of 200 yuan for each temporary residence permit based on the number of temporary residence permits issued.

Article 25 If a person forges, alters, lends or transfers a temporary residence permit, the public security organ shall confiscate the temporary residence permit and impose a fine of not more than 500 yuan or a warning. Article 26 Anyone who illegally seizes a temporary residence permit in violation of the second paragraph of Article 19 of these Regulations shall be fined not less than RMB 50 but not more than RMB 300 by the public security organ. Article 27 If the party concerned is dissatisfied with the administrative penalty decision, he may apply for administrative reconsideration or file an administrative lawsuit in accordance with the law. If the party concerned fails to apply for reconsideration, file a lawsuit, or perform the administrative penalty decision within the time limit, the agency that made the penalty decision shall apply to the People's Court for compulsory execution. Article 28 If staff of public security organs and temporary population management stations practice favoritism, abuse their power, neglect their duties, solicit and accept bribes, or infringe upon the legitimate rights and interests of temporary residents during the registration and management of temporary residents, they shall be given administrative sanctions or punishment in accordance with the law. ; If it constitutes a crime, criminal responsibility shall be pursued in accordance with the law. Article 29 The Xiamen Municipal People's Government is responsible for the interpretation of specific application issues of these regulations. Article 30 These regulations shall come into effect on October 1, 1998. The "Xiamen City Temporary Resident Population Registration Management Regulations" issued by the Xiamen Municipal People's Government on July 9, 1994 were abolished at the same time.
