Measures of Sichuan Province for the Administration of Public Security in Hotel Industry

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the provisions of relevant laws and regulations and in the light of the actual situation in Sichuan, with a view to standardizing the operation of the hotel industry, promoting its healthy development, safeguarding the legitimate rights and interests of hotel operators, employees and passengers, and maintaining social order. Article 2 The term "hotel" as mentioned in these Measures refers to the legitimate business premises that provide accommodation services to the public on a daily or hourly basis within the administrative area of this province, including hotels, restaurants, hotels, apartment hotels, inns, guest houses, bathing places, farmhouses, animal husbandry, resorts and family hotels. Article 3 When the state expropriates rural collective land occupied by farmhouses, livestock farms, resorts and family hotels according to law, it shall implement the compensation standards stipulated by existing laws, regulations and policies. Article 4 The public security organs shall be responsible for the public security management of the hotel industry, and the tourism and industrial and commercial administrative organs shall, according to their respective functions and duties, assist and cooperate with the public security organs in the public security management of the hotel industry. Article 5 The public security management of the hotel industry shall implement territorial management and follow the principle of ensuring safety and serving the society. Article 6 Hotel operators and employees shall abide by the laws and regulations on public security management, establish a responsibility system for internal public security management in hotels, and assist public security organs in preventing and investigating illegal and criminal activities.

Hotel industry associations shall formulate industry self-discipline norms to guide and standardize the business activities of hotel operators. Chapter II Business License Article 7 To operate a hotel, the following conditions shall be met:

(1) The distance from the factory (warehouse) where inflammable, explosive, toxic, radioactive and corrosive dangerous goods are produced or stored meets the requirements of the state;

(two) the use of underground space to run the hotel, ventilation, lighting and safety facilities are complete and effective, and there are more than two spacious entrances and exits. Eighth units or individuals operating hotels shall apply to the local public security organs at or above the county level for the "Special Trade License" before handling the business license. The application materials include:

(a) the identity certificate of the legal representative and the person in charge of the operation;

(two) the fire safety inspection certificate issued by the fire department of the public security organ or the public security police station;

(3) Relevant materials that meet the requirements of safety monitoring equipment and facilities and the public security management information system of the hotel industry have been installed; Where Internet access service is provided, relevant materials of the safety management system with sales license issued by the public security department shall also be provided;

(four) proof of ownership or lease of the business premises (land);

(five) the orientation map of the hotel and the plan indicating the internal room number, service desk, safety monitoring equipment and facilities, evacuation routes, safety entrances and exits, etc. ;

(six) the hotel safety management system and emergency plan;

(seven) the basic situation of the person in charge of hotel safety, security personnel and registration and verification personnel. Article 9 For the construction of rural hotels, farmhouses and other hotels with a total construction area of more than 300 square meters and less than 1000 square meters, the number of guest rooms is more than 20 and less than 50, or the number of beds is more than 30 and less than 1000, the construction, decoration and fire-fighting facilities and equipment shall refer to the implementation of relevant national and provincial fire-fighting technical standards, and obtain the fire safety inspection certificate issued by the local county-level fire department.

Hotels below the scale mentioned in the preceding paragraph shall have basic fire safety conditions and obtain the fire safety inspection certificate issued by the local police station. Tenth public security organs at or above the county level shall, after accepting the application, review the materials and conduct on-the-spot verification, and make a decision within 20 working days from the date of accepting the application. To meet the conditions, it shall make a licensing decision and issue a "special trade license"; Do not meet the requirements, it shall make a decision not to approve, and explain the reasons in writing. Article 11 If the hotel business premises are relocated, it shall reapply for a special trade license within 15 days.

If the hotel is closed down, it shall be filed with the public security organ that originally issued the Special Trade License within 15 days.

If a hotel changes its name, legal representative or person in charge of operation, it shall go through the change formalities with the public security organ that originally issued the special trade license within 15 days.

If the hotel is closed down, it shall go through the cancellation formalities with the public security organ that originally issued the special trade license within 15 days. Chapter III Administration of Public Security Article 12 The legal representative and the person in charge of the operation of the hotel are the persons in charge of public security of the hotel, and are responsible for public security management and public security prevention of the hotel and its affiliated entertainment service places such as dance halls, bathing places and music cafes.

Hotels should formulate emergency plans for emergencies, implement the responsibility system for safety and security precautions, carry out safety knowledge education and training, organize emergency drills, and support and cooperate with public security organs to do a good job in public security management. Thirteenth hotels should establish and improve various public security management systems such as verification and registration, visit management, property storage, on-duty inspection and situation report. Article 14 When a hotel receives lodging personnel, it shall check the identity documents of the passengers one by one, truthfully register the identity information of the passengers, such as their names, addresses, types and numbers of identity documents, check-in and check-out times, and enter them into the public security management information system of the hotel industry in real time, and report to the public security organ.

When receiving foreigners, Hong Kong, Macao residents, Taiwan Province residents or overseas Chinese, they should check the passenger's passport, visa or other valid identity documents, register accommodation information in accordance with the relevant provisions on the entry of overseas personnel, and report to the public security organ.
