What procedures and materials are needed for marriage registration?

The current marriage registration process can be roughly divided into three links: application, examination and registration.

(1) application

Those who meet the requirements for marriage registration shall bring relevant certification materials and registration photos, and both parties shall apply for marriage registration at the marriage registration office where one party's permanent residence is located, and fill in the application registration statement according to the guidance of the staff.

The preparation materials for marriage registration application depend on the specific circumstances. For example, China citizens applying for marriage registration in China (except Hong Kong, Macao and Taiwan) must hold their valid ID card, household registration book, certificate of premarital examination, certificate of being single and a statement that they are not related by blood (lineal blood relatives and collateral blood relatives within three generations). For the divorced party, he/she must also carry divorce documents.

Foreigners living in China, foreign Chinese and other foreigners applying for marriage registration in China need to hold their identity documents (passports or other nationality documents), foreigners' residence permits or valid temporary residence certificates in China issued by public security organs, and proof of marital status issued by domestic notary organs, and be authenticated by the Ministry of Foreign Affairs (or authorized by the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country.

(2) Review

The marriage registration office will examine the application of the parties to determine whether the marriage application submitted is within the conditions. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties concerned and may require them to provide corresponding certification materials when necessary.

(3) Registration and licensing

Those who meet the conditions for marriage shall be registered by the marriage registration authority and then issued a marriage certificate; For divorced parties, the marriage registration authority will cancel their divorce certificates; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The divorce registration procedure is as follows:

(1) application

If the husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement and jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;

2. Valid identity documents that meet the requirements for divorce registration, such as my identity card, household registration book, pass, passport or other valid international travel documents;

3. Fill in the application for divorce registration.

(2) Accept

The marriage registrar shall, in accordance with the relevant provisions, conduct a preliminary examination of the above-mentioned materials submitted by the parties. After the divorce application is found to be correct in the first instance, the parties concerned will receive the Receipt of Accepting the Application for Divorce Registration. If there are differences with the application conditions for divorce registration, it will not be accepted, and the registrar may issue a notice of not accepting the application for divorce registration.

(3) cooling-off period

Within 30 days from the date when the marriage registration authority receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, the party unwilling to divorce may withdraw the previous application for divorce registration from the divorce registration authority that accepted the application for divorce registration with relevant materials. If I have a valid ID card and a receipt for accepting the divorce registration application (if the receipt is lost, I don't need to provide it, but I need to explain it in writing), and fill in relevant documents in person, such as "Withdrawing the divorce registration". After verification by the staff of the marriage registration office, a "Confirmation Letter for Withdrawing the Application for Divorce Registration" will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the end of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the expiration date), divorced couples should carry valid certificates and materials according to relevant regulations, such as recent bareheaded photos of both parties, divorce agreement, marriage certificate, ID card, passport or pass, etc. , and * * * in accordance with the provisions to the marriage registration office for divorce certificate. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. For those who do not meet the requirements for divorce registration, divorce registration procedures are not provided, and if necessary, a notice of disapproval of divorce registration is issued at the request of the parties.

(5) Registration and certification

The marriage registration authority shall register in accordance with the provisions and issue a divorce certificate.
