How much should the hotel pay for falling and breaking in the hotel?

Now it is a society ruled by law. Everyone should know that solving problems and handling disputes through legal channels is the simplest and most efficient way. However, many people are unfamiliar with the law, dare not use the law to defend their rights, and are even more reluctant to go to court. This concept should have been corrected long ago. Not long ago, the People's Court of Pinggu District of Beijing held a court session to hear a dispute case, and what happened in this case may also happen to us.

The plaintiff, Mr. Li, traveled to Beijing Pinggu in early 2022 and stayed in a hotel room. When I got up in the morning to wash, I slipped and got injured in the bathroom, which directly led to a fracture. After going to the hospital, he went to the hotel to ask for compensation, but the hotel refused to pay compensation and the two sides could not reach an agreement. Finally, Mr. Li took the hotel to court. The hotel's attitude is also very clear, because they don't know if Mr. Li fell in the hotel, so they don't want to pay compensation.

It turned out that after Mr. Li fell, he did not contact the hotel at the first time, nor did he call the emergency number 120. Instead, I went directly to the doctor and found the hotel with a diagnosis certificate. So this time difference has become the reason for the hotel to defend, but this reason is not sufficient. Later, the hotel said that because the bath towel in the hotel room had never been used, it was impossible to prove that Mr. Li slipped and was injured in the shower.

Mr. Li said that he didn't take a bath, but his wife did that morning. After taking a shower, because of the design of the hotel bathroom, there was water on the bathroom floor, and the hotel did not provide plastic non-slip slippers, which caused him to fall and get injured. However, the hotel does not admit this. First of all, the water is not made by the hotel. Secondly, the non-slip slippers are in the grid under the bath towel. Mr. Li himself can only blame himself for wearing disposable slippers into the bathroom.

In court, Mr. Li admitted that he did have some responsibility, but he didn't see the anti-slip slippers, and they were placed in the bathroom. You can't get them without going into the bathroom. Isn't this a contradiction? However, the hotel still said that warning signs were posted in the bathroom, anti-slip slippers were provided and anti-slip mats were laid. As an adult, Mr Li should be responsible for his carelessness.

The proof and cross-examination of both sides can be said to restore the true nature of the matter. Hotels, as operators of similar places, of course have the obligation to protect the safety of consumers, but this obligation is not unlimited. As an adult, Mr. Li also has something he should pay attention to, so in the end, the court synthesized the evidence from both parties and made a judgment, and found that the hotel was liable for 50% of Mr. Li's damage.

In the end, the hotel compensated Mr. Li for medical expenses, nursing expenses and other losses12,664 yuan, so the judgment that both parties should bear half the responsibility was fair. After all, both parties are indeed responsible, but privately, the customer's problem is even bigger, but it is the customer who is ultimately hurt. We should be careful in our daily life. Not bad at the hotel. If you fell down at home, did you tell the manufacturer of the floor tile?
