The first cooperation period is 10 year, from February 18, 2007 to February 17, 2006. Paragraph 7 of Article 7 of the Agreement stipulates that Party A (hotel) has the permanent management right of the house.
"Our houses are all complete with two certificates, but now they can't be recovered." Ms. Li said that when she cooperated with the hotel, she was introduced by others and did not read the contract carefully.
Director Wu of Kaiyuan Road Community Neighborhood Committee said that they have coordinated this matter many times, and "property rooms and apartment hotels" need to be further standardized.
Lawyer's statement
Lawyer Li Jian of Hunan Wanhe United Law Firm said that according to Article 2 14 of the Contract Law, the lease term shall not exceed 20 years. More than twenty years, the excess is invalid. Upon the expiration of the lease, the parties may renew the lease contract, but the agreed lease term shall not exceed 20 years from the date of renewal. Therefore, if there is an agreement on the term of permanent lease in this incident, it obviously conflicts with the existing legal provisions.
