Interim Measures for Hotel Fire Management Penalties
Chapter 1 General Provisions
Article 1 In order to strengthen hotel fire management and protect hotel property and employee life and property safety, in accordance with the "Fire Protection Regulations of the People's Republic of China", The "Regulations on Public Security Administration Punishments of the People's Republic of China" and other relevant national regulations are specially formulated based on the situation of the hotel.
Article 2 Anyone who violates fire protection regulations, hinders public fire safety, hinders the normal conduct of firefighting work, or otherwise violates safety technical operating procedures and affects fire safety, which is not sufficient to pursue criminal liability, shall be subject to these Measures. Behaviors that should be punished are violations of fire management.
Article 3 Any violation of fire protection management by hotel personnel shall be punished in accordance with these regulations.
Chapter 2 Punishment
Article 4 Fire management penalties are divided into
(1) Warning
(2) Notice of criticism
(3) Fines
(4) Resignation sanctions
(5) Detention
(6) Seizure
(7) Compensation for losses
Article 5: Departments and responsible persons who commit any of the following violations of fire management shall be given a notice of criticism, a warning, a fine of not more than 200 yuan, and resignation according to the severity of the case
(1) Neglecting fire safety work, not conscientiously performing fire management responsibilities, chaotic management, and no obvious improvement after supervision, resulting in general fire accidents;
(2) Fire hazards exist in other departments, Refusing to implement improvement requests after being made;
(3) Instructing or forcing others to operate in violation of fire safety regulations, or assigning employees who have not received safety education and safety assessment to independently engage in fire-risk operations;
(4) Changing the use of the building without the consent of the chairman of the company, violating fire regulations, and causing fire hazards or fires without inspection by the chairman of the company;
(5) Occupation Fire separation, blocking, or damaging fire escapes;
(6) Failure to dismantle temporary buildings within the time limit, affecting fire safety;
(7) Storing, using, and destroying flammable and explosive materials Do not comply with relevant safety regulations and do not change hazardous chemicals after being instructed;
(8) Violate regulations by storing flammable or explosive chemical hazards in offices or dormitories, or bringing these items into Hotels;
(9) Starting fires without authorization or other behaviors that may cause fire in areas or places where fire is prohibited;
(10) Watchmen and staff on duty drinking alcohol on duty Or fail to inspect and patrol in accordance with regulations, leave work without authorization and cause fire hazards or fires;
(11) Electricians, welders, stokers and other types of work that may involve fire may cause fires through illegal operations;
(12) Stacking combustible items in dormitory corridors, stairwells, etc., and refusing to clean or clear them when instructed;
(13) Failure to equip fire-fighting equipment as required and Damaging or misappropriating fire-fighting equipment, but failing to correct it after being instructed, or having a bad attitude;
(14) Burying, occupying, or damaging public fire-fighting facilities, but failing to make corrections after being instructed;
(15) Falsely reporting a fire, failing to call the police when a fire occurs, or refusing to borrow communication equipment to call the police;
(16) Obstructing the passage of fire-fighting vehicles performing fire-fighting tasks, disrupting the order of the fire scene, and hindering fire-fighting Work is being carried out normally; other departments refuse, obstruct, or make things difficult for company personnel to conduct fire prevention inspections in accordance with the law.
(18) General fires caused by subjective reasons of the responsible personnel;
(19) Other violations of fire protection regulations or safe operating procedures;
Article 6 Anyone who commits any of the following violations of fire protection management shall be punished with a penalty of not more than 30 yuan, and be notified of criticism and resignation.
(1) Violating hotel fire regulations and using electric stoves, alcohol stoves, kerosene stoves, liquefied gas tanks and other appliances in the dormitory; The addition of electrical equipment constitutes a general fire risk;
(3) In the dormitory, random connection of power cords and power sockets causes a fire risk;
(4) In the building , igniting waste paper and other combustible materials indoors;
Article 7 Anyone who causes a fire to destroy national, collective or individual property shall, in addition to being punished accordingly, also be ordered to compensate according to the consequences of the loss and the ability to compensate. .
Article 8 For departments that are in fire danger, and it has been pointed out that rectification cannot be made for a while, the responsibility must be assigned to the person before rectification, and the fire risk parts must be watched and guarded.
Article 9 Anyone who falls under any of the following circumstances may be severely punished;
(1) Knowingly commits a crime;
(2) The consequences are serious;

(4) Refusing to pay a fine or failing to change despite repeated punishments;
Article 10: Any of the following circumstances 1, may be given a lighter punishment or be exempted from punishment.
(1) Fire occurs due to force majeure;
(2) Due to coercion or deception by others;
(3) The consequences are minor , can proactively admit mistakes and correct them in a timely manner;
Chapter 3 Judgment and Enforcement
Article 11 Hotel Fire Management Punishment Measures shall be determined by superior public security organs, The fire department and hotel security team rule and implement.
Article 12 Notices of criticism, fines, and small compensation for losses shall be adjudicated and executed by the hotel security team; sanctions of resignation shall be executed by the hotel department; warnings, detentions, seizures, and larger amounts of compensation shall be adjudicated by the fire and public security departments Judgment execution.
Article 13 When executing a penalty, a fine receipt must be issued to the person punished, and the reason for the fine and the amount of the fine must be stated.
Article 14 All fines collected by the security team shall be handed over to the hotel to supplement firefighting funds.
Article 15 When enforcing these Measures, the security forces and relevant departments shall strictly abide by laws and disciplines, enforce the law impartially, and shall not engage in corruption for personal gain. Violators shall be severely dealt with.
Supplementary Provisions:
(1) If there is any conflict between these Measures and the regulations of the superior public security or fire department, the regulations of the superior department shall prevail;
