Regulations of Ningbo Municipality on the Protection of Vegetable Base Construction

Article 1 In order to strengthen the construction and protection of vegetable bases and ensure the vegetable demand of urban residents, these Regulations are formulated in accordance with the Regulations on the Protection of Vegetable Bases in Zhejiang Province and relevant laws and regulations, combined with the actual situation of this Municipality. Second vegetable bases approved by the people's governments at or above the county level shall be protected for a long time in accordance with the provisions of these regulations. Third people's governments at all levels should strengthen the leadership of the construction, protection and management of vegetable bases, and be responsible for organizing the implementation of these regulations.

The municipal administrative department of vegetables is responsible for the construction, protection and management of vegetable bases in the city, and guides and coordinates the construction, protection and management of vegetable bases in counties (cities, districts).

County (city, district) vegetable administrative departments and Town People's Government shall be responsible for the construction, protection and management of vegetable bases at the corresponding level, and assist the construction, protection and management of vegetable bases in cities or counties (cities, districts).

Planning, agricultural economics, agriculture, urban and rural construction, land management, planning, finance, water conservancy, environmental protection and other departments shall, in accordance with their respective responsibilities, cooperate with the vegetable administrative departments to do a good job in the construction, protection and management of vegetable bases. Fourth vegetable administrative departments in the construction, protection and management of vegetable bases are mainly responsible for:

(a) in conjunction with the relevant departments to prepare the construction plan of vegetable base and vegetable reserve base;

(two) responsible for the construction of new vegetable bases and the transformation of old vegetable bases;

(three) to guide and coordinate the production and sales of vegetables;

(four) in conjunction with the relevant departments to determine the scientific research projects of vegetable production, introduce and popularize new varieties and technologies of vegetables, and provide socialized services such as technical training and information consultation for vegetable farmers. Fifth cities, counties (cities), zhenhai district, Beilun District and towns with a non-agricultural population of more than 5,000 shall establish vegetable bases.

The area of vegetable base is determined by the permanent population and floating population in cities and towns. Urban per capita is not less than 0.025 mu, and county (city) town per capita is not less than 0.02 mu. Sixth cities and counties (cities, districts) should establish vegetable reserve bases at a ratio of not less than the total area of vegetable bases 10%. Due to natural population growth and requisition of vegetable base, the area of vegetable base per capita has decreased, which should be supplemented in vegetable reserve base in time.

City, county (city, district) vegetable administrative departments should transform the land and facilities of vegetable reserve base, and increase the vegetable planting area year by year in a planned way.

Vegetable reserve bases where vegetables have been planted are regarded as vegetable bases and protected in accordance with the requirements of these regulations. Seventh city and county (city, district) people's governments shall incorporate the construction of vegetable bases and vegetable reserve bases into the overall urban planning and national economic and social development plan, and make unified layout and reasonable arrangements. Article 8 People's governments at all levels shall take the following measures to support the construction of vegetable bases and protect the interests of vegetable farmers:

(a) financial departments at all levels to increase investment in vegetable base year by year;

(two) to give appropriate subsidies to the vegetable base of irrigation and drainage, roads, power supply and other infrastructure construction;

(three) to give preferential treatment to vegetable farmers who have the conditions to sell directly in transportation, opening stores and setting up stalls;

(four) to establish a risk protection mechanism for vegetable production, sign production and marketing contracts, implement the minimum protection price, and give appropriate compensation for losses caused by natural disasters and other reasons. Ninth new vegetable base should meet the following conditions:

(a) the contiguous area of vegetable bases in the city is not less than 50 mu, and the contiguous area of vegetable bases in counties (cities, districts) and towns is not less than 30 mu;

(two) convenient transportation, irrigation and drainage unobstructed;

(3) The soil is suitable for growing vegetables;

(4) There is no pollution source nearby;

(five) in line with the overall urban planning.

The conditions of vegetable reserve base refer to the provisions of the preceding paragraph. Tenth vegetable bases shall be designated by the vegetable administrative department in conjunction with the land management department, and drawings shall be drawn, registered and put on record, and the examination and approval authorities shall make an express announcement, and the vegetable administrative department shall set up protection signs.

No unit or individual may destroy or move the protection signs without authorization. Eleventh vegetable bases must grow vegetables all the year round and shall not be deserted. Without the approval of the municipal and county (city, district) administrative department of vegetables, no unit or individual may replant other crops or dig ponds.

It is forbidden to borrow soil and dig sand in vegetable bases. Twelfth are not allowed to occupy the vegetable base for capital construction. If it is really necessary to requisition vegetable bases due to the implementation of major national and provincial construction projects or approved urban planning, it shall be reported for approval in accordance with the procedures and authority stipulated in the Regulations on the Protection of Vegetable Bases in Zhejiang Province.

The residential construction of vegetable farmers should be arranged within the scope of residential land for urban and rural planning. Thirteenth requisition of vegetable base to implement the first supplement after levy. The land management department shall, jointly with the vegetable administrative department and the planning department, put forward the annual control plan for the requisition of vegetable base at the beginning of each year, and the vegetable administrative department shall not start the requisition until the vegetable reserve base is supplemented with new vegetable fields according to the standard of requisition 1 mu. Fourteenth units that have been approved to requisition vegetable bases must first pay the vegetable field development and construction fund.

Vegetable development and construction funds are collected by the land management departments of cities and counties (cities, districts) respectively, and included in the management of extra-budgetary funds. They are remitted to the municipal, county (city, district) and town finance every quarter according to regulations, stored in special financial accounts, and used for special purposes.

Without the approval of the provincial people's government, the funds for vegetable field development and construction shall not be reduced.
