Article 41 of the Urban and Rural Planning Law stipulates that for the construction of township enterprises, rural public facilities and public welfare undertakings in township and village planning areas, the construction unit or individual shall apply to the township and town people's government, and the township and town people's government shall report to the competent department of urban and rural planning of the people's government of the city or county to issue a rural construction planning permit.
