First Article, Project Price and Payment
1. The contract price is determined based on the current national, provincial and municipal relevant documents and the "Project Budget Book" quota.
2. The price of this project is calculated and determined to be RMB 245,000. The final settlement amount shall not exceed the principal amount, and Party A will not pay the excess.
3. Appropriation of project funds: 25% of the project cost will be paid as an advance payment after the contract is signed, 25% will be paid upon completion of the project, and the remaining 50% will be a quality deposit, which will be paid after the warranty period expires and there are no quality problems.
Article 2. Project Quality
1. The project quality must meet the qualifications of the current national or professional quality inspection and assessment standards. After negotiation, the quality level of this project is agreed to be qualified. The quality of the project must meet the requirements of the Municipal Technical Supervision Bureau.
2. Project construction must be carried out in accordance with the construction drawings, must meet the standards of the renderings, and meet the acceptance standards of Party A and relevant departments after completion.
3. When the quality of the project fails to meet the above requirements, Party B will be responsible for repairing it free of charge until it meets the requirements. At the same time, Party B will be responsible for various related costs and losses caused by it, and will be charged according to the legal liquidated damages standard (1%). Liquidated damages shall be paid on a daily basis.
Article 4: Responsibilities of both parties
1. Party A’s responsibilities:
1.1. Jointly review the construction drawings.
1.2. Provide a construction site with construction conditions.
1.3. If the construction period is affected by Party A’s reasons, the construction period will be postponed accordingly, and the resulting costs will be borne by Party A.
2. Party B’s responsibilities:
2.1. Party B shall provide construction drawings, construction organization design, qualification certificates, project progress, materials and equipment plans and other necessary construction procedures one week before the start of construction.
2.2. Party B shall bear the cost of water, electricity and steam used during the construction process.
2.3. Party B must use raw materials that meet national quality standards. If there are project quality problems caused by the use of unqualified raw materials, Party B will be responsible for compensation for direct and indirect losses, regardless of whether the warranty period has expired.
2.4. Party B is responsible for construction safety. Party B shall bear full responsibility for all accidents caused by Party B during the construction period.
2.5. Party B must enter the site for construction within one week after the contract takes effect. If Party B fails to enter the site for construction within the time limit, Party A has the right to unilaterally terminate the contract. Party B will return the advance payment and pay liquidated damages according to the legal standard (1%).
2.6. The losses caused by Party B’s failure to complete the project on time shall be borne by Party B after Party A determines the direct losses and indirect losses.
Article 5: Completion Acceptance and Warranty
1. One week after the completion of the project, Party B shall provide Party A with the completion information and completion acceptance report.
Party A shall organize relevant departments to conduct acceptance within 10 days after receiving the completion data.
2. After the project is completed and accepted, in accordance with the relevant national warranty regulations and within the scope contracted by Party B, the project warranty period is one year.
Article 6: Handling of Disputes
If any dispute arises between the two parties due to the contract, they shall first ask the construction administrative department where the project is located for mediation.
After mediation, if the two parties agree If an agreement is not reached, the dispute shall be settled by litigation in the People's Court where Party A is located.
Article 7: Unfinished matters and supplementary terms are as follows:
1. Party A’s dispatched personnel and supervisors have the right to conduct overall supervision of the project, including project quality, material quality and Use, project progress and other matters related to the elevator renovation project of XXX Hotel. Party B has the right to propose modifications for construction that violates the contract and construction quality issues, etc. Party B must implement it unconditionally. Party B shall be responsible for any direct losses and indirect losses caused during the modification period.
2. As the project progresses, Party B shall promptly organize the corresponding internal information and submit it to Party A and relevant departments for inspection. Only after the inspection and acceptance are passed, can the next step of construction be entered.
3. When the project is completed and accepted, it must be accepted by the Municipal Technical Supervision Bureau, and Party B shall handle the acceptance procedures.
4. Unfinished matters shall be resolved through consultation by both parties.
