Can't an adult family of three live in a standard room?
"Industry regulations" does not mean "legal regulations", and it is obviously unreasonable for hotels to ask for check-out.
Our country's law does not clearly stipulate the number of people staying in standard rooms, but it stipulates that people staying in standard rooms must register their real names according to the requirements of the public security.
In other words, adult children can live in standard rooms with their parents if consumers want.
2. Are consumers' rights and interests infringed?
It depends on the contract between the passenger and the hotel before checking in.
If the hotel has informed the passengers in advance of the limit of the number of people staying, for example, the platform made a public announcement when booking online, or the passengers informed them in person after arriving at the hotel; If the passenger did not raise any objection at that time and placed an order for reservation, then the passenger should abide by the relevant regulations of the hotel.
Generally speaking, in order to ensure the safety of passengers and the quality of service, hotels set up relevant regulations, so long as they are within a reasonable range, they will not violate laws and regulations.
Sharp comments
Accommodation "breaking up" a family hotel should not be so inhuman.
"An adult family of three can't live in the same standard room", which makes the parties sigh: "How should a family of three book a hotel?"
The "soul problem" of tourists is not a complaint. For many families, losing a room can save a lot of money in the end. As relatives, it is not inconvenient for everyone to rest in the same room. Many people who are not rich but have tourism needs can also "spend a little money to do great things". According to the news report, the hotel suggested that the parties can change the room type to a family room, but the price of a "standard double room" is 432 yuan, and the price of a "family room" is 609 yuan, which is close to 200 yuan. If a family of three plans to travel in Beijing for a week, the extra cost of accommodation will reach about 1000 yuan.
There are so-called rules and regulations, and it is also reasonable for the hotel industry to formulate corresponding industry norms. However, the formulation of any industry norms should not embarrass consumers and increase their consumption threshold. Take the Proposal of Wangfujing Yong Guang Hotel as an example. Both "family room" and "standard double room" are equipped with one room and two beds. Why can the former make a family of three live in peace, while the latter can't? Just because the word "home" is added to the former, does it meet the industry requirements? This makes people wonder whether industry norms or price differences are at work.
The Law on the Protection of Consumers' Rights and Interests and the Contract Law clearly point out that operators are not allowed to make unfair and unreasonable provisions to consumers, such as excluding or restricting consumers' rights, reducing or exempting operators' responsibilities, and aggravating consumers' responsibilities, by means of standard clauses, notices, statements and shop notices. , the unequal format clause containing the above content is invalid. According to the news published on the website of China Consumers Association, the "industry rules" of relevant industry associations should conform to the principle of fairness and justice. No enterprise or industry may damage consumers' right of independent choice and fair trade in the form of unequal format clauses, and safeguard the improper interests of enterprises. The staff of China Tourist Hotel Association also said that the association has no relevant regulations prohibiting a family of three adults from sharing the same room. This kind of "code of conduct" formulated by some hotels in Beijing obviously belongs to the category of inhumanity, and it is even more suspected of unilaterally favoring merchants' "overlord clause", which should be banned as soon as possible. The question of whether a family of three can share a room should not have been a problem.
