Matters needing attention in subletting houses
1. Check whether renting or subletting is prohibited.

2. Be sure to sign a sublease contract.

3. The termination date agreed in the sublease contract shall not exceed the termination date of the lease contract, unless otherwise agreed.
Article 29 of the Measures for the Administration of Urban House Lease stipulates: "The termination date of the sublease contract shall not exceed the termination date agreed in the original lease contract, unless otherwise agreed by the lessor and the sublease."
4. The contents of the sublease contract must be consistent with the contents of the lease contract. For example, the sublease subject matter can only be all or part of the original lease contract, unless otherwise agreed.
5. The assumption of creditor's rights and debts existing in the subject matter before subletting.
In order to avoid infringement of its legitimate rights and interests, the lessee should negotiate with the sublessor in advance on this part of the creditor's rights and debts.
6. Agree whether you can sublet.
Otherwise, the lessee may have to bear adverse consequences. Article 24 of the Measures for the Administration of Urban House Lease stipulates: "If the lessee commits one of the following acts, the lessor has the right to terminate the contract and take back the house, and if losses are caused thereby, the lessee shall compensate: (1) subletting the rented house without authorization."
7. Both parties shall reach an agreement on the improvement of the leased property.
Article 23 of the Measures for the Administration of Urban House Lease stipulates: "The lessee shall take good care of and reasonably use the rented house and ancillary facilities, and shall not dismantle, modify, expand or add them without authorization. If it is really necessary to change, it must obtain the consent of the lessor and sign a written contract. "
8. During the sublease period, if the original lease contract is changed, dissolved or terminated, the sublease contract shall be changed, dissolved or terminated accordingly.
