Chapter 1 General Provisions Article 1 In order to strengthen the management of urban appearance and environmental sanitation, create a clean and orderly urban environment, and promote the construction of civilized cities, in accordance with the "Prevention and Control of Environmental Pollution by Solid Wastes of the People's Republic of China" "Law", the State Council's "Urban City Appearance and Environmental Sanitation Management Regulations" and relevant laws and regulations, and combined with the actual situation of this city, these regulations are formulated. Article 2 These regulations apply to urban built-up areas in the administrative region of this city and other areas subject to urbanization management. Article 3 The management of city appearance and environmental sanitation adheres to the principles of unified leadership, hierarchical responsibility, territorial management, public participation, and social supervision. Article 4: Municipal and county (city, district) people's governments shall strengthen leadership over city appearance and environmental sanitation management and incorporate it into national economic and social development plans. Funds for city appearance and environmental sanitation management should be included in the government budget at the same level and should be consistent with economic and social development.

The administrative department of city appearance and environmental sanitation is responsible for the management of city appearance and environmental sanitation in its own administrative region. Administrative penalties shall be imposed on city appearance and environmental sanitation violations stipulated in these Regulations in accordance with the authorized scope and in accordance with the law.

Public security, finance, education, natural resources and planning, water conservancy, ecological environment, housing and urban and rural construction, transportation, health, market supervision and other departments shall jointly improve the city appearance and environment in accordance with their respective responsibilities Health management work.

Township people's governments and sub-district offices shall be responsible for the management of city appearance and environmental sanitation within their respective jurisdictions in accordance with the responsibilities specified in these regulations. Article 5 People's governments at all levels and their relevant departments for city appearance and environmental sanitation work shall strengthen the publicity and education of city appearance and environmental sanitation management laws, regulations and environmental sanitation and other knowledge, and do a good job in mobilizing citizens to consciously participate in city appearance and environmental sanitation improvement; radio, television Mass media such as newspapers, periodicals, online media, and bulletin boards of units and communities should carry out publicity on city appearance and environmental sanitation, and raise citizens' awareness of consciously maintaining city appearance and environmental sanitation. Article 6: Maintaining city appearance and environmental sanitation and caring for environmental sanitation facilities are the common responsibilities of the entire society.

Any unit or individual has the obligation to maintain city appearance and environmental sanitation and care for environmental sanitation facilities. They should respect the work of city appearance and environmental sanitation staff; they have the right to take action against behaviors that affect city appearance and environmental sanitation and damage environmental sanitation facilities. Discourage, stop or report or complain.

Encourage units and individuals to participate in public welfare activities for city appearance and environmental sanitation. Article 7 Anyone who insults or beats city appearance and environmental sanitation staff or hinders their normal work and hinders law enforcement personnel from performing their duties in accordance with the law shall be punished by the public security organs in accordance with the "Public Security Administration Punishment Law of the People's Republic of China"; if it constitutes a crime, the person responsible shall be punished in accordance with the law. Article 8 The administrative departments for city appearance and environmental sanitation and other relevant departments and their staff shall perform management and supervision duties and shall not abuse their powers to damage the legitimate rights and interests of citizens, legal persons or other organizations. Reports or complaints from units and individuals should be handled and fed back in a timely manner. If a person fails to perform his duties, neglects his duties, abuses his power, or engages in malpractice for personal gain, the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law. Chapter 2 Responsibility for City Appearance and Environmental Sanitation Article 9 The management of city appearance and environmental sanitation implements the responsibility area system. Responsibility area refers to the buildings (structures), facilities, places and areas within a certain range owned, used and managed by relevant units or individuals. Article 10 The owners, users and managers of buildings (structures), facilities, places, etc. are the persons responsible for city appearance and environmental sanitation.

The person responsible is determined in accordance with the following provisions:

(1) Roads, public squares, underground passages, sidewalks, pedestrian bridges, urban greening land, public toilets, garbage transfer stations (points) and other public roads Areas are the responsibility of professional units such as city appearance and environmental sanitation;

(2) Residential areas that are subject to property management are the responsibility of property service units, and residential areas that are not subject to property management and back streets and alleys are the responsibility of the township people's government or the The sub-district office is responsible, and the public rental housing area is the responsibility of the housing and urban-rural development administrative department;

(3) The areas managed by agencies, groups, enterprises and institutions, etc. are the responsibility of the unit;

(4) Railways, highways, airports, stations, docks, bus stops, parking lots and their management scope shall be the responsibility of the operating or management unit;

(5) Hotels, restaurants, guesthouses, shopping malls , supermarkets, stores, farmers' markets, exhibitions and sales venues (pavilions), gas stations and other places are the responsibility of the operation or management unit;

(6) Culture, sports, entertainment, scenic spots, parks and amusement parks and other public places The operation or management unit shall be responsible for the maintenance of the premises;

(7) Public facilities such as electricity, lighting, gas supply, water supply, drainage, communications, transportation, and public security shall be the responsibility of the operation or management unit. Responsible;

(8) The management unit is responsible for rivers, lakes and other waters within the city limits;

(9) The construction site of the construction project is the responsibility of the construction unit and the construction unit. The user shall be responsible for the construction sites to be built for which the user has been identified, and the reserve land shall be the responsibility of the reserve department.

If there is an agreement between the owner, user, and manager regarding the responsibility for city appearance and environmental sanitation, the agreement shall prevail.

If the responsible area and responsible person are unclear, the city appearance and environmental sanitation administrative department shall determine it in conjunction with the township people's government and the sub-district office and notify it in writing.
