Legal analysis: the practice of "checking out at 12 o'clock" has its historical origin. On May 1 day, 2002, the Code of China Tourist Hotel Industry was promulgated, and its article 10 stipulated:

"Hotel room rate is based on' room/night' (except hourly room). According to the guest staying in a' room/night', charge a room fee for one day; If you check out after 12 o'clock and before 18 o'clock the next day, the hotel can add half a day's room charge; If you check out after the next day 18, the hotel can add one day's room charge. "

Obviously, according to 10, if you check out after 12, the hotel can charge you half a day-1 day, but this charge may not be well known to customers, and compulsory charging may also lead to disputes. Therefore, article 10 was revised in 2009, and now it is stipulated as follows:

"The hotel should clearly indicate the settlement method of room price and accommodation time in a prominent position in the lobby, or confirm that the above information has been informed to the guests in an appropriate way."

Since then, it has become an industry practice to inform customers in advance and express the requirement of "checking out before 12". Although "China Tourist Hotel Industry Code" is only an industry code and does not belong to the legal category, strictly speaking, it cannot be considered that there is a "legal basis" for the practice of "checking out before 12". However, as an industry norm, the existence of this norm is no less deterrent to the hotel industry than the law, and the practice of "checking out before 12 o'clock" has also been generally observed over the years. In fact, it has played the role of "soft law" and unified the industry code of conduct, or "business habits", which should be respected in principle.
