8. During the lease period, Party B's publicity or advertising for business needs must be approved by the leaders of relevant departments of the hotel before implementation.
9. In principle, Party B shall not operate the same goods as the hotel, and the sales price of some approved goods shall not be lower than the pricing of the hotel premises. During the lease term, Party B promises to operate on its own and shall not transfer it.
Article 7 Operating expenses and settlement
1. Party B is responsible for all expenses of all employees. Specifically, it includes: salary, bonus and welfare expenses, working meals (which can be eaten in Party A's staff canteen, and the expenses shall be settled uniformly according to the staff dining standard plus 40% of the food expenses), accommodation expenses, on-the-job physical examination of employees, temporary residence permits, training fees, and related expenses paid for employees according to the Labor Contract Law and relevant regulations.
2. During the lease period, Party B shall bear part of the expenses for maintenance of facilities and equipment, and Party A shall bear the expenses for internal maintenance personnel.
3. The monthly telephone charges shall be settled according to the facts. The water fee and general lighting fee shall be borne by Party B, and the air-conditioning fee shall be borne by Party A. Party B shall not use high-power electrical appliances in the business premises.
4. All materials, supplies, low-value consumables and other items collected by the hotel shall be uniformly settled according to the financial accounting price (cost price plus 5% purchase and storage fee) and the actual amount collected.
5. The settlement of various credit cards in the turnover shall be recorded as the turnover income of Party B after deducting the credit settlement fees. Among them, the domestic credit card settlement fee is 2.20% and the foreign credit card settlement fee is 4.00%. If the bank credit card handling fee is adjusted, it shall be implemented according to the new regulations. The handling fee shall be collected and remitted by Party A. All kinds of internal hanging cards and hotel contract consumption allowed in the hotel turnover shall be collected by Party A. ..
6. On the 5th of each month, Party A's finance department will settle all kinds of receipts and payments for this month on behalf of Party B, and the money collected can be deducted from the rent payable by Party B. ..
Article 8 Modification and rescission of the contract
1. After the contract comes into effect, if it needs to be changed, it must be agreed by both parties through consultation, otherwise it will be regarded as a breach of contract.
2. Within the same validity period, both parties shall not terminate the contract in advance without reason, and it shall be agreed by both parties through consultation; Otherwise, if either party of Party B terminates the contract in advance, it will be deemed as a breach of contract, and it will be liable for breach of contract.
Article 9 Liability for breach of contract
Both parties shall strictly abide by this contract. If either party violates this contract, it shall bear the liability for breach of contract and pay the liquidated damages of RMB _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _. However, if the losses caused to Party A due to Party B's fault exceed _ _ _ _ _ _, Party B shall make full compensation.
Article 10 Exemption clause
Upon appraisal by the relevant departments, if the leased property is damaged or lost due to force majeure during the lease period, the lessor shall not be liable for repair or compensation, but shall explain the situation to the lessor in time and obtain the certificate from the relevant competent department when necessary.
Article 11 Other related matters
Three months before the expiration of the stipulated lease term, if both parties are willing to continue to extend the lease term, Party B has the priority to re-sign the contract under the same conditions. For matters not covered in this contract, supplementary provisions shall be made in accordance with the relevant provisions of People's Republic of China (PRC) Contract Law, which have the same effect as this contract.
This contract is made in quadruplicate, two for each party, and submitted to the Finance Department of Kaiyuan International Hotel Management Company and Kaiyuan Tourism Group Company for the record.
