Is it illegal for married men and unmarried women to stay in hotels?

It is not necessarily illegal for a married man to live with an unmarried woman. Only married men and unmarried women living together in the name of husband and wife will violate the law, and if certain circumstances are reached, it will also constitute bigamy and will be sentenced to fixed-term imprisonment of not more than two years or criminal detention by the people's court. If it does not meet the conditions of bigamy, it is only illegal cohabitation rather than bigamy.

The criteria for determining bigamy are as follows:

1, after registering marriage with spouse, register marriage with others and remarry. That is, bigamy of two legal marriages;

2. If you and your spouse are registered to get married, but you are not registered with others, but live together as husband and wife and remarry. This is the type of de facto marriage after legal marriage;

3, with the spouse and others not registered marriage, but with the spouse and others have lived together in the name of husband and wife and bigamy, this is the bigamy of two de facto marriages;

4. It is the legal marriage type after de facto marriage that you live together with your original spouse without registration and in the name of husband and wife, and then register with others for marriage and bigamy;

5, no spouse, but knowing that the other party has a spouse and registered marriage or cohabitation and bigamy in the name of husband and wife.

Legal basis: Article 258 of the Criminal Law of People's Republic of China (PRC).

The crime of bigamy involves bigamy of a spouse, or marrying someone who knows that they have a spouse, and shall be sentenced to fixed-term imprisonment of not more than two years or criminal detention.
