Whoever assists in organizing others to engage in prostitution shall be sentenced to fixed-term imprisonment of not more than five years and fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and shall also be fined.

Article 359 Whoever lures, shelters or introduces others to prostitution shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance, and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years and fined.

Whoever lures a young girl under the age of 14 into prostitution shall be sentenced to fixed-term imprisonment of not less than five years and fined.

Article 360 Whoever knowingly engages in prostitution or whoring while others are suffering from serious sexually transmitted diseases such as syphilis and gonorrhea shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance and shall also be fined.

Whoever whores with a girl under the age of 14 shall be sentenced to fixed-term imprisonment of not less than five years and fined.

Article 361 Personnel of hotels, catering services, cultural and entertainment industries, taxi industry and other units who use the conditions of their own units to organize, force, seduce, shelter or introduce others to prostitution shall be convicted and punished in accordance with the provisions of Articles 358 and 359 of this Law.

The principal responsible person of the unit listed in the preceding paragraph who commits the crime mentioned in the preceding paragraph shall be given a heavier punishment.

Article 362 Personnel of hotels, catering services, cultural entertainment, taxis, etc. who tip off criminals when the public security organs investigate and deal with prostitution and whoring activities, if the circumstances are serious, shall be convicted and punished in accordance with the provisions of Article 310 of this Law.

Section 9 Crime of Making, Selling and Disseminating Obscene Articles

Article 363 Whoever makes, copies, publishes, sells or disseminates obscene articles for profit shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.

Whoever makes or copies obscene movies, videos and other audio-visual products for broadcasting shall be given a heavier punishment in accordance with the provisions of the second paragraph.

Whoever disseminates obscene articles to minors under the age of 18 shall be given a heavier punishment.

Article 365 Whoever organizes obscene performances shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined.

Article 366 Where a unit commits the crimes specified in Articles 363, 364 and 365 of this section, it shall be fined, and the persons who are directly in charge and other persons who are directly responsible shall be punished in accordance with the provisions of these Articles.

Article 367 The term "obscene articles" as mentioned in this Law refers to obscene books, periodicals, films, video tapes, audio tapes, pictures and other obscene articles that specifically depict sexual behavior or publicly publicize pornography.

Scientific works about human physiology and medical knowledge are not obscene articles.

Literary and artistic works with artistic value containing pornographic content are not regarded as obscene articles.
