My friend's visa expired and he stayed in the UK. He was taken away by the police yesterday and is now detained in Manchester City.

Your friend is unlikely to stay in England. Since 2008, the British Immigration Bureau has severely cracked down on the detention of international students.

If your friend is sent back to China, it is unlikely that he will go back to the UK for further study, because his current situation is involuntary repatriation, and it will take at least five years to return to the UK.

In addition, the problem of overstaying is not that you can't find a lawyer, but the chances of applying to become a refugee are very small (compared with before 2002).

The following is the notice of the British Immigration Bureau on overstaying:

From April 1 2008, we will amend the immigration law to prevent anyone who violates the immigration law (such as working illegally, staying illegally for more than 28 days, entering the country illegally or using false documents in the process of visa or other applications) from entering the UK within a fixed period of time.

Applicants who use deception (using false documents, lying and concealing information) in visa applications will be banned from entering the UK in the next ten years.

Applicants who violate immigration laws in the UK will be banned from returning to the UK for a long time. The duration of the ban depends on how he/she leaves the UK after breaking the law, for example:

If he/she leaves the UK voluntarily at his/her own expense, he/she will be prohibited from entering the UK in the next year;

If he/she leaves the UK voluntarily at the expense of the government, he/she will be banned from entering the UK for the next five years;

If he/she is expelled from the UK, he/she will be banned from entering the UK for the next ten years.

We made these changes for two reasons:

Punish those who violate China's immigration laws;

Urge those who are currently illegally staying in the UK to leave the UK voluntarily (if anyone who is illegally staying in the UK voluntarily leaves the UK during March 17, 2008 to 2008 10/day, he will not directly face this ban).
