Measures of Guiyang Municipality on the Administration of Accommodation Industry (202 1 Revision)

Article 1 In order to strengthen the management of the accommodation industry in this Municipality, standardize business practices, improve service quality, and protect the legitimate rights and interests of passengers and operators of the accommodation industry, these Measures are formulated in accordance with the provisions of the Tourism Regulations of Guizhou Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the operation, supervision and management activities of tourist star hotels and social hotels that provide accommodation services to consumers by using special accommodation facilities within the administrative area of this Municipality.

The term "social hotels" as mentioned in these Measures refers to hotels, hotels, guest houses, resorts, country hostels and other enterprises that mainly provide accommodation services and provide corresponding services to the society such as business, meetings, leisure and holidays. Article 3 The competent departments of culture and tourism of the people's governments at or above the county level shall be responsible for the supervision and management of the operation and service quality standards of the accommodation industry within their respective administrative areas.

Market supervision, public security, emergency, health, ecological environment, urban management, natural resources and planning, development and reform, commerce and other relevant departments shall, according to their respective responsibilities, do a good job in the supervision and management of the accommodation industry. Article 4 The competent department of culture and tourism of the Municipal People's Government shall take the lead in establishing a joint meeting system attended by relevant competent departments and accommodation industry associations, and hold regular meetings to study and solve relevant problems in the supervision and management of the accommodation industry. Article 5 The competent department of culture and tourism of the Municipal People's Government shall, in accordance with the national economic and social development plan, the overall land and space plan and the tourism development plan of this Municipality, and in combination with the needs of tourism development, work out a special plan for the development of the accommodation industry in conjunction with the competent departments of development and reform, natural resources and planning. Article 6 The competent department of culture and tourism shall publish the information such as the occupancy rate and average room rate of various local accommodation enterprises in a timely manner through newspapers, radio, television and the Internet.

The multimedia tourism information service facilities set up by the competent departments of culture and tourism in tourist public places shall provide information such as the distribution of accommodation enterprises and accommodation consultation. Article 7 The competent department of culture and tourism of the Municipal People's Government shall establish an accommodation management information system to summarize the accommodation supply and demand and related information of the accommodation industry in this Municipality.

Encourage enterprises in the accommodation industry to establish an e-commerce platform for the accommodation industry, develop online information inquiry, reservation and payment services, realize online accommodation transactions and promote the development of e-commerce in the accommodation industry.

The competent department of culture and tourism shall collect and summarize the real and reliable information such as room size, occupancy rate and room rate, and classify them into the accommodation management information system. Article 8 The competent department of culture and tourism of the Municipal People's Government shall regularly summarize and analyze the development status and future trend of the accommodation industry in this Municipality, prepare a report on the development of the accommodation industry, and publish it in accordance with the relevant provisions on the disclosure of government information. Article 9 The establishment of an accommodation enterprise shall conform to the special planning for the development of the accommodation industry in this Municipality, meet the national and local standards for the accommodation industry, and go through the relevant procedures in accordance with the provisions of laws and regulations before starting business. Article 10 The competent department of culture and tourism shall, jointly with the competent department of market supervision and other departments, formulate and improve the operating and service standards of various accommodation enterprises according to industry standards.

The competent department of culture and tourism shall announce the national and local commercial service standards to the society.

Accommodation enterprises shall, in accordance with national and local business service standards, ensure that service facilities and equipment are in good condition and effective, implement relevant management systems, provide quality services, meet health standards and meet the requirements of energy conservation and environmental protection. Eleventh relevant departments should regularly carry out vocational skills training for accommodation enterprises.

Encourage accommodation enterprises to establish an internal vocational training system, extract and use employee training funds in accordance with state regulations, organize employees to participate in business, vocational skills training and pre-job training in light of actual conditions, and make training records truthfully. Twelfth accommodation enterprises should take measures to guide passengers to save energy and environmental protection consumption; With the consent of passengers, the provision of disposable consumables and the cleaning times of room supplies can be reduced.

The competent department of culture and tourism shall timely summarize the methods and experiences of accommodation enterprises in implementing energy conservation and environmental protection work, and popularize and apply them. Thirteenth qualified accommodation enterprises shall, in accordance with the relevant provisions and standards of the state and this Municipality, configure barrier-free facilities to ensure the safety and convenience of the disabled, the elderly and other groups.

Accommodation enterprises shall regularly inspect, maintain and update the configured barrier-free facilities to ensure the normal use of barrier-free facilities. Fourteenth departments in charge of culture and tourism shall implement the star-rated standards of tourist hotels, and may entrust the evaluation agencies of tourist star-rated hotels to carry out the evaluation work.

Accommodation enterprises that meet the evaluation conditions of tourist star-rated hotels may apply for star-rated evaluation to the evaluation agencies of tourist star-rated hotels according to the standards of tourist star-rated hotels.

It is strictly forbidden for accommodation enterprises to use the signs of tourist star hotels without authorization, and it is strictly forbidden to mislead the use of standard terms of tourist star hotels. Fifteenth departments in charge of culture and tourism shall, in conjunction with relevant departments, regularly check the service quality of the accommodation industry according to the business service standards, and announce the service quality inspection to the public. Sixteenth passengers have the right to use their rooms independently after checking in.

Except in the following circumstances, without the consent of the passengers, no one may enter the guest room registered by the passengers or otherwise affect the accommodation of the passengers:

(1) An emergency that may endanger the personal safety of passengers occurs;

(two) the law enforcement officers of the relevant departments shall, in accordance with the procedures prescribed by laws and regulations, perform official duties with relevant certificates;

(3) Hotel employees shall clean the rooms within the prescribed time;

(4) Other circumstances stipulated by laws and regulations.
