Legal analysis: it is unreasonable for the hotel to accept 16-year-old waiters. State organs, social organizations, enterprises and institutions, private non-enterprise units or individual industrial and commercial households may not employ minors under the age of 16.

Legal basis: Article 2 of the Provisions on Prohibiting the Use of Child Labour: State organs, social organizations, enterprises and institutions, private non-enterprise units or individual industrial and commercial households (hereinafter referred to as employers) shall not employ minors under the age of 16 (hereinafter referred to as using child labour).

It is forbidden for any unit or individual to introduce employment to minors under the age of 16.
