Measures of Sichuan Province for the Administration of Public Security in Hotel Industry

Chapter I General Provisions Article 1 In order to ensure the legitimate operation of the hotel industry and the safety of passengers' lives and property, and maintain public order, these implementation measures are formulated in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, the Measures for the Administration of Public Security in the Hotel Industry and relevant laws and regulations, and in combination with the actual situation of our city. Article 2 The operation of the hotel industry shall abide by the laws and regulations of the state and the relevant provisions of the local people's government; The principle of "whoever is in charge is responsible" shall be implemented in the public security management of the hotel industry, and various public security systems shall be established and improved, and preventive measures shall be effectively implemented. Article 3 These Measures shall apply to all hotels operating and receiving Chinese and foreign tourists within the administrative area of this Municipality. Article 4 The term "hotel" as mentioned in these Measures refers to hotels, guest houses (including foreign-related guest houses and reception stations set up by Chengdu organs, organizations, troops, factories and mines, foreign offices in Chengdu, etc.), passenger warehouses, chariots and horses shops, bathrooms, hotels, resorts, etc. (hereinafter referred to as the hotel). Article 5 The hotel industry shall accept the guidance, supervision and inspection of the local public security organs on its public security management, assist the public security organs to investigate and deal with illegal crimes, and do a good job in preventing theft, fire prevention and public security accidents. Chapter II Opening and Examination and Approval Article 6 An application for opening a hotel shall be submitted to the local (city) or county public security organ for approval, and shall be registered with the administrative department for industry and commerce before it can start business. To apply for opening a foreign-related hotel, the municipal tourism administrative department shall, jointly with the Municipal Public Security Bureau, examine and approve it, apply to the administrative department for industry and commerce for registration, and obtain a business license before starting business. If a hotel that has been approved to open for business closes down, changes jobs, merges, moves, changes its name or replaces its legal representative, it shall file with the public security organ that originally approved it within three days after the administrative department for industry and commerce handles the registration formalities for change. Article 7 The operation of hotels shall meet the following requirements:

(a) the location of the hotel should be far away from factories, warehouses and other places where inflammable, explosive, toxic, radioactive and corrosive dangerous goods are produced and stored.

(two) the hotel building, fire equipment, entrances and exits and passages should comply with fire safety.

(three) the use of civil air defense projects to run the hotel, its internal electrical appliances, fire protection, communications, ventilation equipment and access channels, etc., must comply with fire safety.

(four) when the hotel is open, it shall not affect the rest, life and environmental sanitation of the surrounding residents. When operating a hotel, individual or private workers shall abide by the relevant national laws and regulations and meet the above requirements, and the guest room area shall not be less than 100 square meter. Article 8 Hotel registrars should have a junior high school education or above, and can only take up their posts after the public security organs have conducted training in safety and household registration management. Hotels that receive foreigners at designated places should be equipped with foreign language registration and service personnel. Ninth in the hotel to open dance halls, music cafes, karaoke and other places of entertainment, should abide by these measures and the relevant provisions of the city's cultural and sports activities of public security management. Chapter III Public Security Management Article 10 The legal representative (or person in charge) of a hotel is responsible for the public security management of the hotel, and its main duties are:

(1) Organizing the implementation of the Measures for the Administration of Public Security in Hotel Industry and these Measures and other relevant laws and regulations;

(two) to educate and train employees in public security prevention knowledge. Newcomers should pass training and examination before taking up their posts;

(three) to establish and improve the security agencies, equipped with security personnel, the purchase of security equipment. Improve the registration, custody, guards, visitors, on duty, rounds, reports and other systems. , and is responsible for the implementation of the public security responsibility system;

(4) Accept the safety guidance, supervision and inspection of public security organs, be responsible for organizing staff to count wanted criminals or stolen goods, and assist public security personnel in performing official duties. Eleventh hotel staff in the hotel security management is the main responsibility:

(a) found criminals, criminals wanted by the public security organs, and report the discovery of property, as well as suspicious behavior, should immediately report to the public security organs and do a good job of control;

(two) when a case or accident occurs in the hotel, it should immediately report to the local police station, and protect the scene, truthfully reflect the situation and assist in the investigation and handling;

(three) found prohibited items and suspicious items, should immediately report to the public security organs and wait for treatment. Twelfth public security organs are mainly responsible for the management of hotel security:

(a) to supervise and guide the hotel to establish various safety management systems and implement safety precautions;

(two) to assist the hotel to train the staff in safety business knowledge;

(three) to investigate and deal with illegal and criminal activities in hotels according to law, and organize hotel staff to assist in investigating criminals and searching for stolen goods;

(4) Conduct safety inspection and verification (or replacement) of hotels, ensure their legal operation, investigate and deal with those responsible for violating the provisions on public security management of the hotel industry and the person in charge of hotels, and deal with hotels that have become illegal acts in conjunction with the administrative department for industry and commerce according to law. Thirteenth hotels must check their resident identity cards when receiving passengers. Fill in the passenger accommodation registration card or passenger registration book one by one according to the specified items. China citizens and compatriots from Hong Kong, Macao and Taiwan who have settled abroad shall register their accommodation in accordance with the Detailed Rules for the Implementation of the Law on the Entry and Exit of Citizens from China, People's Republic of China (PRC), the Interim Measures for the Administration of China Citizens Traveling to or from Hong Kong or Macao for Private Affairs and other relevant provisions; Foreigners shall go through the formalities of accommodation registration in accordance with the Law of People's Republic of China (PRC) on the Entry and Exit of Foreigners and the Detailed Rules for the Implementation of the Law of People's Republic of China (PRC) on the Entry and Exit of Foreigners, and submit the temporary accommodation registration form to the local public security organ within 24 hours. If it is found that the certificates held by the above-mentioned personnel have expired or been forged or altered, it shall immediately report to the local public security organ.

Legal basis:

Article 12 of the Measures for the Administration of Public Security in Hotel Industry in Sichuan Province, the legal representative and the person in charge of operation of the hotel are the persons in charge of public security of the hotel, and are responsible for the public security management and public security prevention of the hotel and its affiliated dance halls, bathing places, music cafes and other entertainment service places. Hotels should formulate emergency plans for emergencies, implement the responsibility system for safety and security precautions, carry out safety knowledge education and training, organize emergency drills, and support and cooperate with public security organs to do a good job in public security management.
