Different from many legal departments that focus on theoretical research, commercial law is a practical and applied legal department, and an effective grasp of the commercial law system is inseparable from the study of a large number of typical cases. In addition, the socio-economic relationship of commercial law adjustment is complex and changeable, so it is not easy to distinguish and understand it correctly, which also needs to provide students with more intuitive judgment basis through typical cases. It is based on the above thinking that we have compiled this case textbook.
For the preparation and selection of cases, we follow the following principles: First, the selected cases should be typical and representative, and some problems can be explained through case analysis. Second, the content of the case should be extensive, covering all parts of commercial law as much as possible. Third, the source of the case should be determined, that is, the selected case should basically be a real case, not a case fabricated in the study, so that the case can correctly reflect the real situation of social and economic relations. Fourth, the judgment basis of the case should be accurate. Although many commercial disputes do not necessarily have absolutely accurate answers, we still try to provide readers with as accurate answers as possible through detailed litigation evaluation and detailed analysis of the applicable basis of relevant laws. Of course, whether we can really achieve the above goals can only be concluded after readers use this book.
It is worth noting that due to the difficulty in case selection, despite our best efforts, the rationality of the selected cases cannot be guaranteed. In addition, our level is limited, and some viewpoints in the case analysis may be inaccurate. Here, we sincerely hope that readers and scholars can correct me, make the book perfect day by day, and thus better serve the public.
