Site selection criteria for isolated hotels requisitioned by the government

Some time ago, people in the observation point of isolating the close contacts of COVID-19 cases or other people will see some hotels requisitioned by the local government for epidemic prevention and control. This is a government expropriation behavior for the purpose of public management and due to special circumstances.

Article 245th of the Civil Law of People's Republic of China (PRC) stipulates that due to emergency needs such as emergency rescue and disaster relief, epidemic prevention and control, organizations and individuals may be expropriated for their real estate or movable property in accordance with the authority and procedures prescribed by law. The expropriated real estate or chattel shall be returned to the expropriated person after use. If an organization or individual's real estate or chattel is expropriated or damaged or lost after expropriation, compensation shall be given.

This article stipulates that there is only "emergency rescue and disaster relief" in the current Property Law of People's Republic of China (PRC). It is precisely because of the occurrence of the COVID-19 epidemic that the legislature found that the prevention and control of the epidemic is also a very likely situation for government expropriation. Therefore, on the original basis, this paper includes "disease prevention and control" in the compilation of property rights, making the scope of government expropriation more representative. Of course, expropriation will be compensated according to the market price. Although the government is for the public interest, it will not harm the interests of any organization or individual.
