What procedures and materials are needed for marriage registration?

Application, examination and registration are three links in the process of marriage registration.

(1) application

Those who meet the requirements for applying for marriage registration shall apply for marriage registration at the marriage registration office where one party is located with their registration photos, relevant certificates and supporting materials, and both parties shall fill in the application documents for marriage registration on the spot.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, China citizens applying for marriage in China must hold their own identity certificate, household registration certificate, marriage examination certificate, single spouse certificate and a signed statement that they are not related to each other. For the divorced party, he/she must also carry divorce documents.

Foreigners (including foreigners residing or temporarily staying in China, China people and foreigners residing in China) applying for marriage in Chinese mainland must hold their valid passports or nationality certificates, foreigners' residence permits or temporary entry and residence certificates, and certificates that can effectively prove their marital status.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the documents and certificates meet the conditions for marriage. If the application materials submitted by the parties are unknown, the marriage registration authority will ask the parties and ask them to provide relevant certification materials when necessary.

(3) Registration (Licensing)

The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate to the parties concerned; For divorced people who want to remarry, the marriage registration office will cancel their divorce certificates; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The divorce registration procedure is as follows:

(1) application

If a husband and wife voluntarily divorce, they shall sign a divorce agreement in accordance with the provisions, apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials in accordance with the provisions:

Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party unwilling to divorce may go to the marriage registration office that accepts the application for divorce registration with his identity certificate and the Receipt for Accepting the Application for Divorce Registration (if it is lost, a written explanation is required), withdraw the application for divorce registration, and fill out the application for withdrawing the divorce registration in accordance with the relevant provisions on withdrawing the application for divorce registration. After the marriage registration authority has verified that it is correct, it will issue a Confirmation Letter for Cancellation of Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the expiration date of the period), both parties shall bring relevant certificates and materials as required, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc. , and apply for a divorce certificate at the marriage registry. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Do not meet the conditions for divorce registration, do not provide divorce registration procedures. If a party requests to issue a notice not to register for divorce, it shall issue it.
