The Regulations on Dog Breeding in Nanchang (hereinafter referred to as the Regulations) was adopted at the 31st meeting of the Standing Committee of the 14th Nanchang Municipal People's Congress on August 28th and approved at the 20th meeting of the Standing Committee of the 12th Jiangxi Provincial People's Congress on September 24th. These Provisions shall come into force as of July 1 year 1 day.

The "Regulations" consists of seven chapters, namely, general rules, kennel zoning, immunization and registration, dog-raising behavior norms, dog-raising acceptance and adoption, dog-raising diagnosis and management, legal responsibilities and supplementary provisions, with a total of 54 articles. Compared with the original regulations, the Regulations are more operational and humanized in content.

According to Article 10 of the Regulations, dog management within the administrative area of this Municipality is divided into key management areas and general management areas, and other areas designated by the urban area of this Municipality and the municipal people's government and the town planning area where the county people's government is located are key management areas, and the specific scope is announced to the public by the municipal and county people's governments, and dynamic adjustment is implemented. Individuals in key management areas are not allowed to keep dangerous dogs, and it is forbidden to keep and sell dangerous dogs. Individuals are limited to one dog per household.

Chapter I General Provisions

Article 1 These Regulations are formulated in accordance with the provisions of relevant laws and regulations and in the light of the actual situation of this Municipality, with a view to strengthening the management of dog-raising, standardizing dog-raising behaviors, safeguarding citizens' health and personal safety, and maintaining city appearance and environmental sanitation and social public order.

Article 2 These Regulations shall apply to dog-raising behavior and its supervision and management within the administrative area of this Municipality.

The management of special dogs such as the army and police dogs, as well as zoos and dogs for scientific research, shall be implemented in accordance with the relevant provisions of the state.

Article 3 Dog management shall follow the principles of supervision by government departments, self-discipline of dog owners, participation of grass-roots organizations and public supervision.

Article 4 The municipal, district (county) people's governments shall be responsible for the organization and implementation of these Regulations, establish a coordination mechanism for dog management, organize, guide and supervise dog management, and coordinate and solve major problems in dog management.

Article 5 The municipal public security organ is the competent department of dog management in this Municipality. District (county) public security organs shall be responsible for the management of dogs in their respective jurisdictions.

Animal husbandry and veterinary departments are responsible for dog immunization and quarantine, and supervise and manage the harmless treatment of epidemic spots, infected dogs and dog carcasses.

The administrative law enforcement department of urban management is responsible for investigating and dealing with the environmental sanitation behavior caused by raising dogs.

The health and family planning department is responsible for the supervision and management of rabies vaccination and patient diagnosis and treatment in medical and health institutions.

The market and quality supervision and management department is responsible for the supervision and management of dog business activities.

Street offices and town (township) people's governments shall cooperate with relevant departments to do a good job in dog management.

Sixth neighborhood (village) committees shall assist the relevant departments to carry out dog management, publicize and educate the neighborhood (village) people, discourage illegal dog-raising behavior, and mediate dog-raising disputes.

Neighborhood (village) committees or owners' committees may formulate conventions on matters related to dog management in their residential areas and supervise their implementation.

Property service enterprises should discourage illegal dog raising and assist relevant departments in dog management.

The relevant departments of public security, animal husbandry and veterinary medicine shall give guidance to the neighborhood (village) committees and owners' committees to manage dogs by themselves.

Seventh people's governments at all levels in this Municipality, relevant departments and news media should carry out publicity and education on keeping dogs according to law, keeping dogs civilized and preventing rabies through various forms.

Relevant industry associations, animal protection organizations and other social organizations should actively advocate raising dogs according to law and in a civilized way, and assist in the publicity and education of dog management.

Article 8 Dog owners shall keep dogs in accordance with the law and in a civilized manner, and shall not harm the public interests or the legitimate rights and interests of others.

Ninth units and individuals have the right to discourage, report and complain about illegal dog-raising behavior.

The public security organs and other departments shall publish the telephone numbers of reports and complaints, and shall register and handle them in time after receiving them.

Chapter II Zoning, Immunity and Registration of Dog Breeding

Tenth dog management within the administrative area of this Municipality shall be classified according to key management areas and general management areas.

Other areas designated by the people's government of the city or county and the town planning area where the people's government of the county is located are the key management areas, and the specific scope is announced to the public by the people's government of the city or county, and dynamic adjustment is implemented. Other areas outside the key management areas are general management areas.

Eleventh key management areas, the implementation of rabies compulsory immunization and dog registration system for dogs. No unit or individual may keep dogs that have not been immunized or registered.

Individuals who raise dogs in key management areas are limited to one per household; Don't keep dangerous dogs.

It is forbidden to raise or sell dangerous dogs in key management areas. The standard and breed list of dangerous dogs shall be determined by the municipal public security organ in conjunction with the municipal animal husbandry and veterinary department and announced to the public.

Twelfth general management area, dog owners should be in accordance with the relevant provisions of the state, regularly for dogs vaccinated against rabies.

Thirteenth offices, hospital treatment areas, school teaching areas, student dormitories, unit dormitories and kindergartens are prohibited from raising dogs.

Article 14 Dog owners shall regularly take their dogs to animal epidemic prevention and control institutions or animal clinics entrusted by them according to law for rabies immunization, and obtain proof of dog immunization.

Newborn puppies were immunized against rabies for the first time at the age of three months, for the second time at the age of twelve months, and once a year thereafter; Immunization of other epidemics shall be handled in accordance with relevant regulations.

Animal husbandry and veterinary departments shall set up rabies immunization spots in accordance with the principle of reasonable layout and convenient vaccination.

Fifteenth individuals in key management areas shall meet the following conditions:

(1) Having full capacity for civil conduct;

(2) Having an independent residence.

Article 16 If an individual applies for raising a dog in a key management area, he shall, within 20 days from the date of obtaining the dog immunization certificate, bring the dog to the designated place of the local (county) public security organ for dog registration, and submit the following materials:

(a) the identity certificate of the dog owner;

(2) dog immunization certificate;

(3) Real estate license and house lease certificate.

Seventeenth key management area units to raise dogs shall meet the following conditions:

(a) Implementing security, guarding property and other reasonable purposes;

(two) a sound dog management system;

(3) having full-time personnel to look after dogs;

(four) there are dog cages, kennels, fences and other closed captive facilities.

Article 18 Where a unit in a key management area applies for raising a dog, it shall, within 20 days from the date of obtaining the dog immunization certificate, bring the dog to the designated place of the local (county) public security organ for dog registration, and submit the following materials:

(a) the qualification certificate of the unit, the identity certificate of the legal representative or the person in charge of the unit;

(2) dog immunization certificate;

(3) List of breeds and quantities of dogs;

(four) the relevant certificates that meet the conditions stipulated in Article 17 of these regulations.

Nineteenth district (county) public security organs shall make a decision on whether to approve the registration within five working days from the date of accepting the application for raising dogs. Eligible, register and issue dog registration certificate and dog logo, and implant electronic chips for dogs; Do not meet the conditions, not to register, explain the reasons in writing, and inform the applicant to dispose of the dog within ten days or send it to a dog shelter.

If it is necessary to further verify the situation or there are other special circumstances, it may extend five working days to go through the registration formalities and explain the reasons to the applicant in writing.

Article 20 The public security organ and the animal husbandry and veterinary department shall set the dog rabies vaccination and dog registration and certification in the same place, and announce the handling place to the public.

Twenty-first dog registration certificate is valid for one year. After the expiration of the period, it is necessary to continue to raise dogs. Dog owners shall, within one month before the expiration of the period, go through the formalities of dog renewal registration at the designated place of the local (county) public security organ with the dog immunization certificate and dog registration certificate.

Article 22 Dog owners in key management areas shall, under any of the following circumstances, go through the formalities of alteration, cancellation or completing formalities at the designated place of the local (county) public security organ with the Dog Registration Certificate:

(1) If the raised dogs are sold or donated to others, the purchaser or the donee shall go through the formalities of change within 30 days from the date of purchase or donation;

(two) to give up the dog, the dog should be sent to the dog shelter, and go through the cancellation procedures;

(3) If a dog dies, it shall go through the cancellation procedures within 30 days from the date of death of the dog.

If the dog registration certificate and dog logo are lost or damaged, the dog owner shall, within 30 days from the date of loss or damage, reissue them with the dog owner's identity certificate.

If the address, contact information and other information of the dog breeder changes, it shall go through the formalities of change at the same time as continuing to register the dog.

Twenty-third it is forbidden to bring dangerous dogs that are not registered in this Municipality into the key administrative areas of this Municipality. Those who bring other dogs that are not registered in this Municipality into the key administrative areas of this Municipality shall hold the dog immunization certificate; Those who stay for more than three months shall go through the registration formalities in accordance with the provisions of these regulations.

Article 24 It is forbidden to forge, alter or buy or sell dog immunization certificate, dog registration certificate and dog logo.

Twenty-fifth dogs keep puppies, dog owners should hand over the over-limit dogs to others or send them to dog shelters within three months from the date of birth of puppies.

Encourage dog owners to neuter their dogs.

Article 26 The public security organ shall establish a dog management information system and electronic files of dog management in key management areas, and share information with animal husbandry and veterinary, urban management administrative law enforcement, health and family planning departments, neighborhood offices, town (township) people's governments, neighborhood (village) committees and property service enterprises, and provide relevant management and service information to the public.

The electronic archives of dog management shall record the following information:

(a) the dog owner's name, address and contact information;

(2) breed, immune status, date of birth, main physical characteristics and photos of the dog;

(three) the record of administrative punishment for violating the provisions on dog management;

(four) the issuance, alteration, cancellation and replacement of the relevant certificates for dog registration;

(5) Other information that needs to be recorded.

Twenty-seventh dog owners in key management areas shall pay the dog management fee to the public security organ when handling the dog registration or renewal registration. In the first year, everyone will pay 300 yuan, and then pay 200 yuan every year.

Feeding guide dogs for the blind, dogs for the severely disabled, and dogs for the elderly over 65 are exempt from management fees. Breeding neutered dogs, with the dog neutering certificate halved the dog management fee.

Twenty-eighth dog management fees should be paid in full to the financial, the implementation of two lines of revenue and expenditure management. The funds required for dog management and related construction services shall be included in the financial budget of the city, district (county).

Chapter III Code of Conduct for Raising Dogs

Twenty-ninth dog owners should abide by the following provisions when raising dogs:

(a) shall not affect the normal production and life of others, and shall take effective measures to stop barking when affecting others;

(2) Don't let dogs intimidate or hurt others, and don't organize dog fighting activities;

(3) Do not pollute the environment;

(four) no dog in the residential area of * * *;

(five) shall not abuse or abandon dogs;

(six) shall not be abandoned at will, and shall be treated harmlessly in accordance with the relevant provisions;

(seven) other provisions of laws and regulations.

Thirtieth dogs are prohibited from entering the following areas:

(a) office space, hospital treatment area, school teaching area, student dormitory, unit dormitory, kindergarten and other places for children's activities;

(two) stadiums, museums, libraries, theaters, Internet cafes and other public cultural and entertainment places;

(three) public transport and waiting places other than taxis;

(4) cultural relics protection units;

(5) Dining places, shopping malls, hotels and indoor farmers' markets;

(6) Commemorative places such as Bayi Square.

Blind people carrying guide dogs or severely disabled people carrying assistance dogs are not subject to the restrictions stipulated in the preceding paragraph.

In addition to the provisions of the first paragraph, other units and individuals have the right to decide to prohibit dogs from entering the places where they operate or manage. Dogs are prohibited from entering the area, and obvious no-entry signs are set up.

Article 31 The municipal, district (county) people's governments may designate areas temporarily forbidden to dogs during major festivals or large-scale activities, and set up signs.

Article 32 The park management unit may set up a public area for dog activities in the park, and the area shall set up corresponding sanitary facilities and billboards, indicating the area scope, opening hours, warning matters and other contents.

Thirty-third key management areas with dogs should comply with the following provisions:

(1) Wearing dog logos for dogs;

(two) lead the dog with a dog rope to avoid others;

(3) Holding a dog or putting a muzzle on the dog in crowded places such as corridors and elevators;

(four) when taking a taxi, the driver shall obtain the consent, and lead the dog or put a muzzle on the dog;

(5) stop the barking and attacking behavior of dogs;

(six) immediately clean up the dog excrement;

(seven) shall not be carried alone by minors under the age of sixteen.

When a dog is led by a leash, if the weight of the dog is less than 20 kg, a leash with a length of less than two meters shall be used; If the dog weighs more than 20kg, a leash with a length of1.5m should be used, and a muzzle should be put on the dog.

Dangerous dogs kept by the unit need to leave the breeding place only because of immunization, diagnosis and treatment, etc. , should be put in a dog cage.

Thirty-fourth dogs cause personal or property damage to others, dog owners should bear corresponding legal responsibilities according to law.

If a dog hurts others, the dog owner shall immediately send the injured person to a medical institution for diagnosis and treatment, and advance the medical expenses.

Advocate dog owners to insure dog liability insurance.

Article 35 If a dog owner discovers that his dog has or is suspected to have rabies, he shall immediately take isolation control measures, and promptly report to the animal husbandry and veterinary department, the supervising agency for animal health or the prevention and control agency for animal diseases, and deal with it in accordance with the relevant provisions of the state.

Chapter IV Raising Dogs

(9) Dog owners who violate the dog-raising code of conduct and cause injuries to dogs shall be fined between 1,000 yuan and 5,000 yuan for units and between 500 yuan and 1,000 yuan for individuals; If a dog injures others more than twice or injures more than two people at a time, the dog shall be confiscated, and a fine of 10,000 yuan shall be imposed on the unit and 2,000 yuan on the individual.

Article 47 A dog shall be detained for ten days, during which time it shall be delivered to a dog shelter. If the unit or individual fails to reclaim the dog within five days after the seizure is lifted according to law, the dog shelter shall handle it in accordance with the provisions of the second paragraph of Article 37 of these regulations.

Forty-eighth dog owners in violation of the provisions of this Ordinance, the confiscation of dogs, the public security organs to cancel the dog registration certificate, and within three years shall not apply for dog registration.

Forty-ninth in violation of the provisions of these regulations, dogs pollute the environment and sanitation, and the urban management administrative law enforcement department shall impose a fine of fifty yuan each.

Fiftieth in violation of the provisions of this Ordinance, engaged in dog sales and business activities in the no-breeding area, the market and quality supervision and management departments shall order it to make corrections within a time limit; Refuses to correct, confiscate the dog.

Fifty-first acts in violation of the provisions of these regulations, laws and regulations have been punished, the relevant departments shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Fifty-second public security organs or other relevant departments and their staff have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions by their units, higher authorities or supervisory organs; Suspected of a crime, transferred to judicial organs:

(1) Handling dog registration and other procedures for dog owners who do not meet the requirements;

(two) to meet the conditions of raising dogs, not to handle or delay the formalities of dog registration;

(3) Failing to deal with the problems found in the performance of duties or the reports and complaints received, or passing the buck;

(four) the confiscated dogs are owned by themselves or transferred to others;

(five) other dereliction of duty, abuse of power, favoritism.

Chapter VII Supplementary Provisions

Fifty-third before the implementation of these regulations, dogs that have been registered according to law will continue to be valid.
