What procedures and materials are needed for marriage registration?

Application, examination and registration are three links in the process of marriage registration.

(1) application

Those who meet the requirements for applying for marriage registration, with their own registration photos, relevant certificates and supporting materials, both parties apply for marriage registration at the marriage registration office where one party's permanent residence is located, and both parties fill in the declaration of applying for marriage registration and other documents.

The certification materials needed to apply for marriage registration depend on individual circumstances. For example, China citizens applying for marriage registration in China must hold their valid ID card, household registration book, marriage examination certificate, single spouse certificate and a signed statement that they are not related to each other. For divorced parties, they must also hold divorce certificates or divorce proof materials.

Foreigners (including foreigners residing in China or temporarily coming to China, foreign Chinese and foreigners residing in China) applying for marriage in China must hold their own identity documents (passports or other nationality certificates), Alien Residence Permit issued by public security organs or valid temporary residence certificates in China, and marriage status certificates issued by domestic notary organs certified by the Ministry of Foreign Affairs (or authorized organs of the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the application for marriage is correct. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties and ask them to provide materials related to the application for marriage registration when necessary.

(3) Registration (Licensing)

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For divorced people who want to remarry, the marriage registration office will generally cancel the divorce certificate; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

Where a husband and wife voluntarily divorce in the Mainland, both parties who need a divorce shall sign a divorce agreement in accordance with the provisions, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials in accordance with the provisions:

2. Valid identity documents that meet the requirements for divorce registration, such as household registration book, identity card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After verifying the application materials submitted by the parties, the staff will issue a receipt for accepting the divorce registration application. If the application conditions for divorce registration are not met, the marriage registration authority will not accept it, and if necessary, the notice of rejection of divorce registration application will be issued according to the requirements of the parties.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, if one party does not agree to divorce, it can withdraw the divorce registration application submitted before at the divorce registration office that accepts the application for divorce registration by presenting its identity certificate and the receipt for accepting the application for divorce registration (if the receipt is lost, it is not required to provide a written explanation), and fill out the "Withdrawal of the Application for Divorce Registration" and other relevant documents in person. After verification, the marriage registration authority shall issue a Confirmation Letter for Withdrawing the Application for Divorce Registration. Within 30 days after the end of the cooling-off period of divorce, if both parties fail to apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday will be the expiration date of the period), both parties shall handle the divorce certificate at the marriage registration office with the divorce agreement, marriage certificate, photos and valid documents to prove their identity. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Those who do not meet the requirements for divorce registration shall not be registered for divorce, and if necessary, a notice of not registering for divorce shall be issued at the request of the parties concerned.

(5) Registration and certification

The marriage registration authority shall register in accordance with the provisions of the marriage registration work norms and issue divorce certificates.
