I forgot to bring something after I checked out. What if the hotel says it can't be found?
1. When the guest checks out, the hotel has the responsibility to check the items in the room, but after checking out, the guest generally does not compensate for the lost items. If you lose valuables, you can negotiate with the hotel. If no agreement can be reached, you can consider reporting the case and the public security organ will be responsible for the investigation. In the event of a dispute, the consumer needs to prove that the goods have indeed been left in the hotel, and if necessary, the consumer can also call the police to obtain the monitoring certificate. At the same time, when customers report the left-behind items, the hotel has the obligation to actively cooperate with customers to find their lost items.
2. Legal basis: Article 56 of the People's Republic of China (PRC) Public Security Administration Punishment Law.
If the hotel staff fails to register the names, types and numbers of identity documents of the guests, or fails to stop them knowing that dangerous goods are brought into the hotel, they shall be fined between 200 yuan and 500 yuan. Hotel workers who know that the overnight guest is a criminal suspect or wanted by the public security organ and fail to report to the public security organ shall be fined between 200 yuan and 500 yuan; If the circumstances are serious, he shall be detained for not more than five days and may be fined not more than 500 yuan.
Second, how to punish check-out?
The liquidated damages are determined in advance by the parties through agreement, which can not only make up for the losses of the observant party, but also punish the defaulting party. The liquidated damages shall be determined by both parties through consultation, and the amount is not limited. Liquidated damages are generally determined according to the expected losses caused by one party's breach of contract. If the agreed liquidated damages are lower than the actual losses after one party breaches the contract, the observant party may bring a lawsuit to the court to request an increase in liquidated damages; If the agreed liquidated damages are "excessively" higher than the actual losses, the defaulting party may bring a lawsuit to the court to reduce the liquidated damages. The comparison standard of excess liquidated damages is the actual loss of the observant party. The actual loss includes direct loss and performance loss.
