Regulations of Zhuhai Municipality on Rewarding and Protecting Courageous Persons

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the actual situation of this Municipality for the purpose of promoting healthy trends, strengthening the construction of socialist spiritual civilization, maintaining social stability, and rewarding and guaranteeing the courageous people. Article 2 The term "being courageous" as mentioned in these Regulations refers to the act of fighting against the illegal and criminal acts being carried out, or rescuing people from danger in order to protect national interests, social interests or other legitimate rights and interests such as personal and property safety of others. Article 3 These Regulations shall apply to the rewards and guarantees for courageous people within the administrative area of this Municipality.

These Regulations shall also apply to the rewards and guarantees for the courageous acts of registered residents in this Municipality outside the administrative area of this Municipality.

People's police, armed police, servicemen and other public security personnel shall be rewarded and guaranteed with reference to these regulations for their courageous acts when they are not performing official duties. Article 4 The principle of combining spiritual encouragement with material rewards, and combining social relief with social pension shall be implemented for the reward and guarantee of courageous people. Article 5 The Municipal People's Government shall be responsible for organizing the implementation of these Regulations, and the specific work shall be handled by the municipal public security department. Civil affairs, labor and social security, health, finance, personnel, education and other departments. Should be in accordance with their respective responsibilities, close cooperation, do a good job in the reward and protection of courageous people. Article 6 The expenses for rewarding and guaranteeing the courageous people shall be included in the financial budget of the municipal and district people's governments, and the municipal and district financial departments shall timely allocate the rewards and guarantee expenses according to the confirmed courageous people, and accept the supervision of relevant departments according to law.

The Municipal People's Government and its relevant departments encourage and accept donations from all walks of life to courageous people, and the donations are used to reward courageous people. Chapter II Confirms that Article 7 can be regarded as a courageous act if it commits one of the following acts, is courageous, has outstanding deeds or has made significant contributions:

(a) to fight against the ongoing illegal and criminal acts;

(two) regardless of personal safety, capture or actively assist the public security organs, state security organs and judicial organs to capture wanted persons, escape from prison, being pursued or being found immediately after committing a crime;

(three) in the rescue and disaster relief, regardless of personal safety, save the state, collective property or other people's lives and property;

(four) other acts to protect the national interests, social public interests or the safety of others' lives and property from ongoing illegal infringement or ongoing danger. Eighth courageous review committee is responsible for the investigation, examination and confirmation of courageous acts. The review committee is composed of municipal public security, civil affairs, labor and social security, personnel, health and other departments, and its office is located in the Municipal Public Security Bureau. Article 9 If an individual or organization reflects the situation of doing a good job or applies for confirmation of the act of doing a good job, it shall submit it to the review committee within 30 days from the date of occurrence, and provide relevant clues or proof materials. Article 10 The evaluation committee shall, within 30 days from the date of receiving the application or recommendation, investigate and review the courageous acts and make a decision on whether to confirm them. If the situation is complicated, it can be extended to 60 days. Eleventh the review committee in the investigation, examination and confirmation of courageous acts, the relevant units and individuals shall actively cooperate and truthfully provide proof materials.

Beneficiaries who are courageous have the obligation to provide proof for the confirmation of courageous acts. Chapter III Awards Article 12 After the courageous acts are confirmed, the Municipal People's Government will issue certificates to the courageous persons, and at the same time give the following single or multiple awards:

(1) circulate a notice of praise;

(2) record merit;

(3) granting a one-time bonus;

(4) conferring honorary titles. Thirteenth to encourage state organs, enterprises and institutions and social organizations to commend and reward courageous people. Fourteenth because of the heroic sacrifice and meet the conditions of revolutionary martyrs, the municipal civil affairs department according to the relevant materials, go through the formalities for examination and approval of revolutionary martyrs. Those who are approved as revolutionary martyrs shall enjoy the treatment of martyrs in accordance with relevant regulations. Chapter IV Safeguards Article 15 Any unit or individual shall promptly send the injured to a medical institution. Medical institutions shall actively organize rescue and treatment, and shall not shirk, refuse or delay for any reason. Article 16 The medical expenses, lost time, disability living allowance or funeral expenses of the injured or sacrificed person due to the courageous act shall be borne by the injurer or the responsible person according to law; If the offender or the responsible person is really unable to bear all the expenses, the insufficient part shall be paid from the courageous security fund; If there is no injurer or responsible person, and there is an injurer or responsible person, but it is really unable to bear it, it will be paid from the courageous security fund; If there is a beneficiary, the beneficiary shall give appropriate compensation. Article 17. Those who delay their work because of their bravery are regarded as attendance by their work units, and their wages, benefits and other benefits will remain unchanged during the treatment of work-related injuries. If there is no work unit, no fixed income and life is difficult, appropriate economic subsidies will be given from the courageous security expenses. Eighteenth because of the courageous disabled, disability rating by the labor ability appraisal institutions in accordance with the relevant provisions.

In the process of disability assessment, civil affairs, health and other departments and medical institutions should actively cooperate. Nineteenth because of the courageous part of the loss of ability to work, the unit shall arrange for it to engage in the work within its capacity; Those who have completely lost their ability to work because of their courage should be given disability and retirement procedures and enjoy corresponding disability and retirement benefits; Those who are injured, maimed or killed because of being courageous and meet the requirements of industrial injury insurance shall be given corresponding treatment in accordance with the provisions of industrial injury insurance.

Courageous people can not enjoy the treatment prescribed in the preceding paragraph of this article, have permanent residence in this city, and partially lose their ability to work, and the municipal and district labor administrative departments will introduce them to employment. Partial loss of working ability and inability to arrange employment and complete loss of working ability, the municipal civil affairs department shall issue a monthly living allowance according to the minimum wage standard of enterprises in this Municipality. If there is no permanent residence in this city, a one-time subsidy will be paid from the courageous security fund according to the disability grade standard of courageous people.
