Legal basis: Article 32 of the Regulations on the Implementation of People's Republic of China (PRC) Tobacco Monopoly Law stipulates that counterfeit trademark tobacco products seized by relevant departments according to law shall be handed over to the tobacco monopoly administrative department for public destruction in accordance with relevant state regulations, and it is prohibited to sell them in any way.

Article 46 of the Regulations on the Implementation of the Tobacco Monopoly Law of People's Republic of China (PRC) also stipulates that the tobacco monopoly administrative department shall supervise and inspect the implementation of the tobacco monopoly law and these regulations according to law, investigate and deal with cases that violate the tobacco monopoly law and these regulations, and investigate and deal with smuggling, counterfeiting and shoddy tobacco monopoly products jointly with relevant state departments.

The punishment for selling fake wine is based on Article 140 of the Criminal Law: producers and sellers who adulterate fake products, pass fake products off as genuine products, and pass unqualified products off as qualified products, and the sales amount is more than 50,000 yuan but less than 200,000 yuan, shall be sentenced to fixed-term imprisonment of not more than two years or criminal detention, and shall also be fined not less than 50% but not more than two times the sales amount; If the sales amount is more than 200,000 yuan but less than 500,000 yuan, he shall be sentenced to fixed-term imprisonment of not less than two years but not more than seven years, and shall also be fined not less than 50% but not more than two times the sales amount; If the sales amount is more than 500,000 yuan but less than 2 million yuan, he shall be sentenced to fixed-term imprisonment of more than seven years, and shall also be fined more than 50% but less than two times the sales amount; If the sales amount is more than 2 million yuan, he shall be sentenced to fixed-term imprisonment of 15 years or life imprisonment, and shall also be fined more than 50% but less than 2 times the sales amount or his property shall be confiscated.

To apply for a tobacco monopoly retail license, a tobacco hotel shall meet the following conditions:

(1) Having funds suitable for the retail business of tobacco products;

(2) Having a fixed business place independent of the domicile;

(three) in line with the requirements of the reasonable layout of local tobacco products retail outlets;

(four) other conditions stipulated by the administrative department of tobacco monopoly in the State Council.
