Xianning City Regulations Prohibiting Fireworks and Firecrackers
Article 1. In order to protect public safety, personal and property safety, and protect the ecological environment, in accordance with the "Law of the People's Republic of China on the Prevention and Control of Air Pollution", the "Regulations on the Safety Management of Fireworks and Firecrackers" and other relevant These regulations are formulated in accordance with the provisions of laws and regulations and in combination with the actual situation of this city. Article 2 The term "fireworks and firecrackers" as mentioned in these Regulations refers to various types of fireworks, firecrackers and fireworks bombs that can produce smoke, light and sound and other flammable and explosive dangerous items. Article 3 It is prohibited to set off fireworks and firecrackers in the following areas of this city:
(1) The area enclosed by Quandu Avenue, Taiyi Avenue, Chang'e Avenue, Juning Avenue, 107 National Highway and Changheng Line in Xian'an District , and other areas determined and announced by the district people's government;
(2) The people's governments of Jiayu County, Chibi City, Tongcheng County, Chongyang County, and Tongshan County shall determine and announce them within their respective administrative regions area.
In areas where fireworks and firecrackers are prohibited, county (city, district) people's governments should uniformly set up warning signs. Article 4 No unit or individual may produce, operate or store fireworks and firecrackers in areas where the setting off of fireworks and firecrackers is prohibited. Article 5 These Regulations shall be organized and implemented by the Municipal People's Government.
The county (city, district) people's government and the Xianning High-tech Industrial Development Zone Management Committee are responsible for prohibiting the setting off of fireworks and firecrackers in their jurisdiction.
The public security department is the department in charge of prohibiting the setting off of fireworks and firecrackers. Departments such as production safety supervision and management, industrial and commercial administration, quality and technical supervision, environmental protection, urban management, civil affairs and supply and marketing cooperatives shall, in accordance with their respective responsibilities, do a good job in prohibiting the setting off of fireworks and firecrackers. Article 6 The town (township) people's government and sub-district offices are responsible for the management of the prohibition of setting off fireworks and firecrackers in the areas under their jurisdiction.
Residents (village) committees and property service companies should do a good job in promoting, inspecting, informing, and discouraging the prohibition of setting off fireworks and firecrackers. Article 7: State agencies, social groups, enterprises, institutions and other organizations are responsible for the publicity, education and management of the prohibition of setting off fireworks and firecrackers in their own units.
Fireworks and firecrackers-related industry associations should strengthen industry self-discipline and cooperate with the government and relevant departments to prohibit the setting off of fireworks and firecrackers.
Schools should incorporate the prohibition on setting off fireworks and firecrackers into publicity and education content.
Radio, television, newspapers, the Internet and other media should carry out public welfare propaganda on the prohibition of setting off fireworks and firecrackers.
Guardians of minors are responsible for the management and education of minors’ compliance with these regulations. Article 8: The ban on setting off fireworks and firecrackers is included in the management of comprehensive social security goals. Article 9: Any unit or individual has the right to discourage and report violations of these regulations. After receiving a report, the public security, work safety supervision and management and other departments shall promptly investigate and deal with it, keep the whistleblower's information confidential, and protect the legitimate rights and interests of the whistleblower.
Rewards will be given to units and individuals who report truthfully. The specific reward methods will be formulated and announced by the Municipal People's Government. Article 10 In areas where the setting off of fireworks and firecrackers is prohibited, operators engaged in weddings, banquets, funerals and other services shall inform service recipients of the prohibition on setting off fireworks and firecrackers, and shall not provide them with services of setting off fireworks and firecrackers. The behavior should be discouraged. If the dissuasion is ineffective, it should be reported to the public security department in a timely manner. Article 11 In areas where the setting off of fireworks and firecrackers is prohibited, if a unit sets off fireworks and firecrackers, the public security department shall order it to stop setting off and impose a fine of 500 yuan; if an individual sets off fireworks and firecrackers, the public security department shall order it to stop setting off, criticize and educate them, and impose a fine of 100 yuan. A fine of more than 500 yuan and less than 500 yuan is imposed.
If state personnel set off fireworks and firecrackers, in addition to being punished in accordance with the preceding paragraph, relevant units will also provide criticism and education, order written inspections, and notify criticisms according to their authority.
If minors set off fireworks and firecrackers, in addition to being punished in accordance with the law, their guardians will also be ordered to discipline them.
Article 12 In areas where the setting off of fireworks and firecrackers is prohibited, operators engaged in services such as weddings, banquets, and funerals, if they provide services of setting off fireworks and firecrackers for service recipients, the illegal gains shall be confiscated by the public security department and a fine of not less than 500 yuan but not more than 2,000 yuan shall be imposed. A fine of 500 yuan will be imposed on the person in charge of the unit or the person directly responsible; if the service recipient fails to report the behavior of setting off fireworks and firecrackers in a timely manner, the public security department will order him to make corrections and impose a fine of 500 yuan. Article 13 In areas where the setting off of fireworks and firecrackers is prohibited, the production, operation and storage of fireworks and firecrackers shall be handled by the production safety supervision and management, public security and other departments in accordance with the law. Article 14 If the unit and its staff responsible for the management of prohibiting the setting off of fireworks and firecrackers commit any of the following acts, they shall be ordered to make corrections by their competent unit or supervisory authority; if the circumstances are serious, the directly responsible person in charge and other directly responsible persons shall be ordered to make corrections. Personnel shall be given administrative sanctions in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) Failure to perform management duties prohibiting the setting off of fireworks and firecrackers;
(2) Failure to accept reports, Timely investigation and handling;
(3) Administrative penalties imposed illegally;
(4) Other abuse of power, dereliction of duty, and malpractice for personal gain. Article 15 Anyone who violates the provisions of these Regulations and constitutes a violation of public security management shall be subject to public security management penalties in accordance with the law; if it constitutes a crime, criminal liability shall be pursued in accordance with the law; if it causes losses to national, collective, or personal property or personal injury to others, civil liability shall be borne in accordance with the law. Article 16: In areas where the setting off of fireworks and firecrackers is prohibited, the use of electronic firecrackers and electronic salutes shall be governed by these regulations.
