Has anyone caught the hacking incident in Changshu 19?

I believe you have seen all the videos six months ago, right? At that time, I heard that it was our six defending Hunan fellow villagers who were sentenced instead. The following is transferred from Tencent News.

Six migrant workers in Hunan were sentenced for repelling 24 door-to-door hackers.

This is a "battle" called "action blockbuster" by netizens.

I have waited for 24 people to come to the office on the second floor of Jiangsu Changshu Investment Company. The two sides fought. He Qiang, 20, and five other Hunan villagers repelled him with kitchen knives, computer speakers and chairs. The two sides cut dozens of knives at each other.

This scene was completely photographed by the camera and circulated wildly after being posted on the Internet. The punishment result of Changshu official on this matter has caused continuous controversy on the Internet. Hunan wage earners, regarded by netizens as "heroic counterattacks" at home, were sentenced by the local court for "gathering people to fight". Our reporter Zhou Qingshu

(Weibo) Report from Changshu, Jiangsu Province

Conflict: 24 people came to the door with knives.

The story began six months ago.

On April 2 12, Jiang, secretary of the investment company, went to the boss's office to print the document. /kloc-around 0/2: 44, 4 cars stopped downstairs and 24 people got off. After handing out the machete, a "bald head" took the lead in entering the company.

The surveillance video of the front door, office and corridor of Zhongfa Investment Company shows that "Bald Head" walked into Xu Jianzhong's office on the second floor within 45 minutes and 38 seconds. There are seven people in the office, including He Qiang and Jiang. Except Jiang and Jiang, they are all from Hunan.

"Bald" stood in the middle of the room. A man on the right took a knife holder to John Zhang's neck after entering the door, and a man with glasses on the left punched him down on the sofa. He Qiang pulled out a kitchen knife from behind and cut it at the "glasses", which were injured.

Then both sides blacked out. The confrontation lasted two minutes. There were four people with knives, and the other two threw sofas, ashtrays and other items at the "bald heads", and even the trash can became a weapon in their hands.

After the "bald head" and others were forcibly driven out of the house, some people threw chairs and other items into the house and tried to enter the house through the back door of the office, but the back door was blocked by two safes and sofas.

Jiang, who was hiding under the table at that time, recalled that the newcomer spoke like a northern Jiangsu accent and she couldn't understand it. During the whole fight, both sides were shouting, and something hard hit the ground and made a loud noise.

12: 48 or so, "Bald" and others ran down one after another, and four cars drove away in the opposite direction.

12: 48: 33, Jiang got out from under the table and immediately called the police and called the boss. She told Xu that something had happened.

The reporter learned that Xu Jianzhong had a debt dispute with the other party. On the morning of April 2, He Qiang negotiated with the other party on behalf of Xu Jianzhong, and received a phone call with the suffix "7777" at noon. The other party said, "You wait, I'll come." He Qiang was worried about an accident, so he telephoned John Zhang and other five Hunan villagers to the company and prepared a kitchen knife for self-defense.

Question: The man who came to the door with a knife was arrested after half a year.

A week after the incident, He Qiang, John Zhang and other six people were detained in criminal detention. At the same time, no one on the "bald" side was detained.

He Qiang and other family members questioned this and posted videos and other materials on the Internet, titled "Six wage earners in Hunan were attacked in Changshu. Why did all the self-defense players enter the classroom?" Related posts immediately attracted network attention, and "Chopper Team' VS' Chopper Team" became a hot online search word for a time.

Well-known netizen Zhang Hongfeng (Weibo) posted a Weibo on September 26th, which has been forwarded nearly 12000 times. In Weibo, he said: Six wage earners stood up in the office in the face of many people who came to make trouble and cut people with knives. After calling the police, they used stools and kitchen knives to defend themselves and even fled. So far, the police haven't arrested any troublemakers, but they have sentenced the wage earners to gather for a fight. Su Jinlin, the mother of He Qiang, said that the police did not detain anyone who came to the door with a knife. "In a legal society, it really hurts me."

10 10 13, the reporter learned from Changshu bureau that the name of "bald head" was Zeng. 1June 10 to June 12, the police arrested seven suspects, including Zeng, Zhu and Hu, who came to the door with a knife. The police are chasing three other suspects online.

Is there any doubt about why six people, including He Qiang, were detained one week after the incident, while the "bald head" was detained six months later? The police believe that they have not given up the investigation of the case and the pursuit of the relevant suspects. "The authorities have been investigating and collecting evidence to ensure that the evidence is conclusive and can withstand scrutiny."

Controversy:

Self-defense? Gather people to fight.

Equally controversial is the judgment of this case. On August 9, Changshu People's Court sentenced He Qiang and other five people to three years' imprisonment for "gathering people to fight", among which Li Yifu was treated as a minor. The court held that He Qiang clearly knew that the other party was coming to make trouble, gathered five people himself, and prepared kitchen knives, sticks and other equipment to wait for the other party to arrive. Legally speaking, it is a crime preparation, subjectively, it is intentional. After the other party came, after the other party punched him, He Qiang immediately took out a kitchen knife and fought back. Objectively speaking, there was a fight, which belonged to armed gathering.

Family members and lawyers of He Qiang and others believe that the actions of He Qiang and others are aimed at preventing the injured from fighting back and belong to legitimate defense. He Qiang's lawyer, Subei Feng, said that the case would not have happened if Zeng and others had not come to the door to make trouble, or had not put a knife around his neck and personally attacked He Qiang.

Zhou Ze, a famous lawyer, and Wu Danhong, an associate professor at China University of Political Science and Law, both think that the actions of He Qiang and others belong to self-defense.

"affray is a deliberate fight between the two sides. The result is disorder. In this case, He Qiang's party is subjectively only for defense and has no intention of fighting with the other party. " Zhou Ze analyzed that He Qiang and others prepare knives, not to fight with each other, but to defend when the other party infringes, which is actually a defense preparation; When attacked by Zeng and others, the countermeasures taken by He Qiang and others were mainly to stop each other's illegal behavior, not to fight with each other. In this sense, the actions of He Qiang and others are completely self-defense measures. The court's judgment of "gathering people to fight" was improper. Moreover, compared with more than 20 people from Zeng's side who went to the door to commit illegal infringement, He Qiang's side caused minor injuries to the other side and was too defensive.

Lawyer Zhou Ze also disagreed with the statement of "active confrontation" put forward by the procuratorate. The preparation made by He Qiang and others is a defensive preparation behavior, not a meeting behavior of gathering people to fight. "If the other party doesn't attack, he can't attack each other. If he knows that the other party is coming, it is a confrontation to ambush on the road. " In addition, Zeng and others should bear the responsibility. "There is no problem in defining the crime of gathering people to disturb social order."

According to a staff member of Changshu Court, Suzhou Intermediate People's Court will conduct a second trial of this case in the near future.
