Article 37 of the Land Management Law of the People's Republic of China prohibits any unit or individual from idle and barren cultivated land. If the non-agricultural construction that has gone through the examination and approval procedures and can be cultivated and harvested within one year occupies cultivated land, it shall be recovered by the collective or individual who originally cultivated the cultivated land, or it may be recovered by the land-using unit; If construction has not started for more than one year, idle fees shall be paid in accordance with the provisions of provinces, autonomous regions and municipalities directly under the Central Government; If it has not been used for two consecutive years, with the approval of the original approval authority, the people's government at or above the county level shall recover the land use right of the land-using unit without compensation; Land originally owned by farmers' collectives shall be handed over to the former rural collective economic organizations to resume farming.
Agriculture, animal husbandry and land bureau should do the following work:
First, actively organize the reclamation of existing abandoned sloping farmland. If the sloping farmland has been abandoned, but the contractor operates at home or nearby, mobilize him to resume farming; If the contractor has gone out to work and do business with his whole family, the sloping farmland will be abandoned and the land will be transferred to farming by large growers; For a long time, the original contractor's whole family went out, and the contracted land was cultivated by other farmers or collective economic organizations. The ownership of the contracted operation remained unchanged, and the proceeds belonged to the cultivators. We will actively coordinate the rural financial sector to provide small loans to the abandoned land that has no funds to buy seeds, fertilizers and other means of production because of family poverty, or that cannot be cultivated because of insufficient labor force, and coordinate and organize the existing labor force to help re-cultivate. The second is to innovate the way of land transfer and promote large-scale operation. Popularize the existing experience and explore new methods, so that farmers who don't want to plant or can't plant can "retire" from the land, and agricultural business entities with the ability and funds can plant on the "retired" land. Establish and improve the land transfer service system, build an information platform for both land supply and demand, and standardize the signing of transfer contracts; Explore the formulation of land transfer implementation methods, guide grassroots practice, set up land transfer guidance and coordination institutions, standardize land transfer behavior, resolve land disputes, and safeguard farmers' rights and interests. Third, continue to promote the conversion of farmland to forests and prevent sloping farmland from being abandoned. It is necessary to correctly handle the relationship between abandoned land and returning farmland to forest, scientifically plan scattered, scattered, remote and barren cultivated land that cannot be transferred, implement returning farmland to forest (grass), encourage and guide farmers to make rational use of abandoned land, which not only improves the ecological environment, but also increases farmers' income. The fourth is to implement the responsibility of farmland supervision and restrain the behavior of farmland abandonment. Land departments should conduct in-depth investigation and study on the problem of abandoned farmland, fully grasp the current situation of abandoned farmland, deeply analyze the reasons for abandoned farmland, actively take targeted measures, issue policy documents to solve the problem of abandoned farmland, and restrain the people's behavior of abandoned farmland.
