1. Signing period with the landlord:
The longer you sign a contract with the landlord, the better! The contract law stipulates that the lease term shall not exceed 20 years. More than twenty years, the excess is invalid. So it's best to sign 19 years and 364 days.
If you plan to be a low-end homestay, the minimum signing period is 3 years;
If you plan to be a high-end homestay, the minimum signing period is 6 years;
At present, the shortest contract period is 8 years, and it is not a house with good comprehensive conditions such as residential environment, apartment type, orientation and floor. Basically, only 10 year contracts are signed.
Remember the signing period, signing a contract for five years is better than renewing two contracts for three years; Signing a contract for six years is better than renewing it for two years; It is better to sign for eight years than to renew for two five years.
2. Conditions for increasing the rent:
In principle, it is best not to increase it, which is of course impossible. Therefore, it is better to increase a fixed amount than to increase a percentage;
It is better to increase it every two or three years than once a year. This needs to be discussed in detail with the landlord. After negotiation, be sure to write the annual rental amount in the contract or supplementary agreement, remember.
3. Contract rent-free period:
The rent-free period is the same as the signing period. Generally, the first year of renovation can take one month, and then half a month every year. If you can, it is best to spend a month every year in the future.
4. Liability for breach of contract with the landlord:
This is the most important point in the contract except the number of years. First of all, make it clear that you will not default, and only Fang Dongfang may default; Then some people will ask, what should I do with the current epidemic? All contracts have force majeure clauses. If you can't do it this year, you can use this clause to terminate the contract. I believe the landlords will understand.
The liability for breach of contract must be equal to both parties, that is, both parties bear the same responsibility, so that the landlord will not resist. I suggest setting a large amount of liquidated damages according to the signing period, which can be reduced year by year, but it must be higher than the depreciation residual value of house decoration and the liquidated damages paid to tenants.
