Regulations of Huludao Municipality on Funeral Management

Chapter I General Provisions Article 1 In order to strengthen funeral management, promote funeral reform and promote the construction of socialist spiritual civilization and ecological civilization, these Regulations are formulated in accordance with the provisions of the Regulations on Funeral Management of the State Council and relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to funeral activities and their management within the administrative area of this Municipality. Article 3 Funeral activities and their management shall adhere to the principles of cremation, civilization and frugality, environmental protection, resource conservation and convenience for the people. Article 4 The civil affairs department of the people's government of a city or county (city) is the administrative department in charge of funeral management, and its subordinate funeral management institution is responsible for the daily work of funeral management.

Development and reform, housing and urban and rural construction, public security, finance, urban and rural planning, land and resources, environmental protection, forestry, health and family planning, industry and commerce (market supervision), transportation, water conservancy, marine and fishery, culture, radio, film and television, ethnic and religious departments should do a good job in funeral management according to their respective responsibilities.

The township (town) people's government and sub-district offices shall be responsible for the funeral management within their respective jurisdictions. The village (neighborhood) committee and the unit where the deceased belongs shall assist in the funeral management. Article 5 The municipal and county (city) people's governments shall strengthen their leadership over funeral management, establish a linkage and assessment mechanism for funeral management, incorporate the development plan of funeral undertakings into the national economic and social development plan, and improve the basic funeral public service system.

The development plan of funeral business includes the development goal of funeral reform, the layout, scale and quantity of funeral facilities such as funeral parlours, funeral service centers (stations), cemeteries and columbariums, the development and supervision of funeral market, and the formulation and implementation of funeral policies for the benefit of the people. Article 6 The people's governments of cities and counties (cities) shall strengthen the construction of land-saving ecological burial facilities, strengthen the ecological functions of burial facilities, and implement land-saving ecological burial methods.

The term "land-saving ecological burial" as mentioned in these Regulations refers to the burial methods of ashes that consume less resources and use less non-degradable materials, including tree burial, flower burial, lawn burial, sea (river) burial, deep burial, scattered burial and lattice burial.

Use urban marine resources to encourage and support sea burial. Specific measures for the administration of sea burial shall be formulated by the Municipal People's Government. Seventh funeral industry associations should carry out activities in accordance with the articles of association, safeguard the legitimate rights and interests of the industry and its members, play the role of industry self-discipline, improve the service level of the funeral industry, and promote the healthy development of the funeral industry. Eighth newspapers, radio and television, Internet and other media and relevant units should take various forms, actively publicize the funeral reform, advocate people-oriented, ecological civilization, and change customs. Chapter II Planning, Construction and Management of Funeral Facilities Article 9 The Civil Affairs Department of the Municipal People's Government shall, jointly with the departments of development and reform, land and resources, urban and rural planning, environmental protection, forestry, water conservancy, etc., formulate a special plan for the construction of funeral facilities in accordance with the overall urban and rural planning and land use planning of this Municipality, taking into account factors such as population, land, transportation and environment as a whole, and report it to the Municipal People's Government for approval before promulgation and implementation. Article 10 The setting of funeral facilities shall meet other conditions stipulated in the special planning of funeral facilities and laws and regulations of this Municipality, and relevant examination and approval procedures shall be handled according to law. Eleventh prohibit the construction of graves in the following areas:

(1) Cultivated land and forest land;

(two) city parks, scenic spots and cultural relics protection areas;

(3) Near reservoirs, river dams and water source protection areas;

(four) on both sides of the railway and highway trunk lines;

Existing graves in the areas specified in the preceding paragraph shall be preserved, except cemeteries with historical, artistic and scientific value protected by the state, and the civil affairs department shall announce that they shall be moved or buried within a time limit, and no tombstones shall be left behind. Twelfth cemeteries include public welfare cemeteries and operating cemeteries.

Public cemetery refers to a non-profit cemetery that provides services for urban and rural residents to bury their ashes; Operating cemetery refers to a public welfare cemetery that provides paid services for residents to bury their ashes.

It is forbidden to change a public cemetery into a business cemetery without authorization. Thirteenth cemetery business units to collect a one-time tomb management and maintenance fees for a period of not more than twenty years. Before the payment period expires/within 0/80 days of kloc-,the cemetery business unit shall inform the user in a way that can be checked afterwards, and if the user needs to keep the tomb, he shall go through the formalities of renewal. If it is not paid within three months, and there is no contract, it will be handled by land-saving ecological burial. Article 14 The area of new graves in cemeteries shall not exceed 1 m2, and the height of tombstones and pedestals from the ground shall not exceed1.2m.. The number of land-saving ecological burial graves in the new cemetery area of the operating cemetery shall not be less than 40% of the total number of graves; The number of land-saving ecological burial graves in newly-built cemeteries of public welfare cemeteries shall not be less than 50% of the total number of graves.

The price of graves in public welfare cemeteries is set by the government, and free burial areas are set up to ensure the burial needs of eligible groups.

The civil affairs department of the county (city) District People's Government shall delimit the service area of rural public cemetery, specify the conditions for burial objects, and shall not bury other unqualified personnel. Fifteenth because of the construction need to move the grave, the construction unit in accordance with the relevant laws and regulations and the principle of fairness and justice, put forward the compensation scheme for land acquisition, bear the relocation compensation costs, and deal with it in the following ways:

(a) in the city's major media published a notice of moving the grave and posted a notice of moving the grave in the local area, and the owner of the tomb selected the compensation method for moving the grave to claim and handle it within 60 days;

(II) after the announcement period unclaimed or did not go through the formalities of moving the grave, the construction unit shall draw lots, take photos and record the number before burial, the buried remains shall be cremated, and the ashes shall be stored in the funeral service unit; After two years, it is still unclaimed or has not gone through the formalities. After the announcement by the civil affairs department, it will be buried in a land-saving and ecological way.
