3. Improve the requirements for car owners and control industry risks.

In order to protect the legitimate rights and interests of drivers and control market risks, firstly, raise the threshold and conditions for Article 15 enterprises as legal persons to enter the online car service industry; Two, increase the fourteenth item (eight). 4. Increase the conditions for the network car to exit the business.

5. Improve the driver qualification management.

First, delete the provisions on household registration and residence permit requirements in the implementation rules and break unnecessary household registration restrictions. The second is to refine the requirements of motor vehicle driver's license for quasi-driving vehicles, and clearly require motor vehicle driver's license C 1 and above. The third is to increase the platform's requirements for driver registration, and the driver of the network car may not register repeatedly on the same network service platform.

7. Strengthen the main responsibility of enterprises and strengthen industry supervision.

Article 2 (Scope of Application)? These Rules shall apply to the business service and management of online booking of taxis (hereinafter referred to as online booking) within the administrative area of this Municipality.

The term "online car rental service" as mentioned in these Rules refers to the business activities of building a service platform based on Internet technology, integrating supply and demand information, using qualified vehicles and drivers, and providing non-cruise car rental service at the agreed time and place.

The term "network car operator" as mentioned in these Rules refers to an enterprise legal person who builds a network service platform and engages in network car management services.

Article 3 (development principle)? Adhere to giving priority to the development of public transport, moderately develop taxis, and orderly develop online car rentals in accordance with the principles of quality service and differentiated management.

The freight rate of this city's network car is subject to market adjustment.

Article 4 (Management Department)? The municipal transportation department is the administrative department in charge of the city's network car, and is responsible for the specific implementation of the city's network car management and supervision.

Development and reform, public security, commerce, people's bank of China, taxation, market supervision and other departments shall, in accordance with their statutory duties, implement relevant supervision and management of online car rental business activities.

Chapter two? Network car operator

Article 5 (License of Operators)? Engaged in the operation of online car rental, it shall obtain the "Network Appointment Taxi Business License" according to law.

Article 6 (Conditions for Operators)? To apply for online carpooling, the applicant shall have online and offline service capabilities and meet the following conditions:

(1) Having the qualification of an enterprise as a legal person, in which a foreign enterprise as a legal person shall set up a branch in this Municipality;

(2) It has the Internet platform to carry out online car sharing business and the interactive processing capability of information and data suitable for the business to be carried out, and it has the conditions for relevant regulatory departments such as transportation, public security and taxation to obtain and query relevant network data and information according to law. The database of the network service platform is connected to the supervision platform of the municipal transportation department, and the server is located in the mainland of China, with the network security management system and safety protection technical measures that meet the requirements; ?

(3) Where electronic payment is used, an agreement shall be signed with banks and non-bank payment institutions to provide payment and settlement services;

(four) a sound management system, production safety management system and service quality assurance system;

(six) other conditions stipulated by laws, regulations and rules.

In addition to the above conditions, foreign-invested automobile operation shall also comply with the provisions of relevant laws and regulations on foreign investment.

Article 7 (Application Materials for Business Operators)? Those who apply to engage in online car rental business shall apply to the municipal transportation department and submit materials in accordance with the provisions of Article 6 of the Interim Measures for the Administration of Online Booking Taxi Management Services.

Article 8 (Time limit for acceptance)? The municipal transportation department shall make a decision on whether or not to grant permission within 20 working days from the date of acceptance. If a decision cannot be made within 20 working days, with the approval of the person in charge of the municipal transportation department, 10 working days may be extended, and the applicant shall be informed of the reasons for extending the time limit.

Article 9 (Licensing Procedure)? In line with the operating conditions of the network car, the municipal transportation department shall make a decision to grant the license, clarify the business scope within the jurisdiction of Dongguan City, and issue the "Network Appointment Taxi Business License"; Do not meet the operating conditions of the network car, the municipal transportation department shall issue a "decision not to grant administrative license" to the applicant.

Article 10 (License Validity Period)? The validity period of the network car business license is 5 years, counting from the date when the license decision is made.

30 days before the expiration of the validity period of the license, the licensee may apply to the municipal transportation department for extending the validity period of the license, and the municipal transportation department shall make a decision on whether to grant the extension before the expiration of the validity period.

If the network car operator merges, divides, moves its business premises or changes the name of its business entity, it shall go through the licensing change formalities with the original licensing authority.

Article 11 (Record of Business Operators)? The network car operator shall obtain the "Network Booking Taxi Business License" and apply to the Provincial Communications Department for Internet information service for the record in accordance with the regulations before carrying out related business.

The network car operator shall, within 30 days from the date of formal connection of the network, go through the filing formalities at the acceptance organ designated by the public security organ of the provincial people's government where the management and operation institution of the network car operator is located.

Article 12 (Suspension of business)? If the network car operator suspends or terminates its operation, it shall submit a written report to the municipal transportation department 30 days in advance, explain the relevant situation, notify the vehicle owners and drivers who provide services, and make an announcement to the public. If the network car operator fails to provide the network car service for more than 180 days without justifiable reasons after obtaining the business license, it shall be deemed as automatic termination of operation. If the operation is terminated, the online taxi business license shall be returned to the municipal transportation department within 10 days from the date of termination. If it is not returned within the time limit, the license shall be cancelled by the municipal transportation department.

Chapter three? Network car, vehicle and driver

Article 13 (Vehicle License Plate)? Vehicles engaged in the network car service shall obtain the "Network Booking Taxi Transport Certificate".

Article 14 (Conditions for renting a car online)? A vehicle applying for the Network Booking Taxi Transport Certificate shall meet the following conditions:

(1) Pure electric passenger cars with 7 seats or less registered in this Municipality;

(2) The initial registration date specified in the motor vehicle driving license is less than 2 years from the date of application;

(three) the wheelbase is not less than 2600 mm; Where the state and province have new regulations on vehicle models, such regulations shall prevail;

(4) The vehicle has passed the safety technical inspection by the public security organ;

(five) the installation of vehicle-mounted satellite positioning devices and emergency alarm devices that meet the relevant technical standards and have the function of driving records;

(six) shall not be in violation of the provisions of the spray color similar to the city's parade taxi, and the installation of overhead lights, empty lights and other special facilities and equipment for parade taxi service;

(seven) there is no illegal act in the vehicle;

(8) Having gone through the vehicle driver registration formalities;

(nine) other conditions stipulated by laws, regulations and rules.

Article 15 (Owner's Conditions) An owner who applies for booking a taxi transport license online shall meet the following conditions:

(1) If the owner of the vehicle is an individual, he shall first obtain the driver's license of the cruise taxi or the driver's license of the network car, and the vehicle under his name has not obtained the transportation license of the network car, and promise to drive the applied vehicle to provide the network car service.

(2) If the vehicle owner is an enterprise legal person, there shall be no vehicles and drivers who have not obtained legal qualifications to carry out online car rental service, and the following two conditions shall be met: for the first time, the number of vehicles applied for shall not be less than 100; If the applicant applies again, all the vehicles under his name that have obtained the online booking taxi transport license shall have gone through the driver registration procedures.

Article 16 (Application Materials for Network Car Transportation Permit)? To apply for the "Network Booking Taxi Transport Certificate", the following materials shall be submitted to the municipal transportation department:

(a) the "network booking taxi transport permit" application form;

(2) Motor vehicle driver's license, motor vehicle registration certificate and their photocopies;

(three) the contract or invoice for the installation and configuration of qualified vehicle-mounted satellite positioning devices and emergency alarm devices;

(four) two color photos of the vehicle and the electronic documents of the photos;

(5) If the motor vehicle owner is an enterprise legal person, the identity certificate and photocopy of the agent, business license and photocopy of the enterprise legal person shall be submitted;

(6) If the motor vehicle owner is an individual, the identity certificate of the motor vehicle owner and its copy shall be submitted;

(7) If the vehicle owner entrusts the network car platform company to apply, it shall also submit a power of attorney.

Article 17 (Licensing Procedure)? According to the application of the vehicle owner or the network car operator, the municipal transportation department shall conduct the audit in accordance with the conditions stipulated in Articles 14 and 15 of these Rules. After the examination and approval, the applicant shall go to the municipal public security department to register the nature of the use of reserved taxi vehicles, and the municipal transportation department shall make a decision to grant the license, and issue the Network Appointment Taxi Transport Certificate. If the audit is unqualified, the municipal transportation department shall make a decision not to grant permission and explain the reasons.

Article 18 (License Validity Period)? The validity date of the Online Booking Taxi Transport Certificate is the date of issuing the certificate, and the expiration date is the initial registration date specified in the vehicle driving license, which is extended for 8 years.

Article 19 (Exit of online car service)? In any of the following circumstances, you should quit the online car service:

(a) the online taxi transport certificate expires;

(2) The vehicle owner applies for withdrawing from the online car rental business before the expiration of the online car rental transportation certificate;

(three) after the "Network Booking Taxi Transport Certificate" is processed, the driver who has not been registered for 180 days without justifiable reasons;

(four) the owner of the vehicle is an enterprise, and the business license of the enterprise is revoked, revoked or cancelled;

(five) the owner of the vehicle is an individual, and the individual "Network Taxi Driver's License" is revoked, revoked or cancelled.

If the vehicle related to the network car withdraws from operation or the mileage reaches the mandatory scrapping conditions, the municipal transportation department will cancel its "Network Appointment Taxi Transport Certificate".

Article 20 (Conditions for drivers of online car)? Drivers applying for online car service shall meet the following conditions:

(1) Holding a valid motor vehicle driver's license of C 1 or above and having more than 3 years' driving experience at the time of application;

(2) It has no record of traffic accident crime, dangerous driving crime, drug abuse and drunk driving, and has no record of 12 in three consecutive scoring cycles recently;

(3) No violent criminal record;

(4) There is no record that the taxi driver's qualification certificate has been revoked within 3 years before the date of application;

(five) other conditions stipulated by laws, regulations and rules.

Article 21 (Application Materials for Driving License of Online Car)? To apply for an online taxi driver's license, the following materials shall be submitted:

(a) the taxi driver qualification certificate application form;

(2) ID card, motor vehicle driver's license and their copies;

(3) If the driver entrusts the network car platform company to apply on his behalf, he shall also submit a power of attorney.

The certification materials in Item (2) and Item (3) of Article 20 of these Rules shall be transferred by the municipal transportation department to the municipal public security department for inspection; The certification materials in Item (4) of Article 20 of these Rules shall be verified by the municipal transportation department, and the applicant need not submit written materials.

Article 22 (Issuance of Driving License)? The assessment, issuance and management of online booking taxi driver's license shall be implemented in accordance with the Regulations on the Administration of Taxi Driver's Qualification.

The driver of the network car should apply for qualification registration in accordance with the regulations. Network car drivers are not allowed to register repeatedly on the same network service platform.

Article 23 (validity period of audit)? Apply for "network booking taxi transport certificate" and "network booking taxi driver's card", the applicant shall complete the change of vehicle use nature and apply for qualification examination within 90 days after the approval of the municipal transportation department. If it is not handled within the time limit, it is necessary to re-submit the application.

Chapter four? Business service specification

Article 24 (Responsibility of Operators)? The network car operator shall bear the responsibility of the carrier, ensure the safety of operation and protect the legitimate rights and interests of passengers.

Article 25 (Operator Requirements)? Network car operators shall comply with the following provisions:

(1) Strengthen safety management, implement business and network safety measures, improve safety and risk resistance, improve safe production conditions, and support and cooperate with relevant departments to carry out related work;

(two) to ensure that the vehicles providing services obtain the "network booking taxi transport certificate", to ensure that the vehicles providing services online are consistent with the vehicles actually providing services offline, and to report the relevant information of vehicles to the municipal transportation department; Ensure that vehicles are insured with compulsory insurance and carrier liability insurance, and encourage vehicles to purchase third-party liability insurance and passenger accident insurance; The safety performance is reliable, ensuring that the relevant data of the vehicle-mounted satellite positioning device is directly connected to the supervision platform of the municipal transportation department;

(three) to ensure that the drivers who provide services have legal qualifications, to ensure that the drivers who provide services online are consistent with the drivers who actually provide services offline, and to report the relevant information of drivers to the municipal transportation department;

(four) in accordance with the provisions of relevant laws and regulations, according to the characteristics of working hours, service frequency and so on. Sign a labor contract or agreement with the driver to clarify the rights and obligations of both parties. Conduct pre-job training and daily education on relevant laws and regulations, professional ethics, service standards and safe operation. , safeguard and protect the legitimate rights and interests of drivers;

Fulfill the obligation of risk notification, sign a business risk notification with the driver to ensure reasonable employment;

(6) Truthfully record the information content, user registration information, identity authentication information, order log, online log, online transaction log, vehicle trajectory log and other data released by drivers and car owners on their network service platforms, and make backups, and transmit them to the supervision platform of the municipal transportation department through private network lines to receive the management information fed back by the supervision platform;

(7) Promulgating and determining the taxi pricing method that conforms to the relevant provisions of the state, clarifying the service items and quality commitments, reasonably determining the online car fare, clearly marking the price, providing corresponding taxi invoices to passengers, establishing a service evaluation system and a passenger complaint handling system, and truthfully collecting and recording driver service information;

(eight) provide the driver's name, photo, certificate number, service unit, mobile phone number, service evaluation results, license plate number and other information. When providing online car service;

(nine) shall not interfere with fair competition in the market, and shall not engage in unfair price behaviors such as crowding out competitors or monopolizing the market, operating at a price lower than the cost, disrupting the normal market order, damaging the national interests or the legitimate rights and interests of other operators;

(10) Inform the purpose, manner and scope of collecting and using personal information such as drivers, car owners and passengers in a significant way through its network service platform, and shall not use the aforementioned personal information for other businesses without the explicit consent of the information subject. The collection of personal information of drivers, car owners and passengers shall not exceed the scope necessary for providing online car service. In addition to cooperating with state organs to exercise supervision and inspection rights or criminal investigation rights according to law, personal privacy and sensitive information such as name, contact information, home address, bank account or payment account, geographical location and travel route shall not be provided to any third party. Shall not disclose geographical coordinates, geographical indications and other sensitive information related to national security;

(eleven) comply with the relevant provisions of the national network and information security, the relevant personal information collected and the relevant business data generated shall be stored and used in the mainland of China, and the retention period shall not be less than 2 years, except as otherwise provided by laws and regulations. Do not use its network service platform to publish harmful information prohibited by laws and regulations, and do not provide convenience for enterprises, individuals and other groups and organizations to publish harmful information, and take effective measures to filter and block the spread of harmful information. If it is found that others use their network service platform to spread harmful information, they should immediately stop spreading it, keep relevant records and report to the relevant state organs. Provide necessary technical support and assistance such as technical interface and decryption for public security departments to carry out national security work, prevent and investigate illegal and criminal activities according to law;

(twelve) when the vehicle is in a passenger state, it shall not release other reservation business information to the driver;

(thirteen) not to report, complain about the quality of their services or make dissatisfied evaluation of their services to take revenge;

(fourteen) other obligations stipulated by laws, regulations and rules.

Article 26 (Driver Requirements)? When providing services, the network car driver shall abide by the following provisions:

(a) access to the network car service platform that has obtained the business license to provide network car service;

(two) comply with the provisions of road traffic safety, civilized driving, courteous service;

(three) to keep the appearance and interior of the vehicle clean;

(four) in accordance with the provisions of the use of relevant operating equipment to carry out services, found that the equipment function failure, damage, should be eliminated after the operation;

(five) when operating, the vehicle carries the "network booking taxi driver's card" and "network booking taxi transport card" and other documents;

(6) Driving on a reasonable route or at the request of passengers, and not abandoning passengers halfway or deliberately detouring;

(seven) the vehicle shall not be operated by personnel who have not obtained legal qualifications, and the personal network car shall not be operated by others;

(8) It is not allowed to carry passengers by other means than online booking, not to parade and attract passengers, and not to enter the special waiting channel for parade taxis to wait for passengers and attract passengers;

(nine) shall not undertake other booking business when carrying passengers;

(10) If passengers are found to have lost items, they should take the initiative to remind them and return them. If it cannot be returned, it shall promptly contact the network car operator or hand it over to the relevant department for handling;

(eleven) not to report, complain about the quality of their services or make dissatisfied evaluation of their services to take revenge;

(twelve) to collect fees in accordance with the agreement, and shall not collect fees in violation of the provisions;

(thirteen) without the consent of the passengers, no other passengers shall be carried;

(fourteen) other obligations stipulated by laws, regulations and rules.

Article 27 (Passenger Requirements)? Passengers shall comply with the following provisions:

(a) shall not put forward to the driver does not meet the requirements of road traffic safety regulations;

(2) Do not carry articles prohibited by laws and regulations, such as control devices, inflammable, toxic, radioactive, corrosive and other dangerous goods;

(three) pay the fare in accordance with the agreed standards and methods;

(4) Smoking, spitting, littering and damage to facilities and equipment are not allowed in the car;

(5) Consciously fulfill the electronic agreement reached with the network car operator.

If the passenger violates the provisions of the preceding paragraph, the driver of the online car can refuse or terminate the service.

Article 28 (Business Scope)? The network car should engage in business activities within the licensed business area. Beyond the licensed business area, one end of the starting point should be within the licensed business area.

Article 29 (Service Standards)? Network car operators and drivers shall provide services in accordance with the relevant national, provincial and municipal operational service standards.

Article 30 (Legal Operation)? No unit or individual may provide information docking to vehicles and drivers who have not obtained legal qualifications to carry out network car service.

No unit or individual may provide a network car to drivers who have not obtained legal qualifications; Do not provide others with vehicles that have not obtained legal qualifications to carry out network car business services.

No unit or individual may provide operational services through the network service platform that has not obtained the business license of the network car.

Chapter five? Supervision and inspection

Article 31 (Supervisory Authority)? The municipal transportation department shall strengthen the supervision and management of online car service, make full use of information such as passenger evaluation and government supervision, regularly organize the evaluation of online car service quality and publish the results.

Article 32 (Handling of Complaints)? Network car operators shall promptly handle passenger complaints, after accepting passenger complaints, handle and reply according to the service quality commitment, complaint acceptance channels and complaint settlement time limit, establish complaint handling files, and accept the supervision and inspection of the municipal transportation department.

Passengers who are dissatisfied with the reply of the network car operator or have not received a reply can complain to the municipal transportation department, which shall handle it within 15 working days and reply to the complainant; If it is necessary to extend the processing time due to special circumstances, it may be extended by 15 working days with the approval of the person in charge of the municipal transportation department.

The network car operator shall cooperate with the investigation and handling of complaints and submit the necessary complaint handling materials.

Article 33 (Data Retrieval)? The municipal transportation department has the right to collect and consult relevant data and information such as vehicle registration, driver registration, operation and transaction of automobile operators within its jurisdiction according to management needs.

Article 34 (Administrative Supervision of Departments)? Development and reform, public security, commerce, people's bank of China, taxation, market supervision and other departments shall, according to their respective responsibilities, conduct relevant supervision and inspection on online carpooling business activities and deal with illegal acts according to law.

Article 35 (Industry Self-discipline)? City taxi industry association shall establish a list system of bad records of network car operators and drivers, and strengthen industry self-discipline.

Chapter six? Legal liability

Article 36 (Investigation of Illegal Business Operation)? Those who engage in or engage in online taxi booking business activities without obtaining a business license, forge, alter or use forged, altered or invalid Online Taxi Transport Certificate and Online Taxi Driver's Certificate shall be investigated and dealt with in accordance with the relevant provisions of the Interim Measures for the Administration of Online Taxi Booking Services.

Article 37 (Investigation of Illegal Business Activities)? Network car operators and drivers who violate the Interim Measures for the Administration of Online Booking Taxi Management Services, the Provisions on the Administration of Taxi Drivers' Qualification, the Measures for the Administration of Taxi in Guangdong Province and other laws and regulations shall be investigated and dealt with by the municipal transportation department according to their duties.

Article 38 (Investigation of Price Violations)? If an online car rental operator commits price violations, unfair competition, monopoly and other acts, the municipal development and reform and market supervision department will investigate and deal with them according to the Price Law, the Anti-Unfair Competition Law, the Anti-Monopoly Law, the Provisions on Administrative Penalties for Price Violations, and the Interim Measures for the Administration of Online Car Rental Services.

Article 39 (Investigation of Other Illegal Acts)? Other illegal acts found in the supervision shall be investigated and dealt with by the departments of development and reform, public security, commerce, people's bank, taxation and market supervision according to their respective responsibilities.

Chapter seven? supplementary terms

Article 40 (Provisions on Practice of Qualification Certificates)? Mutual recognition of "Cruise Taxi Driver's License" and "Online Taxi Driver's License" in this city. Drivers can directly drive cruise taxis or book taxis online when the original documents are valid. Where there are new provisions in laws and regulations, those provisions shall prevail.

Article 41 (Scope of Application)? These rules are not applicable to cruise taxis that provide reservation services for passengers through telecommunications, the Internet, etc.

Article 42 (Provisions on Scrapping Online Cars)? When the mileage of the network car reaches 600,000 kilometers, it will be scrapped. When the mileage does not reach 600,000 kilometers, but the service life reaches 8 years, exit the online car service.

Article 43 (Definition of Pure Electric Vehicle)? The term "pure electric passenger cars" as mentioned in these Detailed Rules refers to pure electric passenger cars that conform to the Catalogue of Recommended Models for the Promotion and Application of New Energy Vehicles of the Ministry of Industry and Information Technology and imported pure electric passenger cars licensed by relevant state regulations.
