Regulations of Ningxia Hui Autonomous Region on Surveying and Mapping Management (202 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the administration of surveying and mapping and ensure the development of surveying and mapping, these Regulations are formulated in accordance with the provisions of the Surveying and Mapping Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of the autonomous region. Article 2 Whoever engages in surveying and mapping activities within the administrative area of the autonomous region shall abide by these regulations. Article 3 The competent department of natural resources of the people's government of the autonomous region shall be responsible for the unified supervision and management of surveying and mapping work in the autonomous region.

The competent department of natural resources of the people's governments of cities and counties (cities, districts) divided into districts shall be responsible for the supervision and management of surveying and mapping work within their respective administrative areas, and accept the professional guidance of the competent department of natural resources of the people's governments at higher levels.

Housing and urban construction, civil affairs, transportation, water conservancy and other relevant departments are responsible for the relevant surveying and mapping work of their respective departments in accordance with the division of responsibilities. Article 4 Surveying and mapping activities shall use the national unified surveying and mapping datum and surveying and mapping system, and implement the technical specifications and standards for surveying and mapping stipulated by the state. Fifth units and individuals that have made remarkable achievements in surveying and mapping work and surveying and mapping science and technology research shall be commended and rewarded. Chapter II Administration of Surveying and Mapping Qualification Article 6 An entity applying for surveying and mapping qualification shall meet the following conditions:

(1) Having the qualification of a legal person;

(two) there are professional and technical personnel to adapt to their surveying and mapping activities;

(3) Having technical equipment and facilities suitable for its surveying and mapping activities;

(four) a sound technology, quality assurance system and safety measures, information security management system and surveying and mapping results and data file management system. Seventh units engaged in surveying and mapping activities within the administrative area of the autonomous region shall obtain the corresponding "Surveying and mapping qualification certificate"; Professional and technical personnel engaged in surveying and mapping work shall obtain surveying and mapping work certificates of surveying and mapping personnel.

Surveying and mapping units that have obtained surveying and mapping qualification certificates shall engage in surveying and mapping activities within the approved surveying and mapping business scope, operation area and operation limit.

Surveying and mapping units outside the autonomous region engaged in surveying and mapping activities within the administrative area of the autonomous region shall, before the start of surveying and mapping activities, report to the competent department of natural resources of the autonomous region or the Municipal People's government for the record with a valid "Surveying and Mapping Qualification Certificate" and the surveying and mapping operation certificate of the surveying and mapping personnel.

No unit or individual may alter, lend, transfer or lease the qualification certificate of surveying and mapping and the certificate of surveying and mapping operation. Article 8 The competent department of natural resources of the people's government of the autonomous region shall be responsible for examining and approving the qualification of surveying and mapping within the scope of statutory duties, and issue the "Qualification Certificate of Surveying and Mapping". Ninth "Surveying and mapping qualification certificate" is valid for five years. Three months before the expiration of the validity period, the holder shall apply to the competent department of natural resources of the people's Government of the autonomous region for replacement. Tenth major changes have taken place in the main technical force, instruments and equipment of surveying and mapping units, and it is necessary to change the qualification level or business scope of surveying and mapping, and it shall report to the competent department of natural resources of the people's Government of the autonomous region, and go through the formalities for surveying and mapping qualification examination again. If the legal representative or the person in charge of the unit changes, it shall timely file with the department that issued the qualification certificate of Surveying and mapping. Eleventh the competent department of natural resources issued the "Surveying and mapping qualification certificate" and the certificate of surveying and mapping operation, must open the application procedures, the form and content of the application materials. Chapter III Basic Surveying and Mapping and Geographic Information Management Article 12 The competent department of natural resources of the people's government of the autonomous region shall, jointly with the development and reform department, work out the basic surveying and mapping plan of the whole region, and organize its implementation after being submitted to the people's government of the autonomous region for approval.

The competent department of natural resources of the people's governments of cities and counties (cities, districts) shall, jointly with the relevant departments at the same level, organize the preparation of basic surveying and mapping plans and other major surveying and mapping project plans within their respective administrative areas according to the basic surveying and mapping plans of the state and the people's governments at the next higher level, and organize their implementation after being reported to the people's governments at the same level for approval. Thirteenth people's governments at or above the county level shall incorporate the basic surveying and mapping work within their respective administrative areas into the annual plan for national economic and social development, and incorporate the basic surveying and mapping funds into the fiscal budget at the corresponding level.

Specific measures for the management of basic surveying and mapping shall be formulated by the people's government of the autonomous region. Fourteenth basic surveying and mapping results shall be updated regularly in accordance with the following provisions:

(a) the unified layout of Surveying and mapping control network in the whole region, the update cycle is not more than ten years;

(2) The updating period of aerospace remote sensing images, basic geographic information data and series maps of the autonomous region in the whole region shall not exceed five years;

(three) the basic surveying and mapping results urgently needed for economic construction, social development, national defense construction and ecological protection should be updated in time. Fifteenth the establishment of geographic information system, must adopt the basic geographic information data in line with national standards.

The construction units and users of geographic information systems should do a good job in data confidentiality and security. Sixteenth units that use the basic geographic information data of the state and the autonomous region shall not use the basic surveying and mapping data to generate geographic information data without authorization. Article 17 The construction, operation and maintenance of satellite navigation and positioning reference stations shall conform to national standards and requirements and shall not endanger national security.

The construction, operation and maintenance units of satellite navigation and positioning reference stations shall establish a data confidentiality system and abide by the provisions of confidentiality laws and administrative regulations. Eighteenth the use of aerial photogrammetry for surveying and mapping shall comply with the relevant provisions of the state.
