Measures for the supervision and administration of surveying and mapping quality

Chapter I General Provisions

Article 1 In order to strengthen the supervision and management of surveying and mapping quality, ensure the quality of surveying and mapping products, and safeguard the legitimate rights and interests of users and surveying and mapping units, these Measures are formulated in accordance with the Surveying and Mapping Law of People's Republic of China (PRC), the Product Quality Law of People's Republic of China (PRC) and relevant national laws and regulations.

Second surveying and mapping units engaged in surveying and mapping production and business activities, surveying and mapping and providing all kinds of surveying and mapping products, must abide by these measures.

Surveying and mapping products as mentioned in these Measures refer to analog or digital surveying and mapping results measured and provided by different forms of information carriers. Its professional scope includes: geodesy, photogrammetry and remote sensing, engineering survey, administrative boundary mapping, cadastral mapping and real estate mapping, marine mapping, map compilation and map printing, geographic information system engineering, etc.

Article 3 The competent departments of surveying and mapping and the administrative departments of technical supervision of the people's governments at or above the county level shall be responsible for the management and supervision of surveying and mapping quality within their respective administrative areas.

Article 4 Surveying and mapping and providing surveying and mapping products must abide by the relevant laws and regulations of the state, follow the principle of quality first and serve users, and ensure the provision of qualified surveying and mapping products. It is forbidden to forge and fake and shoddy surveying and mapping products; Shall not harm the national interests, social public interests and the legitimate rights and interests of others.

Article 5 Surveying and mapping units are encouraged to adopt advanced surveying and mapping science and technology, implement scientific quality management methods, and establish a quality system with the characteristics of surveying and mapping work according to internationally accepted quality management standards.

Article 6 The competent departments of surveying and mapping of the people's governments at or above the provincial level shall commend and reward the units and individuals with advanced surveying and mapping quality management and excellent surveying and mapping products.

Chapter II Responsibilities and Obligations of Surveying and Mapping Units

Article 7 Surveying and mapping units shall be responsible for the quality of surveying and mapping products they provide.

Eighth surveying and mapping products must implement national standards and industry standards; If users have special needs, supplementary provisions must be made in the surveying and mapping contract and implemented according to the agreed standards.

The surveying and mapping measuring instruments used must be verified or calibrated in accordance with relevant measurement laws, regulations and rules, and the imported and purchased surveying and mapping measuring instruments shall comply with the provisions of measurement laws and regulations.

Article 9 Surveying and mapping units shall abide by the technical regulations for surveying and mapping production, and have the right to refuse unreasonable demands put forward by users that violate the relevant provisions of the state, and have the right to put forward the necessary working conditions, reasonable construction period and reasonable price to ensure the quality of surveying and mapping.

Tenth surveying and mapping products must be inspected and accepted, and only those with qualified quality can be provided for use. Inspection and acceptance and quality evaluation, the implementation of the "Surveying and mapping products inspection and acceptance regulations" and "Surveying and mapping products quality evaluation standards".

Eleventh surveying and mapping units must accept the quality supervision and management of the competent department of Surveying and mapping and the administrative department of technical supervision, and provide inspection samples to the quality supervision and inspection institutions of surveying and mapping products free of charge according to the needs of supervision and inspection.

Those who refuse to accept supervision and inspection shall be treated as "unqualified batches".

After supervision and inspection, the product quality is judged as "unqualified", and the surveying and mapping unit may apply to the administrative department of technical supervision or the competent department of surveying and mapping for re-inspection.

Twelfth according to the principle of voluntariness, surveying and mapping units can apply for quality system certification to the certification body authorized by the administrative department of technical supervision of the State Council.

Chapter III Quality Supervision of Surveying and Mapping Products

Thirteenth the State Council Surveying and mapping administrative departments to establish a "Surveying and mapping product quality supervision, inspection and testing center" (hereinafter referred to as the quality inspection center); The competent surveying and mapping departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall set up "Surveying and mapping product quality supervision and inspection stations" (hereinafter referred to as quality inspection stations) to be responsible for the quality supervision and inspection of surveying and mapping products.

Quality inspection centers and stations shall pass the examination by the administrative department of technical supervision of the people's governments at or above the provincial level.

The quality inspection station is under the technical guidance of the quality inspection center.

Fourteenth quality inspection centers and quality inspection stations are mainly responsible for:

(a) to undertake quality supervision and inspection according to the quality supervision and inspection plan of surveying and mapping products issued by the competent department of surveying and mapping or the administrative department of technical supervision.

(two) in the work of surveying and mapping qualification certification and annual inspection, to undertake the supervision, quality management evaluation and product quality inspection of the implementation of relevant surveying and mapping standards.

(three) entrusted by users to undertake technical consultation and product quality inspection and acceptance of surveying and mapping project contracts.

(four) according to the scope of authorization, to undertake the quality appraisal, testing and inspection of relevant scientific research projects and new products.

(five) to undertake the arbitration and inspection of quality disputes of surveying and mapping products.

(six) regularly submit the quality analysis report of surveying and mapping products to the competent department of surveying and mapping and the administrative department of technical supervision.

Fifteenth surveying and mapping product quality inspection personnel shall pass the qualification examination. Only those who meet the qualified standards and obtain the certificate of quality inspector of surveying and mapping products can engage in the quality inspection of surveying and mapping products.

Sixteenth the main way of quality supervision and inspection of surveying and mapping products is sampling inspection, and its working procedures and inspection methods are implemented in accordance with the Measures for the Administration of Quality Supervision and Inspection of Surveying and Mapping Products.

The quality supervision and inspection results of surveying and mapping products should be judged as "batch qualified" and "batch unqualified".

No unit or individual may interfere with the independent judgment of the quality inspection center or station on the results of supervision and inspection.

Seventeenth competent departments of Surveying and mapping of the people's governments at or above the county level shall take the implementation of surveying and mapping standards, instrument metrological verification, quality management and product quality supervision and inspection results as an important basis for surveying and mapping qualification certification and annual inspection.

Eighteenth surveying and mapping product quality supervision and inspection plan, prepared by the competent department of Surveying and mapping of the people's government at or above the provincial level, submitted to the administrative department of technical supervision of the people's government at the same level for approval.

Surveying and mapping product quality supervision and inspection fees according to the relevant provisions of the state.

Nineteenth surveying and mapping product quality supervision and inspection results, after the approval of the competent department of Surveying and mapping or the administrative department of technical supervision, shall be announced to the public. Provincial supervision and inspection results, reported to the administrative department of Surveying and mapping in the State Council for the record.

Twentieth users have the right to inquire about the quality of surveying and mapping products from surveying and mapping units; Complaints to the competent department of Surveying and mapping or the administrative department of technical supervision shall be handled by the relevant departments.

Twenty-first disputes arising from the quality of surveying and mapping products, the parties can be resolved through consultation or mediation, can also apply to an arbitration institution for arbitration; If the parties fail to reach an arbitration agreement, they may bring a lawsuit to the people's court.

The arbitration institution or the people's court may entrust the quality inspection center or station specified in Article 13 of these Measures to conduct arbitration inspection on the quality of surveying and mapping products.

Chapter IV Legal Responsibilities and Responsibilities

Twenty-second the quality of surveying and mapping products provided is unqualified, and the surveying and mapping units must correct or re-measure in time; If losses are caused to users, they shall be liable for compensation, and at the same time, the competent department of surveying and mapping shall give informed criticism.

Twenty-third surveying and mapping products quality supervision and re inspection is still judged as "unqualified batch", by the competent department of Surveying and mapping of the people's government at or above the provincial level in consultation with the relevant technical supervision administrative departments to give informed criticism, and urge it to make corrections within a time limit; If the problem is serious, the competent department of surveying and mapping of the people's government at or above the provincial level shall reduce the level of its surveying and mapping qualification certificate in accordance with the "Regulations on the Administration of Surveying and Mapping Qualification Examination and Certification" until the surveying and mapping qualification certificate is revoked.

Twenty-fourth shoddy, forged results, fake and shoddy, by the administrative department of technical supervision shall be given economic punishment; The competent department of Surveying and mapping may revoke its "Surveying and mapping qualification certificate"; If losses are caused to users, surveying and mapping units must also be liable for compensation; If the case constitutes a crime, the person directly responsible shall be investigated for criminal responsibility according to law.

Twenty-fifth surveying and mapping product quality inspection personnel dereliction of duty, according to the seriousness of the case, be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-sixth if a party refuses to accept the decision on administrative punishment, it may, within fifteen days from the date of receiving the notice of punishment, apply for reconsideration to the organ at the next higher level that made the decision on punishment; If you are not satisfied with the reconsideration decision, you can bring a lawsuit to the people's court within 15 days from the date of receiving the reconsideration decision. The parties may also bring a suit directly to the people's court within 15 days from the date of receiving the penalty notice. If it fails to apply for reconsideration or bring a suit in a people's court within the time limit and refuses to implement the punishment decision, the administrative department that made the punishment decision shall apply to the people's court for compulsory execution.

Chapter V Supplementary Provisions

Article 27 These Measures shall be interpreted by the State Bureau of Surveying and Mapping and the State Bureau of Technical Supervision.

Twenty-eighth provinces, autonomous regions and municipalities directly under the central government, the competent department of Surveying and mapping in conjunction with the administrative department of technical supervision can be based on these measures, combined with the actual situation in the region, to develop implementation measures.

Article 29 These Measures shall come into force as of the date of promulgation.
