Chapter 1 General Provisions Article 1 In order to strengthen funeral management, promote funeral reform, and promote the construction of socialist spiritual civilization and ecological civilization, in accordance with the "Funeral Management Regulations" of the State Council and other relevant laws and regulations, combined with the actual situation of this city , formulate these regulations. Article 2 These regulations shall apply to funeral activities and their management within the administrative area of ??this city. Article 3 Funeral activities and management shall adhere to the principles of cremation, economical use of land, environmental protection, civility and frugality. Article 4 The municipal and district (city) and county people's governments shall strengthen leadership over funeral and interment work, incorporate funeral and interment work into national economic and social development plans, and establish and improve guarantee, coordination and assessment mechanisms that are compatible with the development of the funeral and interment industry.

Basic funeral and interment service funds shall be included in financial budget management. Article 5: Municipal and district (city) and county civil affairs departments are responsible for funeral management within their respective administrative areas.

Relevant departments of the municipal and district (city) and county people's governments shall be responsible for work related to funeral management in accordance with their respective responsibilities.

The agencies dispatched by the Municipal People's Government with administrative functions are responsible for managing the funeral management work in the area according to the authorization. Article 6 Funeral industry organizations should strengthen industry self-discipline, promote industry exchanges, establish service standards, guide fair competition and honest operations, and promote the healthy development of the funeral industry. Article 7: State agencies, people's organizations, enterprises and institutions, grassroots mass autonomous organizations and other social organizations should support and publicize funeral reforms, popularize funeral laws and regulations, and spread the concept of civilized funerals. Chapter 2 Planning, Construction and Management of Funeral Facilities Article 8 The civil affairs department shall, in conjunction with the development and reform, land and housing, planning, environmental protection, forestry and other competent departments, in accordance with the city's urban and rural planning and overall land use plan, combined with population, land, transportation , environmental and other factors, formulate a special plan for the construction of funeral facilities and submit it to the Municipal People's Government for approval before implementation. Article 9 The construction of funeral parlors, cemeteries, columbariums and funeral service stations shall comply with the city’s special plan for the construction of funeral facilities and the conditions stipulated in laws and regulations, and land use, construction and other procedures shall be handled in accordance with the law. Article 10 Funeral parlors shall strengthen the management of funeral service facilities and promptly update and transform facilities and equipment. Exhaust gas emissions from corpse cremation and relic incineration facilities should comply with national air pollutant emission standards. Equipment such as corpse refrigeration cabinets and cremation machines must comply with the technical standards stipulated by the state. Article 11 Cemeteries are divided into commercial cemeteries and public welfare cemeteries.

Cemeteries should plan and construct tombs in accordance with the principle of saving land. The area of ??new tombs (including combined tombs) shall not exceed 1 square meter, and the height of tombstones together with their bases shall not exceed 1.2 meters above the ground.

Cemeteries should establish land-saving and ecological burial areas. Encourage the use of degradable materials to reduce the hardened ground coverage area.

It is prohibited to illegally transfer, rent, buy or sell tombs (grids). Article 12 Cemeteries shall reasonably determine the price of tombs in accordance with the principle of price disclosure and accept the management of the competent price department in accordance with the law.

The price of burial spaces in commercial cemeteries shall be subject to market adjustment, and the prices shall be reported to the civil affairs department of the district (city) or county where they are located for filing.

The price of burial spaces in public welfare cemeteries is set by the government and is determined in accordance with the principle of non-profit taking into account the affordability of urban and rural residents. Article 13 The municipal and district (city) and county people's governments shall encourage and support the construction of public welfare cemeteries and ensure the capital investment in public welfare cemeteries.

Encourage enterprises, social organizations and individuals to participate in the construction of public welfare cemeteries through donations, donations, etc. Article 14 The municipal and district (city) and county people's governments shall rationally plan and construct rural public welfare cemeteries in light of rural realities and the needs of convenience for the masses and management of scattered graves. Strengthen the management of existing public welfare cemeteries, standardize the scope of services, clarify operating principles, and ensure the normal operation of rural public welfare cemeteries. Article 15 Barren hills and barren land should be used for the construction of cemeteries, and new cemeteries are prohibited in the following areas:

(1) Cultivated land and forest land;

(2) City parks, scenic spots and cultural relics Protected areas;

(3) Within the scope of reservoir management and protection, within the scope of river management and water source protection areas;

(4) Within 500 meters on both sides of main railways and highways ;

(5) Other areas prohibited by laws and regulations. Article 16 No graves shall be built in places other than cemeteries. For existing scattered graves outside cemeteries, the municipal and district (city) and county people's governments should formulate plans to gradually relocate them, or bury them deeply on the spot without leaving grave heads. Exceptions are scattered graves with historical, artistic and scientific value that are protected by the state.

Encourage scattered graves to be moved to public welfare cemeteries for burial. Article 17 The municipal and district (city) and county people's governments shall strengthen the management of scattered graves that have not yet been relocated within their respective administrative regions, determine the management units for scattered graves, and clarify management responsibilities.

It is not allowed to increase or expand the number and area of ??scattered graves, and it is not allowed to build, expand (renovate) graves or engage in activities of selling tombs in the area where scattered graves are distributed.

Article 18 If graves need to be relocated due to construction, the construction unit shall formulate a relocation compensation plan in accordance with relevant laws, regulations and the principles of fairness and justice, and handle it in the following manner:

(1) If there is a contact person, Notify the relevant contact person directly; if there is no contact person, publish and post the tomb relocation announcement in the city's major media and the location of the tomb, and notify the relevant contact person to claim it within sixty days and go through the relocation procedures;

(2) If there is no one claiming it after the announcement period, the construction unit will draw, take photos and videos, establish files and register for burial, and sign an agreement with funeral parlors, columbariums, cemeteries and other funeral service units to hand over the ashes and files to them for safekeeping;

(3) If the deceased remains unclaimed for more than two years, the storage unit will announce it 60 days later and bury it in a land-saving and ecological manner.

Relocation compensation and other related costs shall be borne by the construction unit. After the implementation of these regulations, illegally newly built tombs and the increased portion of expanded tombs will not be included in the scope of compensation.
