Provisions of Taizhou Municipality on the Safety Management of Residential Rental Housing

(2018 65438+adopted at the 17th meeting of the Standing Committee of the 5th Taizhou Municipal People's Congress on February 26th, and approved at the 11th meeting of the Standing Committee of the 13th Zhejiang Provincial People's Congress on March 28th, 20 19)

Article 1 In order to standardize and strengthen the safety management of residential rental houses, protect the personal and property safety of citizens, legal persons and other organizations, and maintain social order and public safety, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) and the Fire Protection Regulations of Zhejiang Province and other relevant laws and regulations. "Zhejiang Province Housing Safety Management Regulations" and "Zhejiang Province Floating Population Residence Registration Regulations", combined with the actual situation of this Municipality.

Article 2 These Provisions shall apply to the safety management of residential rental houses within the administrative area of this Municipality.

The term "residential rental housing" as mentioned in these Provisions refers to the housing that is used or used for living after being rented, except homestays, hotel rooms and public rental housing.

Article 3 The people's governments of cities and counties (cities, districts) shall be responsible for the safety management of residential rental housing within their respective administrative areas, establish a joint meeting system, strengthen the organization, leadership and comprehensive coordination of the safety management of residential rental housing, urge relevant departments to perform their supervision and management duties according to law, ensure the personnel and funds needed for the safety management of residential rental housing, promote the informatization construction of residential rental housing management, and integrate and enjoy all kinds of information resources.

The management institutions established by the people's governments of cities and counties (cities, districts) in industrial clusters and development zones (industrial parks) shall, in accordance with the duties entrusted by the people's governments at the corresponding levels, do a good job in the safety management of residential rental houses in the management areas.

Article 4 Public security organs shall be responsible for information registration, public security management and fire control supervision and inspection of residential rental houses. Where there are other provisions in laws and regulations on the duties of fire control supervision and inspection of public security organs, such provisions shall prevail.

The fire management department is responsible for the comprehensive supervision and management of fire safety of residential rental houses.

Housing and urban construction management department is responsible for the supervision and management of residential rental housing and housing rental safety.

The electric power management department is responsible for the supervision and management of electricity consumption in residential rental houses.

Other relevant departments shall, in accordance with their respective responsibilities, do a good job in the safety management of residential rental houses.

Article 5 Township (town) people's governments and sub-district offices shall perform the following duties:

(a) improve the safety management mechanism of residential rental housing, and incorporate the safety of residential rental housing into grid management;

(two) to master the basic information of the leased houses, lessors and lessees in this area;

(three) to organize the safety inspection of residential rental houses;

(four) to urge the elimination of residential rental housing security risks;

(five) in violation of the relevant provisions of the safety management of residential rental housing behavior promptly transferred to the relevant departments to deal with according to law;

(six) other duties as prescribed by laws and regulations.

Township (town) people's government, street offices can integrate the offices of relevant administrative departments at the grass-roots level, as well as grid members, various coordinators and other personnel to carry out the safety management of residential rental housing.

Sixth village (neighborhood) committees shall perform the following duties:

(a) to assist in the establishment of a "hotel-style" service management platform for residential rental houses as required, and to implement the person in charge;

(two) to assist in the registration of rental housing in the village and community;

(three) to assist the relevant departments and the township (town) people's government, street offices to carry out safety inspection of residential rental housing, and report the security risks in a timely manner;

(4) Other duties as prescribed by laws and regulations.

Encourage village (neighborhood) committees to organize village (neighborhood) meetings, and incorporate the requirements for the safe use of residential rental houses into village regulations and residents' conventions.

Article 7 Owners' committees, property service enterprises, real estate intermediary service agencies and relevant employers shall assist in the safety management of residential rental houses.

The owners' committee and the realty service enterprise shall dissuade them from violating the relevant provisions on the safety management of residential rental houses in the management area and report to the relevant departments in a timely manner.

Eighth people's governments at all levels and relevant departments should strengthen the publicity of laws and regulations on the safety management of residential rental housing, organize safety education and training, and improve the safety awareness of citizens, legal persons and other organizations.

Ninth any unit or individual has the right to discourage, complain and report violations of the safety management of residential rental housing.

The relevant units that accept complaints and reports shall promptly accept and deal with them according to law, reply to the complaints and informants, and keep the relevant information of the complaints and informants confidential. If the report is verified, the county (city, district) people's government or its designated department may reward it.

Article 10 Both parties to rental houses are encouraged to purchase safety liability insurance, and insurance institutions are encouraged to provide insurance products and services required for the safety management of residential rental houses.

Encourage and support the use of advanced technologies such as big data, Internet of Things and cloud computing to promote the intelligent management of residential rental housing.

Article 11 The lessor shall abide by the following provisions:

(a) to provide rental housing that meets the safety requirements;

(two) to check the identity information of the lessee, and not to rent the house to people without identity documents;

(3) Submitting the information of house lease as required;

(4) Inform the lessee in writing of common fire safety knowledge such as the operation and use of fire control facilities and equipment, and fire safety precautions such as using fire, electricity and gas, parking and charging electric vehicles;

(five) found that there are security risks in the rental housing, timely eliminate or notify the lessee to eliminate;

(six) with the relevant units to implement safety management of residential rental housing;

(seven) found that the lessee is suspected of illegal and criminal acts, timely report to the public security organs, and cooperate with the investigation;

(eight) to receive fire safety education and training;

(nine) other provisions that should be observed according to law.

The fire management department shall make a demonstration text of fire safety common sense and fire safety precautions of residential rental houses for the use of lessors.

Article 12 The lessee shall abide by the following provisions:

(a) truthfully provide identity documents to the lessor;

(two) the lessee is a floating population, in accordance with the provisions of the timely registration of residence;

(3) If the lessee is an overseas person, he shall go to the public security organ for temporary accommodation registration in time;

(four) the safe use of the house, shall not change the structure and function that affect the safety of the house, and shall not use naked fire, electricity and gas facilities in violation of regulations, and shall not park and charge electric vehicles in violation of regulations;

(five) found that there are security risks in residential houses, promptly eliminate or notify the lessor to eliminate;

(six) to cooperate with the relevant units in the inspection of residential rental houses;

(seven) shall not stay without valid identification;

(eight) shall not use the rental housing for illegal and criminal activities and violations of public order and good customs;

(nine) to receive fire safety education and training;

(ten) other provisions that should be observed according to law.

The lessee who operates the sublease business shall also abide by the provisions of Article 11 of these Provisions.

The actual resident of the rented house shall fulfill the obligations of the lessee in these Provisions.

Thirteenth residential rental housing should have basic residential functions, and meet the requirements of building and fire safety. Fire safety shall be implemented in accordance with the Fire Safety Requirements for Residential Rental Houses in Zhejiang Province.

Group renting houses shall also meet the following requirements:

(a) the establishment of management system, determine the management personnel, carry out safety inspection, equipped with manual alarm;

(2) Public walkways and each room should be equipped with independent fire detection alarms;

(three) emergency lighting facilities should be set up in the evacuation passage;

(4) Group renting houses other than commercial houses shall provide unified storage and charging places for electric vehicles, install sockets and devices that automatically cut off power after charging, equip them with necessary fire-fighting facilities and equipment, and use incombustible materials to seal and separate them from other functional areas;

(five) to install video surveillance at the entrance and exit of the house and ensure its normal operation, and the retention period of the collected video image information shall not be less than thirty days.

Fourteenth the following houses shall not be used for residential rental:

(a) identified as dangerous houses;

(2) Basement or semi-basement originally planned for non-residential use;

(three) more than six floors of self-built rooms;

(4) Setting up a place for producing, storing and dealing in inflammable and explosive dangerous goods in the same building;

(five) other houses that do not meet the requirements of building and fire safety and are not allowed to be rented according to laws and regulations.

Fifteenth before the lessor to the township (town) people's government, neighborhood offices or relevant departments to consult whether the rental housing meets the requirements of building and fire safety, the relevant units shall promptly give a reply or provide services at home.

Article 16 The lessor shall, within three working days from the date of renting the house, submit information to the public security organ or the entrusted floating population service management institution in accordance with the requirements and methods stipulated in the Measures for the Administration of Residential House Lease Registration in Zhejiang Province. For villages and communities that have established a "hotel-style" service management platform for residential rental houses, the lessor may submit it to the service management platform and forward it to the registration authority, relevant departments and township (town) people's government or sub-district offices through the service management platform. The public security organ's housing rental registration information and the housing and urban and rural construction management department's housing rental filing information should be shared.

The people's government of a township (town) or the sub-district office shall, within three working days from the date of registration of rental information, assign staff to carry out safety inspection on the rental housing, and inform the lessor and lessee in writing of the regulations they should abide by and the safety requirements of the rental housing at one time. On-site inspectors shall show their work certificates.

The township (town) people's government or the subdistrict office shall, after on-site inspection, inform the lessor in writing at one time if it finds that there are potential safety hazards in the rented house, and urge the relevant departments to make timely rectification or copy the report and deal with it according to law.

Seventeenth city and county (city, district) people's government departments should strengthen the safety inspection of residential rental housing.

Township (town) people's governments and sub-district offices shall check the safety status of residential rental houses at least once every quarter, establish an inspection ledger, and truthfully record the inspection and the disposal of hidden dangers.

The inspector shall, with the consent of the lessee, inspect the room where he lives, and the lessee shall cooperate.

The relevant departments shall deal with the illegal acts found in the safety inspection and the illegal acts copied by the township (town) people's government and street offices in a timely manner and give feedback.

Eighteenth relevant departments and township (town) people's government, street office inspectors found that there are illegal parking of electric vehicles, illegal use of liquefied petroleum gas tanks or electric appliances and other security risks in residential rental housing, it should urge the lessor and lessee to immediately rectify; If the lessor and the lessee do not cooperate, the inspectors shall immediately take measures to eliminate hidden dangers.

Article 19. If there are acts that may cause fire accidents, such as overloading electricity and connecting cables illegally, the power supply enterprise shall stop it in time, and the power management department may make a decision to suspend power supply according to law, and the power supply enterprise shall stop power supply in accordance with the prescribed procedures.

Twentieth residential rental housing is a dangerous house, there are hidden dangers of safety accidents, the city and county (city, district) housing and urban construction management department shall immediately inform the lessor and lessee, urge the evacuation of people in the rental housing, and report to the people's government at the same level. City, county (city, district) people's government shall start the emergency plan according to law, and decide to take other measures such as closing dangerous houses, prohibiting people from entering and laws and regulations according to the actual situation.

Article 21 If it is found that the leased house is under any of the following circumstances, which may cause serious fire threat if it is not eliminated in time, the fire department shall take temporary closure measures for the dangerous parts according to law, and the lessor and lessee shall eliminate the potential safety hazards in time:

(a) the number of evacuation passages and exits is insufficient or seriously blocked, and the conditions for safe evacuation are no longer available;

(two) the use and storage of flammable and explosive dangerous goods in violation of fire safety regulations;

(3) Group renting houses violate the technical standards for fire control and use flammable materials for decoration, which may cause heavy casualties.

Twenty-second acts in violation of these provisions, laws and regulations have legal liability provisions, from its provisions.

Twenty-third lessee in violation of the provisions of Article 12, paragraph 1, item 7, staying without valid identity documents, the public security organ shall order it to make corrections; Refuses to correct, at more than two hundred yuan to five hundred yuan fine.

Twenty-fourth the lessor has one of the following acts, the public security organ shall order it to make corrections; Refuses to correct, at more than two hundred yuan to five hundred yuan fine:

(a) in violation of the provisions of the third paragraph of the second paragraph of article thirteenth, no emergency lighting facilities are set up in the evacuation passage;

(two) in violation of the provisions of the sixteenth paragraph of this Ordinance, the registration information of residential housing lease is not submitted on time.

If the lessor violates the provisions of Item 5, Paragraph 2 of Article 13 of these Provisions, fails to install and run video surveillance as required, or saves information for less than 30 days, the public security organ shall order it to make corrections within a time limit. If it fails to make corrections within the time limit, it shall be fined between 500 yuan and 5,000 yuan.

Twenty-fifth the lessor has one of the following acts, the fire department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than ten thousand yuan but not more than fifty thousand yuan shall be imposed:

(a) in violation of the provisions of the second paragraph of article fourteenth, the basement or semi basement originally planned for non-residential use is changed to residential use;

(two) in violation of the provisions of the third paragraph of article fourteenth of this Ordinance, renting a room with more than six floors of self-built houses in Tian Tong;

(three) in violation of the provisions of the fourth paragraph of article fourteenth, the rental of the same building for the production, storage and operation of flammable and explosive dangerous goods.

Twenty-sixth relevant departments and township (town) people's government, street office staff in the process of inspection and law enforcement should be legal, fair, standardized and civilized, and shall not harm the legitimate rights and interests of the lessor and lessee. Those who abuse their powers, neglect their duties or engage in malpractices for selfish ends in the safety management of residential rental housing shall be punished according to law by the directly responsible person in charge and other directly responsible personnel.

Article 27 The term "self-built houses in Tian Tong" as mentioned in these Provisions refers to houses built by farmers (residents), with staircases located inside houses, stairwells without natural lighting and ventilation, or houses without direct access to the outside.

The term "group rent" as mentioned in these Provisions refers to the residential rental housing of the same suite of commercial housing and other residential rental housing with more than ten beds or more than ten actual residents.

Article 28 These Provisions shall come into force on July 1 day, 2065.
