In the name of people's novel (Beijing Intellectual Property Court heard the novel in public)

Li Xia first-instance prosecution said:

Based on long-term experience in procuratorial work, I began to write the novel Defending Life and Death in June 2008, which was published in Procuratorial Daily from September to June 2000 and Hainan Publishing House from June to June 2000. Zhou's novel in the name of people was published by Beijing Publishing Group. Through comparative analysis, Li Xia found that the novel "in the name of people" plagiarized and plagiarized its book "Defending Life and Death" without giving it a signature, which infringed its copyright.

After hearing the case, the court of first instance held that:

Through concrete comparison, we can see that there are no substantial similarities or similarities between the two novels involved in Li Xia in five aspects, such as the promotion of clues to solve crimes, logical arrangement, role setting, relationship between characters, plot and specific description. Taking in the name of people does not constitute plagiarism of Defending Life and Death, and Li Xia's claim that Zhou and Beijing Publishing Group infringed its copyright cannot be established, so Li Xia's all claims were rejected. Li Xia refused to accept the first-instance judgment and appealed to the Beijing Intellectual Property Court, requesting to cancel the first-instance judgment and change the judgment to support all his claims.

After Beijing Intellectual Property Court accepted the case,

A collegial panel was formed in accordance with the law to hear the case publicly.
