Measures for the Prevention and Control of Environmental Noise Pollution in Zhengzhou City

Chapter I General Provisions Article 1 In order to prevent and control environmental noise pollution, protect and improve the living environment, safeguard human health, and promote economic and social development, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Noise Pollution and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the prevention and control of environmental noise pollution within the administrative area of this Municipality. Article 3 The prevention and control of environmental noise pollution shall follow the principles of overall planning, giving priority to prevention, comprehensive treatment and whoever pollutes shall be responsible.

The people's governments of cities and counties (cities, districts) shall fully consider the impact of noise generated by industrial production, commercial operation and other construction projects on the surrounding living environment, rationally arrange functional areas and construction layout, and prevent and reduce environmental noise pollution. Fourth city and county (city, district) environmental protection administrative departments to implement unified supervision and management of the prevention and control of environmental noise pollution within their jurisdiction.

In the area where the comprehensive law enforcement of urban management is carried out according to law, the administrative law enforcement department of urban management is responsible for investigating and dealing with violations of the provisions on the prevention and control of construction noise and social life noise pollution within its scope of duties.

The traffic administrative department of the public security organ and the traffic and railway departments shall, according to their respective duties, be responsible for the supervision and management of the prevention and control of traffic noise pollution generated by motor vehicles (ships), railway locomotives and other means of transportation.

Development and reform, urban planning, construction, municipal administration, public security, industrial and commercial administration, culture, health, quality and technical supervision and other relevant departments shall, within the scope of their respective duties, do a good job in the supervision and management of noise pollution prevention and control. Fifth community residents' committees, owners' committees and other mass autonomous organizations shall strengthen the coordination of acoustic environment management and neighborhood noise disputes within their respective jurisdictions, and assist people's governments at all levels and relevant administrative departments in the supervision and management of noise pollution prevention and control. Chapter II Supervision and Management of Prevention and Control of Environmental Noise Pollution Article 6 The competent administrative department of environmental protection of the city, county (city) and Shang Jie District shall, jointly with the competent administrative department of urban planning, scientifically delimit the applicable areas of various acoustic environmental quality standards within their respective administrative areas according to the national acoustic environmental quality standards, and organize the implementation after reporting to the people's government at the same level for approval.

If the regional function changes or the scope of the functional area changes, the applicable area of the acoustic environmental quality standard shall be redrawn in accordance with the procedures specified in the preceding paragraph, and it shall be announced in time. Article 7 When determining the planning and site selection of construction projects, the competent department of city planning administration shall reasonably delimit the sound insulation distance between noise-sensitive structures and enterprises, institutions and municipal infrastructure that may produce noise pollution, and put forward corresponding planning and design requirements.

When examining and approving a construction project that may cause noise pollution to the units and residents around the project location, the competent department of city planning administration shall hold a hearing in accordance with the provisions or solicit the opinions of the units and residents around the project location in other appropriate forms. Eighth new construction, renovation and expansion of construction projects that may produce environmental noise pollution, the construction unit shall, in accordance with the provisions of the state on the classified management of environmental protection of construction projects, prepare environmental impact assessment documents and report them to the competent administrative department of environmental protection for approval.

If it is necessary to obtain a business license for construction projects that may produce noise pollution, such as industrial production, processing, maintenance, catering, entertainment, bathing, fitness, etc., an environmental impact assessment document shall be submitted before handling the business license, and it can be carried out only after approval. For construction projects that may cause noise pollution and construction projects that should prepare environmental impact reports, before the environmental impact assessment documents are submitted for approval, the construction unit shall solicit the opinions of the units and residents around the project location.

The competent administrative department of environmental protection may, when examining and approving the environmental impact assessment document, hold a hearing or solicit the opinions of the units and residents around the project location in other appropriate forms. Tenth units and individual industrial and commercial households that produce noise pollution shall, in accordance with the relevant provisions of the state, declare the types, quantities, noise values, pollution prevention measures and other matters of equipment that produce noise pollution to the municipal or county (city) and Shang Jie District environmental protection administrative department. If the declared project needs major changes, it shall go through the change formalities with the competent administrative department of environmental protection in advance 15, and take effective prevention and control measures.

Units and individual industrial and commercial households whose noise emission exceeds the national environmental noise emission standards shall pay the excessive sewage charges in accordance with the relevant provisions. Measures for the collection, management and use of excessive sewage charges shall be implemented in accordance with relevant regulations. Eleventh in accordance with the requirements of environmental impact assessment documents, installation of environmental noise pollution prevention facilities and online automatic monitoring equipment for key pollution sources of noise emission, the installation project should be designed, constructed and put into use at the same time as the main project.

Units and individual industrial and commercial households that produce environmental noise pollution must ensure the normal operation of environmental noise pollution prevention facilities and online automatic monitoring equipment. If it is really necessary to dismantle or leave it idle, an application shall be submitted to the competent administrative department of environmental protection 15 in advance, and it can only be dismantled or left idle after approval. The competent administrative department of environmental protection shall not approve the increase of noise pollution due to the dismantling or idling of environmental noise pollution prevention and control facilities.
