Is my photo copyrighted?

Legal subjectivity:

Photographers enjoy the copyright of their own photos. Authors of photographic works have the right to license others to use their own works and get paid. Licensing others to use their own works, and getting paid by licensing others to use them, must be based on the premise that they own the copyright of the works.

Legal objectivity:

Article 18 of the Copyright Law of People's Republic of China (PRC) A work created by a natural person in order to complete the work task of a legal person or an unincorporated organization is a job work. Except as provided in the second paragraph of this article, the copyright belongs to the author, but the legal person or unincorporated organization has the right to give priority to the use within its business scope. Within two years after the completion of the work, the author shall not permit a third person to use the work in the same way as the work used by the unit without the consent of the unit. Article 9 of the Copyright Law of People's Republic of China (PRC) includes: (1) the author; (2) Other natural persons, legal persons or unincorporated organizations that enjoy copyright according to this Law. Article 19 of the Copyright Law of People's Republic of China (PRC) * * * commissioned works's copyright ownership shall be agreed upon by the client and the trustee through the contract. If the contract is not clearly stipulated or concluded, the copyright belongs to the trustee.
