Regulations on the Administration of Forest and Wildlife Nature Reserve in Wenshan Zhuang and Miao Autonomous Prefecture of Yunnan Province (20 1 1 Revision)

Article 1 In order to strengthen the management of forest and wildlife nature reserves, protect and save rare and endangered biological resources, maintain ecological balance and promote sustainable economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional National Autonomy, the Regulations of People's Republic of China (PRC) National Nature Reserve and other relevant laws and regulations, combined with the actual situation of Autonomous Prefecture. Article 2 The term "forest and wildlife nature reserve" as mentioned in these Regulations refers to the nature reserve established by the state, provinces and prefectures to effectively protect typical forests, sparse forests, shrubs, mosses, swamps and other ecosystems in different natural regions, as well as various rare and endangered wildlife populations and plant resources. Article 3 These Regulations are applicable to the protection and management of the Xiaoqiaogou National Nature Reserve in Xichou County, the five provincial nature reserves in Maguan County, Laojunshan in Malipo County, Gulinqing in Maguan County, Laoshan in Malipo County, Tuoniang River in Funing County and Babao in Guangnan County, and Xiaxingqing National Nature Reserve in Malipo County (hereinafter referred to as the nature reserve). Article 4 Units and individuals engaged in activities in nature reserves shall abide by these regulations. Fifth state and county people's governments should adhere to the principles of overall planning, unified management and rational utilization, strengthen the protection and management of nature reserves, and incorporate them into the national economic and social development plan. Sixth state and county people's governments set up nature reserve management agencies, which are subordinate to the forestry administrative department of the people's government at the same level. Its main responsibilities are:

(a) to publicize and implement the relevant laws, regulations and these regulations;

(two) to formulate the management system and work plan of nature reserves;

(three) to carry out the investigation of wildlife resources in nature reserves and establish archives;

(four) to carry out scientific research work in nature reserves;

(five) the establishment of nature reserve animal and plant epidemic monitoring system and information network;

(six) to regulate the visit and tourism activities in nature reserves;

(seven) to exercise the administrative law enforcement power conferred by these regulations. Article 7 The people's governments at all levels and their relevant functional departments where nature reserves are located shall, according to their respective functions and duties, do a good job in the protection, construction and management of nature reserves. Eighth state and county people's government administrative departments of forestry shall, jointly with relevant departments, formulate the overall planning and implementation plan for the protection, management, development and utilization of nature reserves, and implement it after being approved in accordance with relevant regulations. Article 9 The scope of protection of nature reserves shall be delineated by the people's government at the county level and announced to the public.

The adjustment of the protection scope of nature reserves must be approved by the original examination and approval authority. Without approval, it may not be changed.

The ownership of forest land and trees in nature reserves remains unchanged. Tenth key protected objects of nature reserves:

(1) tropical and subtropical forests, wetlands, karst peak-cluster ecosystems and natural sites;

(2) Species listed in the national list of key protected wild plants, such as Yunnan Taoerqi, Magnolia grandiflora, Yunnan Blue Fruit Tree, Maopo, Cephalotaxus Cephalotaxus, Bole Tree, Tokyo Dipterocarpus, Fadou Guanyin Lotus, Alsophila spinulosa, Acer negundo, Cinnamomum camphora, Magnolia pseudoacacia, etc.

(3) Wild animals listed in the national and provincial key protection lists, such as bee monkeys, bonobos, bear monkeys, langurs, monitor lizards, pythons, rock sheep, macaques, pangolins, black bears, civets and spotted raccoons. Eleventh nature reserves are divided into core areas, buffer areas and experimental areas for protection and management.

(1) No unit or individual may enter the core area without authorization. If it is really necessary for scientific research to enter the core area, an application shall be submitted to the nature reserve management agency and approved by the administrative department with the power of examination and approval;

(II) If it is really necessary to enter the buffer zone due to work, an application and an activity plan shall be submitted to the nature reserve management institution, and experimental activities such as scientific research, teaching practice, specimen collection, artificial propagation of rare and endangered plants, population rejuvenation, and small population tree species regression can be carried out after approval by the administrative department with the power of examination and approval;

(3) With the approval of the competent administrative department with the power of examination and approval, the experimental area can carry out scientific experiments, visits, eco-tourism and the development of forest resources and forest by-products that are conducive to ecological protection. Article 12 Organizations and individuals that have been approved to enter the buffer zone and experimental zone of nature reserves to engage in scientific research, teaching, investigation, visit, geological exploration, specimen collection, photography, film shooting, mountaineering, tourism and other activities shall pay the protection management fee to the nature reserve management agency and submit relevant materials.

Foreigners who need to enter national and provincial nature reserves to engage in related activities shall be handled in accordance with relevant regulations. Thirteenth nature reserves to carry out tourism business activities, its tourist attractions, routes by the nature reserve management agencies audit, and in accordance with the relevant provisions of the people's government at or above the county level forestry administrative departments for approval. Fourteenth units and individuals to carry out business activities in nature reserves, local residents have the priority to participate. Fifteenth state and county people's governments should formulate policies and measures to increase support for the production and life of residents in nature reserves, promote biogas, solar energy, saving firewood and replacing firewood with electricity, and reduce the low-value consumption of forest resources in nature reserves and surrounding areas.
