What charges will Changshu fire suspects be charged with?

On July 2017 16, a fire broke out in Changshu, Jiangsu Province, killing 22 people and injuring 3 others. After police investigation and technical appraisal, it was determined that arson was caused, and the suspect was arrested on the same day.

On July 17, the reporter interviewed Sun Shunfa, a legal expert of Haoda (Sichuan) Law Firm. He believes that Jiang Moumou is most likely to be prosecuted for intentional homicide and arson.

The website of the State Administration of Work Safety reported on July 16 that at 4: 32 on the same day, a fire broke out in Building 74, Caojing District 2, Yushan Town, Changshu City, Suzhou, killing 22 people and slightly injuring 3 others. The fire has been put out.

Official website 17 of Changshu Municipal Government announced that at about 8: 00 on July 6, Changshu Municipal Party Committee and Municipal Government held a news briefing to inform the fire situation of 74 buildings in Caojing District 2 and the aftermath. After investigation and evidence collection by the public security department, the fire building is a two-story brick-concrete structure with attic, with a construction area of about 200 square meters and a fire area of about 200 square meters. At the time of the incident, 29 people lived in the house. After thoroughly cleaning up the scene, 22 people were confirmed dead. All three injured were slightly injured and were not life-threatening. The task force organized the police to conduct a detailed and comprehensive investigation of the fire. Through on-site investigation, interview and technical appraisal, the fire was identified as arson.

Sun Shunfa, director, doctor of law and lawyer of Haoda (Sichuan) Law Firm, believes that according to the report of People's Daily, "the fire building is a two-story brick-concrete group rental house, and it is the staff dormitory rented by the local private restaurant. There were traces of gasoline burning at the scene and the door was locked. As a result, the suspect Jiang Moumou used gasoline to burn while knowing that there was someone in the room. Subjectively, there are obvious intentional homicide and death intentions, and they are suspected of committing intentional homicide.

Secondly, Sun Shunfa introduced that the crime of arson in China's criminal law is one of the specific crimes of endangering public safety, which refers to the act of deliberately setting fire to public and private property and endangering public safety.

"Where the crime of arson and the crime of intentional homicide overlap, the difference lies in whether the arson is to endanger a specific person or an unspecified group, and whether it is enough to endanger the safety of the public." Sun Shunfa said that in the Changshu fire case, although the building set on fire by Jiang was a single-family building, it was very close to the building next door. If the fire is not put out in time, it is likely to burn to the next door, thus endangering the lives of unspecified people next door.

"So, I personally think that even if the suspect only set fire to 25 employees in the May 4th private restaurant, his behavior is likely to endanger public safety and also violate the crime of arson. The prosecution may eventually sue him for intentional homicide and arson. " He said.

The most heinous crime is intentional homicide, and he is indispensable to the death penalty.
