How can party member cadres hold wedding banquets without stepping on the "red line"

There are six criteria to judge whether "weddings, funerals and weddings" belong to "big operations"

What is "major surgery"? CPC Central Commission for Discipline Inspection's website once published an introduction, and some experts gave six basic criteria for judging whether "red and white events" are "major operations": whether to use public funds to do "red and white events"; Second, whether to use public property, such as buses; Third, see whether to use public property, such as the free audience; Fourth, are there any management and service objects among the spectators, whether they have received gifts, especially whether they have taken the opportunity to collect money; Fifth, whether the spectators use public property; Sixth, see if it affects the rest of others and destroys the environment.

Some local disciplinary committees have also issued relevant regulations, requiring all levels to strictly implement the "seven prohibitions": it is strictly forbidden to break through the prescribed scale in disguised form by means of batches and multiple locations; It is strictly forbidden to invite management and service objects and cadres and workers of subordinate units to participate in weddings and funerals in any way, accept gifts from management or service objects, and take the opportunity to collect money; Prohibit the use of public resources such as buses, public property and public funds; It is strictly forbidden to give gifts and cash gifts in the name of the unit; It is strictly forbidden to reimburse expenses in this unit or other units or in disguised form; It is strictly forbidden to affect normal official activities, work order of the unit and normal social order; It is strictly forbidden to engage in vulgar activities and feudal superstitious activities that are detrimental to social morality.

An expert engaged in research in related fields believes that the legal basis for "no major events" comes from "Several Guidelines for Leading Cadres in China * * * party member". Article 8, paragraph 3, clearly stipulates that it is not allowed to engage in such acts as "making a big fuss about weddings, funerals and celebrations, causing adverse effects, or taking the opportunity to collect money".

The Interpretation of Several Guidelines for Leading Cadres in party member of China * * * Party, compiled by the Law Office of the Central Commission for Discipline Inspection, puts forward that the "wedding, funeral and celebration matters" mentioned here include not only weddings and funerals, but also the birthdays of parents, spouses, children, children's going to college, moving to a new house and other matters celebrated with relatives and friends. The so-called "big event" refers to the scale or consumption standard of similar events held by local ordinary people. The so-called "causing adverse effects" refers to causing negative effects among the masses or society and damaging the image of leading cadres in party member. The so-called "taking the opportunity to collect money" refers to accepting material benefits such as gifts, red envelopes and expensive gifts in various names by handling wedding, funeral and festive matters.

Who is not allowed to "do great things"? The Code of Integrity applies to leading cadres in party member at or above the county (department) level and people's organizations and institutions equivalent to the county (department) level. Leaders of state-owned and state-holding enterprises and their branches, such as party member, directly under the authority, county (city, district, banner), party member, head of judicial organs and procuratorial organs, party member, head of township (street), and party member, head of grass-roots stations, should also be handled as such. This can also be regarded as the scope of the object of "prohibiting major events" at the central level.

Whether it is the "Code of Integrity" or the subsequent normative documents such as "Resolutely stop leading cadres from taking advantage of weddings, funerals and celebrations to collect money", the attitude is firm and the requirements are clear. However, considering the differences in customs and habits and the different levels of economic development, there is no specific definition standard for "illegal acts", but the standards are determined by localities according to actual conditions.

According to the local conditions, three specific "operation methods" are generally given.

At present, many places have introduced specific "operational measures" in light of the actual situation, and some areas have also formed a "report-publicity-exposure" mechanism, that is, first report, then put wine on the table, then announce how many tables to be served and who to invite, and finally, the Commission for Discipline Inspection will promptly expose and punish officials who violate the rules through unannounced visits and reports.

Judging from the "declaration" procedure, some places require leading cadres at all levels to declare to their party organizations before organizing weddings, funerals and festive activities, indicating the time, place, scope and number of invited personnel. For example, in Baoji City, Shaanxi Province, if the party and state staff, especially leading cadres, are required to hold a wedding, they should make a written declaration to the organization and personnel department in accordance with the cadre management authority five working days before the wedding, explaining the reasons, time, place, scope of participants, number of banquets and other situations that I think need to be explained to the organization, and promise to abide by relevant disciplinary regulations.

In view of the "exposure" procedure, many places require the discipline inspection and supervision organs to give full play to the accountability function of supervision and discipline, organize and coordinate regular supervision and inspection at all levels, especially at the important time nodes of holding wedding banquets such as major holidays, and focus on making unannounced visits to the work style construction of various localities and units and the wedding, funeral and festive activities organized by leading cadres in party member. Problems found in weddings, funerals and festive activities that are not reported according to regulations, inconsistent with the actual situation and handled in violation of regulations will be dealt with seriously once verified.

As for the specific issues such as how many tables can be placed at party member cadres' wedding banquets, how much gift money can be received, and who to invite, the specific "operation methods" introduced in various places can be roughly divided into three categories:

The first is to limit the number of tables. There are 30 wine lanes in Shijiazhuang and Guiyang, all of which explicitly limit the number of tables for wine, but the number of tables varies from place to place, and most of them are limited to about 20 tables. Hunan also requested in detail that cadres should hold weddings, funerals and weddings, and one party should prohibit banquets for more than 200 people (20 tables), and both sides should jointly prohibit banquets for more than 300 people (30 tables). Lvliang, Shanxi Province has set a standard for each table, and it is forbidden to exceed 1 0,000 yuan, including tobacco and alcohol;

The second is to limit the amount of gift money. For example, in Hechi City, Guangxi Province, people other than relatives attend weddings organized by cadres and workers, and the amount of gifts or gifts of the same value per person shall not exceed 100 yuan. The Interim Provisions on the Wedding, Funeral and Celebration of National Public Officials in Yueyang City, Hunan Province clarifies that the standard of gift money is controlled within the 200 yuan of each person in principle;

The third is to limit the identity of guests. On the basis of local requirements that "officials are not allowed to invite management and service objects at weddings and funerals", more than 20 regions also stipulate that "colleagues" are not allowed to be invited. Altay, Xinjiang stipulates that colleagues, classmates and friends can be present to help, but it is forbidden to be buried with them. Hunan, Hubei and other places have also refined the scope of relatives: immediate relatives, collateral relatives within three generations, and close in-laws.

In addition to reporting to the Commission for Discipline Inspection and limiting the number of tables, some places also stipulate the grades and standards of banquets. In terms of the object of application, many places define the scope as "party and state staff", and some places clearly include retirees, members of rural "two committees" and full-time staff of community neighborhood committees.

How to deal with the disciplinary behavior in party member's weddings, funerals and celebrations?

Article 85 of the newly promulgated "Regulations on Disciplinary Actions of China * * * Production Party" is a disciplinary provision for party member's handling of weddings, funerals and celebrations: whoever uses his authority or position to facilitate the handling of weddings, funerals and celebrations will be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party. In handling weddings, funerals and celebrations, whoever takes the opportunity to collect money or commits other acts that infringe upon the interests of the state, the collective and the people shall be given a heavier or heavier punishment in accordance with the provisions of the preceding paragraph until he is expelled from the party.

According to the website of the Supervision Department of the Central Commission for Discipline Inspection, first of all, this article was revised on the basis of Article 81 of the original Regulations on Disciplinary Actions within the Chinese Production Party. The first paragraph of Article 81 of the original regulations was changed from "taking advantage of his position" to "taking advantage of his position or his influence". It is emphasized that in addition to taking advantage of his position, it is also forbidden to take advantage of his position to handle weddings, funerals and celebrations, so as to reflect the requirements of comprehensively and strictly administering the party. The original paragraph 2 has not been amended.

Secondly, this article provides punishment for three kinds of disciplinary actions in party member's handling of weddings, funerals and celebrations. First, the use of authority or position to influence the handling of weddings, funerals and celebrations has caused adverse effects in society. This kind of behavior, whether it is extravagance or not, whether it is accepting gifts or not, should be dealt with as long as party member takes advantage of his authority or position, such as using the manpower and material resources of the management service object, which causes adverse effects in society. The second is to collect money by organizing weddings, funerals and celebrations. Its main performance is that the actor collects a large amount of gift money in handling wedding, funeral and celebration matters through large-scale or multiple invitations to treat guests. Third, there are other acts that infringe upon the interests of the state, the collective and the people in organizing weddings, funerals and celebrations, such as interfering with or hindering the normal order of production, life, work, business, teaching, scientific research and traffic, or causing casualties or other major accidents, and so on.

It should be pointed out that it is not a ban on traditional folk customs to prohibit party member from taking advantage of his authority or position to organize weddings, funerals and celebrations, or to take the opportunity to collect money or commit other acts that infringe on the interests of the state, the collective and the people. As long as we pay attention to the image of leading cadres in party member, especially in party member, pay attention to the possible adverse effects among the masses, and engage in simple and normal weddings, funerals and celebrations, it will also reflect traditional folk customs.
