According to Article 2 of the Copyright Law of People's Republic of China (PRC), works of China citizens, legal persons or other organizations, whether published or not, enjoy copyright in accordance with this Law. The copyright enjoyed by the works of foreigners and stateless persons in accordance with the agreement signed between the country to which the author belongs or the country of habitual residence and China or the international treaties to which * * * is a party shall be protected by this Law.
Works of foreigners and stateless persons first published in China shall enjoy copyright in accordance with this Law. The relevant requirements for copyright of works stipulate that:
1. If a copyright owner submits a manuscript to a newspaper or periodical agency and fails to receive a notice from the newspaper within 15 days from the date of publication of the manuscript, or fails to receive a notice from the periodical agency within 30 days from the date of publication of the manuscript, he may submit a manuscript to other newspapers or periodical agencies. Unless otherwise agreed by both parties.
2. Publishers, performers, producers of audio and video recordings, radio stations and television stations. The use of another person's work in accordance with the relevant provisions of this law shall not infringe upon the author's right of signature, modification, protection of the integrity of the work and remuneration.
The copyright owner shall deliver the work within the time limit stipulated in the contract. A book publisher shall publish books in accordance with the publication quality and time limit stipulated in the contract. If a book publisher fails to publish within the time limit stipulated in the contract, he shall bear civil liability in accordance with the provisions of Article 54 of this Law.
