Anhui Provincial Cultural Market Management Regulations (Revised in 2006)
Chapter 1 General Provisions Article 1 In order to standardize cultural operations and management behaviors, ensure the health and orderliness of the cultural market, develop cultural industries, prosper cultural undertakings, and promote the construction of socialist spiritual civilization, in accordance with relevant laws and administrative regulations These regulations are formulated based on the actual conditions of the province. Article 2 These Regulations shall apply to the following cultural business activities in the administrative region of this province:
(1) Commercial entertainment;
(2) Commercial performances;
(3) Wholesale, retail and rental of audio and video products;
(4) Operation of Internet access service business premises;
(5) Operation of Internet cultural products;
(6) Fine art management;
(7) Commercial art training, art photography and videography;
(8) Cultural brokerage;
(9) Commercial art exhibitions and literary competitions;
(10) Other cultural business activities that should be managed in accordance with the law.
The wholesale, retail, and rental of books, newspapers, and electronic publications, the distribution and screening of movies, and the operation and management of cultural relics permitted by the state shall be carried out in accordance with relevant laws and regulations. Article 3 Cultural business activities should adhere to the direction of serving the people and socialism, promote the excellent national culture, and enrich the spiritual and cultural life of the people. Article 4 The cultural administrative department of the Provincial People's Government shall formulate an overall plan for the development of the cultural market in the province. The cultural administrative departments of the people's governments at or above the county level shall, in accordance with the overall plan for the development of the cultural market in the province, reasonably arrange the cultural business units in their respective administrative regions in accordance with the law, guide the development of cultural operations in the direction of industrialization and scale, and encourage the development of cultural industries with local characteristics. . Article 5 People's governments at all levels should strengthen rural cultural construction, formulate preferential policies, support and cultivate the development of rural cultural markets, and promote the prosperity of rural cultural markets.
Encourage enterprises, institutions and individuals to carry out cultural business activities in rural areas. Article 6 People's governments at or above the county level shall strengthen leadership over cultural market management and ensure the funds required for cultural market management.
The township (town) people's government should strengthen the supervision and management of cultural business activities within its jurisdiction and give full play to the role of township comprehensive cultural stations. Article 7 The cultural administrative departments of the people's governments at or above the county level are the competent departments for the cultural market in their respective administrative regions and shall supervise and manage cultural business activities. The public security department is responsible for supervising and managing the security and fire safety of cultural business sites and the security of information networks involved in cultural business activities; the industrial and commercial administrative departments are responsible for supervising and managing matters such as the registration of cultural business units, and investigating and punishing unlicensed business activities in accordance with the law.
Administrative departments such as press and publication (copyright), telecommunications, transportation, and health shall, in accordance with their respective responsibilities, do a good job in the management of the cultural market in accordance with the law. Article 8: Units and individuals that have made outstanding achievements in the management and operation of the cultural market in accordance with the law, and have made meritorious service in reporting and stopping illegal activities, shall be commended and rewarded by the people's governments at or above the county level or cultural administration and other departments. Chapter 2 Licensing and Registration Article 9 To establish a cultural business unit or engage in cultural business activities, an application must be submitted to the relevant administrative department in accordance with the law. For those who meet the conditions, the relevant administrative departments shall handle the procedures within the statutory time limit. Article 10 The establishment of commercial entertainment venue operating units, performance brokerage agencies, artistic performance groups, audio and video product wholesale, retail, and rental units, and Internet Internet service business establishment operating units must obtain permission from the cultural administrative department in accordance with the law before filing with the industrial and commercial administration. The management department applies for a business license. After obtaining a business license, the entertainment venue operating unit shall register with the local county-level public security department within 15 days; the performance agency and the theatrical performance group shall register with the cultural administrative department that issued the license within 90 days. Article 11 To establish a commercial Internet cultural unit, an application must be submitted to the cultural administrative department of the provincial people's government. The cultural administrative department of the provincial people's government shall provide preliminary review opinions within 20 days from the date of acceptance of the application and submit it to the cultural administrative department of the State Council for approval. Article 12 To hold commercial performances, an application must be submitted to the cultural administrative department of the county-level people's government where the performance is located in accordance with the law, and can only be held after approval.
Tickets can only be sold for commercial performances after being approved by the cultural administrative department.
Commercial art exhibitions and literary competitions shall submit the content of the exhibition and competition and other relevant materials to the cultural administrative department of the people's government at or above the county level in the place of holding for review five days before the event. Article 13 Fine arts operating units, commercial performance venue operating units, cultural brokerage units other than performance brokerage agencies, commercial art training and artistic photography and videography units shall present a copy of the business license to the county within 20 days after receiving the business license. The cultural administrative department of the people's government at or above the level shall be registered.
Audio-visual product publishing and wholesale units that hold audio-visual product ordering fairs or trade fairs in this province shall notify the cultural administrative department of the county-level people's government at the place where the event is held 5 days before the event. Article 14 Individual actors and individual performance agents shall register with the cultural administrative department of the local county-level people's government within 20 days from the date of receiving the business license. Article 15 If laws and regulations stipulate that engaging in cultural business activities requires the application of fire safety, sanitation and other licenses, they shall be handled in accordance with the law. Chapter 3 Business Article 16 When carrying out cultural business activities, the unity of social benefits and economic benefits shall be adhered to.
