Measures of Xining Municipality for the Administration of Surveying and Mapping

Article 1 In order to strengthen the management of surveying and mapping work and meet the needs of urban planning and urban construction, these Measures are formulated in accordance with the provisions of the Surveying and Mapping Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC) and the Measures for the Implementation of the Surveying and Mapping Law of People's Republic of China (PRC) in Qinghai Province, combined with the actual situation of this Municipality. Article 2 All units and individuals engaged in surveying and mapping activities within the administrative area of this Municipality shall abide by these Measures.

Military surveying and mapping units engaged in civil surveying and mapping activities within the administrative area of this Municipality shall also abide by these measures. Third Xining city planning and land management department in charge of the city's surveying and mapping work, its responsibilities are:

(1) Organizing the implementation of compulsory surveying and mapping tasks within the administrative area of this Municipality;

(two) the preparation of basic surveying and mapping planning and cadastral surveying and mapping planning within the administrative area of this Municipality;

(three) responsible for the supervision and management of the surveying and mapping market, surveying and mapping qualification verification, registration, surveying and mapping project registration, certification and surveying and mapping contract review for units engaged in surveying and mapping activities within the administrative area of this Municipality;

(four) responsible for the supervision and management of urban plane, elevation control survey, topographic survey, aerial photogrammetry, engineering survey and real estate cadastral survey within the administrative area of this Municipality;

(five) responsible for the management of urban planning setting-out, building setting-out, line inspection, completion survey and urban engineering survey, municipal engineering, cadastral and underground engineering;

(six) according to the relevant provisions of the state and our province, organize the compilation of topographic maps, thematic maps and atlases of various scales within the administrative area of this Municipality;

(seven) responsible for receiving, collecting, sorting out and keeping the basic surveying and mapping achievements of this Municipality and related professional surveying and mapping achievements, and conducting quality supervision and confidentiality inspection on the surveying and mapping achievements;

(eight) responsible for the construction and management of urban geographic information engineering;

(nine) responsible for the management of surveying markers within the administrative area of this Municipality. Article 4 All units and individuals who need to engage in all kinds of surveying and mapping activities within the administrative area of this Municipality shall hold the surveying and mapping qualification certificate issued by the national and provincial surveying and mapping administrative departments, and undertake the corresponding surveying and mapping business in this Municipality only after the qualification examination and registration by the municipal surveying and mapping administrative department and the Xining Urban Surveying and Mapping License. Fifth units and individuals engaged in surveying and mapping activities within the administrative area of this Municipality shall abide by the following provisions:

(a) the use of Xining unified plane coordinate system and height system, unified map framing and numbering, as well as surveying and mapping benchmarks and standards stipulated by the state;

(two) repeated surveying and mapping at the same scale shall not be carried out in the same area;

(three) strictly implement the national surveying and mapping fees. Article 6 Surveying and mapping units engaged in the following surveying and mapping business within the administrative area of this Municipality shall register the surveying and mapping project with the municipal administrative department of surveying and mapping in advance, and report the technical design of the project to the examination and approval before operating:

(a) the project of laying plane control points (nets) and fourth-class (including fourth-class) leveling points (nets) above the first-class small triangle (including first-class traverse);

Large-scale topographic maps with surveying and mapping area greater than 0.25 square kilometers (1: 500, 1: 1000,1:2000);

(3) Cadastral mapping and boundary mapping within the administrative area of this Municipality;

(four) the compilation and publication of topographic maps, thematic maps and atlases of various scales within the administrative area of Xining City.

Surveying and mapping tasks included in the provincial and municipal basic surveying and mapping planning are no longer registered separately. Seventh construction units to apply for construction land and surveying and mapping data used in construction projects, shall be examined and sealed by the municipal administrative department of Surveying and mapping; Without examination and seal, urban planning, land management, urban construction management, planning and design departments will not be recognized. Article 8 Surveying and mapping personnel who conduct surveying and mapping activities according to law shall hold a surveying and mapping work permit uniformly issued by the state, and relevant units and individuals shall provide convenience and shall not hinder or obstruct them.

Surveying and mapping administrative law enforcement personnel shall supervise and inspect surveying and mapping activities according to law, and the relevant units and individuals shall not refuse or hinder them. Ninth in order to ensure the systematicness and integrity of surveying and mapping data, all units undertaking surveying and mapping tasks within the administrative area of this Municipality shall submit surveying and mapping reports and permanent surveying markers to the municipal administrative department of surveying and mapping. Article 10 The municipal administrative department of surveying and mapping shall regularly compile the catalogue of surveying and mapping achievements in this Municipality and provide it to users.

Without the consent of the original surveying and mapping results using department, users shall not copy, transfer or lend surveying and mapping results without authorization. Eleventh surveying and mapping results need to be kept confidential, and the determination, change, decryption and use of the classification shall be carried out in accordance with the provisions of the Law on Guarding State Secrets. Twelfth surveying and mapping results shall be paid for, and the specific measures and charging standards shall be implemented in accordance with the relevant provisions of the state.

If the surveying and mapping results belong to intellectual property rights, the provisions of relevant laws shall apply. Article 13 The national first-class and second-class surveying markers within the administrative area of this Municipality and the third-class and fourth-class surveying markers in the urban plane coordinate system, the first-class and second-class surveying markers of small triangles and traverse points, and the boundary markers and boundary markers of administrative boundaries belong to the state property and are protected by state laws. No unit or individual may move or damage it without authorization. If it is really necessary to move, dismantle or cover due to construction needs, the construction unit shall obtain the consent of the sign setting unit and report it to the provincial administrative department of Surveying and mapping for approval, and the municipal administrative department of Surveying and mapping shall supervise the implementation. The construction unit shall pay the relocation expenses as required.

The funds for the management and protection of permanent surveying markers shall be audited and paid by the financial department of the Municipal People's Government.
