What procedures and materials are needed for marriage registration?

Application, examination and registration are three links in the process of marriage registration.

(1) application

Those who meet the requirements for applying for marriage registration shall, with their registration photos, relevant certificates and supporting materials, * * * apply for marriage registration at the marriage registration office where one party's household registration is located, and fill in the declaration required for applying for marriage registration on the spot.

Different people have different requirements on the documents and supporting materials for applying for marriage registration. For example, when China citizens apply for marriage registration in China, they need to hold their valid marriage examination certificate, ID card, household registration book, single certificate and a statement that they are not related by blood (lineal blood relatives and collateral blood relatives within three generations). If it is a divorce, you also need to bring divorce papers.

Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently and temporarily, and foreigners who come to settle in China) must hold their valid passports, foreigners' residence permits issued by public security organs or valid certificates of temporary residence in China, and certificates of marital status issued by domestic notary offices certified by the Ministry of Foreign Affairs (or authorized organs of the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country.

(2) Review

The marriage registration office will check and review the submitted application materials to find out whether the marriage application is correct. If there is any ambiguity, the marriage registration authority will ask the parties and ask them to provide relevant materials when necessary.

(3) Registration and licensing

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and issue a marriage certificate to the parties; For divorced people, the marriage registration office will cancel their divorce certificates; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons why it cannot be registered.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) application

If both parties voluntarily divorce, they shall conclude a written divorce agreement, apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials as required:

1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;

2. Relevant valid identity documents that meet the requirements, such as household registration book, identity card, pass or passport;

3. An application for divorce registration filled in on the spot.

(2) Accept

The staff will conduct a preliminary examination of the materials provided by the parties in accordance with the regulations. After the divorce application is verified by the first instance, a receipt for accepting the divorce registration application will be issued. Those who do not meet the requirements for divorce registration will not be accepted, and if necessary, a Notice of Rejection of Divorce Registration Application will be issued at the request of the parties concerned.

(3) cooling-off period

The marriage registration office shall, within 30 days from the date of receiving the application for divorce registration and issuing a receipt for accepting the application for divorce registration to the parties concerned, if either party disagrees with the divorce, it may present its valid identity certificate and the receipt for accepting the application for divorce registration (if it is lost, no written explanation is required) to the marriage registration office that accepts the application for divorce registration, and fill out the Application for Withdrawal of Divorce Registration in accordance with the relevant provisions of the application for withdrawal of divorce registration. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the end of the cooling-off period of divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, it shall be deemed that the application for divorce registration has been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday is the expiration date), both parties shall go to the marriage registration office to handle the divorce certificate with the divorce agreement, marriage certificate, two recent bareheaded photos of both parties, passport, pass, ID card and other relevant documents and materials stipulated in the Marriage Registration Code. The marriage registration authority shall conduct an examination according to the provisions of the Marriage Registration Code. If the divorce registration conditions are not met, the divorce registration formalities shall not be handled, and if the party concerned requests to issue a notice of not handling the divorce registration, it shall be issued.

(5) Registration (certification)

According to the regulations, the marriage registration authority shall carry out relevant registration and issue divorce certificates to the parties.
